S-1040 - 06/10/2003 - SPECIAL USE - Ordinancesy f ORDINANCE 2003- ZO -SU -S -1040 AN ORDINANCE AMENDING ORDINANCE S -919 BY EXTENDING THE EXPIRATION DATE TO THE SPECIAL USE GRANTED THEREIN (Christ Church of Oak Brook, 501 Oak Brook Road, Oak Brook, IL 60523) WHEREAS, Christ Church ( "Church ") has applied to the Village for a five -year extension of special use Ordinance S -919, passed on December 8, 1998, which approved a special use to allow the property located at 3212 York Road to be utilized as a temporary office for a period of five (5) years or until substantial completion of a planned addition to the existing church building, whichever occurred first, and WHEREAS, as currently drafted, the special use will expire on December 8, 2003, as the Church has not proceeded with its planned addition, and WHEREAS, the Church indicates that it has a continuing need for the temporary office use at 3212 York Road and has requested an extension of the special use for a second five -year term, and WHEREAS, the owner of the Special Use Property, the Church, has requested that the Village Board allow a second five -year term, and WHEREAS, the President and Board of Trustees of the Village of Oak Brook deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein Section 2 That the special use granted pursuant to Ordinance S -919 is hereby amended by extending the period of time the property at 3212 York Road may be used as a temporary office for an additional five (5) years, that is, to December 8, 2008, or until substantial completion of a planned addition to the existing church building, whichever occurs first Section 3 That except as amended hereby, the special use granted pursuant to Ordinances S- 237, S -346, S -382, S -511, S -583, S -729 and S -919 be and the same is hereby ratified and confirmed in all respects Section 4 That this ordinance shall be in full force and effect from and after passage and approval pursuant to law PASSED THIS 10th day of June , 2003 Ayes Trustees Aktipis, Caleel, Korin, Miologos and Yusuf Nays None Absent Tru R t P P C'rP i 2 Abstain ,,1,,,,0 APPROVED THIS 10th day of June �Y. 0 061 1 Approved as to Form fr Village Attorney WORDDOGS -ORDS /Christ Church 2003 Published Date Ordinance 2003- ZO -SU -S- 1040 Amending S -919, Granting Extension to Special Use Permit, Christ Church, 501 Oak Brook Road, Page 2 , 2003 Village Pres ent Not Published XX Paper 501 Oak Brook Road, 3202 and 3212 York Road, Oak Brook, Illinois, which property is legally described as: Lot 1 in the Christ Church Resubdivision of part of the Northwest Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois, recorded on the 9th day of September, 1986 as Document No R86- 107588 and Plat of Survey of Lot "B" (except the North 250 feet thereof measured along the East line) according to the survey of part of the West half of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, recorded November 16, 1897 as Document 65421 in DuPage County, Illinois Permanent Parcel Nos 06 -36- 107 -002, 06 -36- 107 -001 and 06 -36- 100 -004
