G-722 - 06/24/2003 - ALCOHOL - OrdinancesORDINANCE 2003- AL -RR -G- 722 AN ORDINANCE AMENDING SUBSECTION B OF SECTION 4 -1 -13 ( "LICENSE RENEWAL, FAILURE TO RENEW ") AND SUBSECTION A ( "INSURANCE REQUIREMENTS ") OF SECTION 4 -1 -15 ( "CONDITIONS OF LICENSES ") OF CHAPTER 1 ( "LIQUOR CONTROL ") OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, the President and Board of Trustees of the Village of Oak Brook on May 14, 1996, enacted Ordinance G -570, known as "the Oak Brook Liquor Control Ordinance ", which has been codified as Chapter 1 ( "Liquor Control ") of Title 4 ( "Business and License Regulations ") of the Village Code of the Village of Oak Brook, and WHEREAS, the Village President, as Local Liquor Commissioner, has from time to time recommended amendments to Chapter 1 ( "Liquor Control ") of the Village Code of the Village of Oak Brook, and WHEREAS, the Village President has recommended deleting the requirement that persons applying for renewal of a liquor license in good standing be fingerprinted, and WHEREAS, the Village President has recommended an amendment to the insurance requirements contained within Section 4 -1 -15, and WHEREAS, the Board of Trustees has reviewed the proposed amendments and has approved the changes recommended by the Village President, and WHEREAS, the President and Board of Trustees deem passage of this ordinance to be in the best interest and in pursuance of the general welfare of the Village of Oak Brook NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein Section 2 That Subsection B of Section 4 -1 -13 of the Village Code of the Village of Oak Brook is amended to read as follows B In order to assure eligibility to renew the license, the licensee shall either certify to the continued compliance of the premises with the conditions pursuant to which the license was initially granted, including the approved floor plan, or shall submit a request for approval of certain changes in the licensed business pursuant to subsection 4- 1 -20C1 of this Chapter The renewal application shall be on forms provided by the Village and shall include the same information as provided for an original application, to determine whether the licensee is, and will continue to be, qualified for a license Provided, in lieu of new submittals, the renewal applicant may certify, on forms provided for by the Village, that some or all of the information previously provided by the applicant with any original or renewal application has not changed, and provided further, that Section 4-1-91311, requiring "a completed fingerprint card from each general partner, sole proprietor, general manager and liquor manager, and any officer of a corporation or limited liability company Ordinance 2003- AL -RR -G- 722 Amending Title 4, Chapter 1, Alcoholic Liquor, Page 2 who owns either directly or indirectly more than five percent (5 %) of the outstanding shares of any class of the capital stock of said corporation or more than five percent (5 %) ownership interest of said limited liability company', shall not apply in the case of a renewal of a liquor license in good standing Section 3 That Subsection Al of Section 4 -1 -15 of the Village Code of the Village of Oak Brook is amended to read as follows A Insurance Requirements 1 All licensees shall have in effect, prior to the issuance of any liquor license hereunder, general liability insurance with limits of not less than one million dollars ($1,000,000 00) combined single limit or one million dollars ($1,000,000 00) per occurrence and per aggregate, naming the Village of Oak Brook as a party insured, and shall submit to the Village a certificate or policy of insurance as evidence of such coverage, issued by an insurance company licensed to do business in the State and have a "Best" rating acceptable to the Village The effective period of such insurance coverage shall coincide with the period the liquor license is in effect Section 4 That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law Section 5 That the Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law PASSED THIS 24th day of June , 2003 Ayes Trustees Aktipis, Craig, Korin and Yusuf Nays None Absent Trustees Caleel and Miologos Abstain None APPROVED THIS 24th day of June �nnQ j ✓y e ��ae„ Z,,J l h Approved as to Form Village Attorney Ordinance 2003- AL -RR -G -722 Amending Title 4, Chapter 1, Alcoholic Liquor, Page 3 Published 6 -25 -2003 Pamphlet form Date Paper Not Published
