AN ORDINANCE AMENDING ARTICLE A (VILLAGE MANAGER)
OF CHAPTER 5 (APPOINTED VILLAGE OFFICIALS)
OF TITLE 1 (ADMINISTRATION) OF THE VILLAGE CODE
OF THE VILLAGE OF OAK BROOK RELATIVE TO
POWERS OF INTERIM VILLAGE MANAGER
WHEREAS, Village Manager Richard Boehm resigned that position effective March 10, 2007, and
WHEREAS, the Board of Trustees appointed a Search Committee and authorized a process to fi
the Village Manager's position at its Meeting on February 27, 2007, and
WHEREAS, Assistant Village Manager Jeffrey Moline was appointed Acting Village Manager by the
Village President and approved by the Board of Trustees on March 13, 2007, and
WHEREAS, Jeffrey Moline was reinstated as Acting Village Manager by unanimous vote of the
Board of Trustees on May 15, 2007, after having been removed by the Village President on May 8, 2007,
and
WHEREAS, Jeffrey Moline has resigned as Assistant Village Manager and Acting Village Manager
effective July 12, 2007, and
WHEREAS, the process for appointing a new Village Manager is unlikely to be completed by July
12, 2007, and it will be necessary to appoint an Acting, Interim, or Temporary Village Manager to serve until
the new Village Manager is appointed and takes office, and
WHEREAS, the Village President and Board of Trustees deem it necessary and advisable to define
and limit the appointment, duties and authorities of any Acting, Interim, or Temporary Village Manager, or
person exercising such duties and authorities,
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 The foregoing recitals are incorporated herein as findings of the corporate authorities
Section 2 Title I (Village Administration), Chapter 5A (Village Manager) of the Municipal Code shall
be amended to add a new Section 1 -5A -5, as follows
1 -5A -5: ACTING, INTERIM OR TEMPORARY MANAGER:
A Notwithstanding Section 1 -5A -3, no Acting, Interim, or Temporary Village
Manager, or person exercising such duties and authorities, shall have any
authority to hire, discharge, reassign, or discipline any Village employee or to
make any "temporary' appointments, but exclusive of seasonal employees,
without the prior approval of the Board of Trustees at a Regular or Special
Meeting
B Notwithstanding Section 1 -5A -4, no Acting, Interim, or Temporary Village
Manager, or person exercising such duties and authorities, shall have any
authority to authorize any purchase orders or contracts for supplies, materials, or
equipment, or for contractual services, or any public improvement contracts
involving the expenditure of more than five thousand dollars ($5,000), without the
prior approval of the Board of Trustees at a Regular or Special Meeting
C Consistent with the Illinois Municipal Code and the Village Municipal Code, no
Acting, Interim, or Temporary Village Manager, or person exercising such duties
and authorities, shall have any authority to modify the organizational structure,
fob descriptions, or Budget authorizations of the Village as previously approved
by the Board of Trustees, without the prior approval of the Board of Trustees at a
Regular or Special Meeting
Section 3 All ordinances in conflict herewith are repealed to the extent of such conflict
Section 4 This ordinance shall be in full force and effect from and after its passage, approval and
publication as provided by law
