AN ORDINANCE AMENDING THE 2005 BUDGET
WHEREAS, the Village President and Board of Trustees has authorized payment of attorney fees
related to the lawsuit of Kevin Quinlan, et al., Plaintiffs and John Carpino, Intervening Plaintiff, v. Stelios
Aktipis, et al., Defendants (Eighteenth Judicial Circuit, DuPage County, Wheaton, Illinois, Case Number
2004 MR 900); and
WHEREAS, due to uncertainties surrounding the lawsuit, the 2005 Budget did not include an
appropriation for payment of these fees; and
WHEREAS, it is recommended that the 2005 Budget for the General Corporate Fund be
amended in order to budget funds for the payment of these attorney fees.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS that the following
transfers are hereby authorized:
Section 1: The recitals above are hereby incorporated into and made a part of this ordinance.
Section 2: The General Corporate Fund budget is amended by increasing the amount budgeted in
Account 121 -7634, "Litigation Amongst the Corporate Authorities ", by $128,700, the increase which shall
be funded by this Fund's fund balance.
Section 3: This ordinance shall be in full force and effect from and after its passage and approval
as required by law.
Section 4: All ordinances or parts thereof in conflict with the provisions of this ordinance be and
the same are hereby repealed to the extent of such conflict.
