G-865 - 08/26/2008 - TAX - OrdinancesORDINANCE 2008- TX -HM -G -865 AN ORDINANCE AMENDING ORDINANCE G -817 IN RELATION TO THE HOTEL BEAUTIFICATION DISTRICT WHEREAS, with the passage of Ordinance G -817 on November 28, 2006, the President and Board of Trustees established a Hotel Beautification District (the "Hotel District ") which included public right -of -way and adjacent properties along 22nd from Illinois Route 83 to the east Village limits, along Spring Road from 22nd Street to 16th Street, and along Jorie Boulevard from 22nd Street to 31 st Street, and WHEREAS, the Board has determined that it is in the best interest of the Village to amend Ordinance G -817 to include a portion of York Road between the 1 -88 Off -Ramp onto York Road and Dover Drive in the Hotel Beautification District NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein Section 2 That Section 5 -5 -2 ( "Tax Imposed ") of Chapter 5 ( "Municipal Hotel Tax ") of Title 5 ( "Municipal Taxes ") of the Village Code of the Village of Oak Brook be amended by deleting paragraph F in its entirety and substituting the following language F There is hereby created a Hotel Beautification District to include public right -of- way and adjacent properties along 22nd Street from Illinois Route 83 to the east Village limits, along Spring Road from 22nd Street to 16th Street, along Jone Boulevard from 22nd Street to 31 St Street and a portion of York Road between the 1 -88 Off -Ramp onto York Road to Dover Drive Certain of the tax revenues imposed under paragraph B of this section may be applied to the installation and maintenance of improvements in the District created herein, including landscape and hardscape features, in the discretion of the Village Board, for the purpose of promoting tourism and conventions and attracting nonresident overnight visitors to the Village Section 3 That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law Section 4 That all ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict APPROVED THIS 26th day of August, Ayes Nays Ordinance 2006- TX -HM -G -865 Amending Section 5 -5 -2 of the Village Code York Rd Properties Page 2 of 2 PASSED THIS 26th day of August, 2008 Trustees Carson Kennedy, Manofsky, Saiyed, Sanford and Wolin None Absent None Abstain None ®f= 0', d ATTEST Charlotte K Pruss Village Clerk
