S-1271 - 09/22/2009 - ZONING - OrdinancesORDINANCE 2009- ZO -V -S -1271 AN ORDINANCE GRANTING A VARIATION ALLOWING DRIVEWAY GATES FOR THE PROPERTY AT 44 WINDSOR DRIVE IN THE VILLAGE OF OAK BROOK (PIN 06 -25- 200 -031) WHEREAS, an application has been filed by John Groth and Marilyn Groth (collectively the "Petitioner "), requesting a variation to Section 13 -3 -14A of the Zoning Ordinance to allow driveway gates at 44 Windsor Drive, Oak Brook, Illinois, and WHEREAS, on August 4, 2009, the Zoning Board of Appeals conducted a public hearing on the request for a variation, pursuant to due and appropriate legal notice, and recommended approval of the variation subject to certain conditions, and WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the factors required for approval of the requested variation and made specific findings, including that the variation will not endanger the public health, safety and welfare, and that there will be no substantial injury to other property in the neighborhood, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Zoning Board of Appeals and deem the variation, as set forth below, to be in the best interests of the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein Section 2 The Petitioner is hereby granted a variation to Section 13 -3 -14A of the Zoning Ordinance to allow driveway gates at 44 Windsor Drive, Oak Brook, Illinois, subject to the following condition The design and installation of the driveway gates shall be in conformance with the plans submitted to the Zoning Board of Appeals 2 The Petitioner shall comply with all other applicable rules and ordinances of the Village of Oak Brook Section 3 The variation and the scope of this ordinance are limited and restricted to the property located at 44 Windsor Lane, which is legally described as follows LOT 59 IN YORK WOODS UNIT 5, A SUBDIVISION OF PART OF THE NORTH EAST 1/4 OF SECTION 25, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINICPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 18, 1982 AS DOCUMENT R82- 47886, IN DUPAGE COUNTY, ILLINOIS Permanent Index Number 06 -25- 200 -031 Section 4 If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance Ordinance 2009- ZO -V -S -1271 Variation - 44 Windsor Drive 06 -25- 200 -031 Page 2 of 2 Section 5.
