G-683 - 09/25/2001 - COMMUNITY DEVELOPMENT - OrdinancesOP ORDINANCE 2001- CD -BC -G -683 AN ORDINANCE AMENDING SECTIONS 10 -1 -1 AND 10 -1 -2 OF CHAPTER 10 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATING TO BUILDINGS AND BUILDING REGULATIONS WHEREAS, the Village President and Board of Trustees have heretofore established rules and regulations for the construction, alteration, repair and conversions of building within the Village of Oak Brook; and WHEREAS, said provisions have been codified as Chapter 10 of the Village Code of the Village of Oak Brook; and WHEREAS, the Village President and Board of Trustees deem the amendment of said regulations to be in the best interest of the public health, safety and welfare; and WHEREAS, 65 ILCS 5/1 -3 -2 specifically authorizes the adoption of codes and public records by reference; and WHEREAS, the codes and portions thereof herein adopted have been filed in the office of the Village Clerk and available for public use and inspection and have been on file for a period in excess of 30 days prior to the passage of this ordinance as required by Section 5/1 -3 -2 of Chapter 65 of the Illinois Compiled Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows- Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That Section 10 -1 -1 of the Village Code of the Village of Oak Brook be and is hereby amended to read as follows: "Section 10 -1 -1: BUILDING CODES ADOPTED BY REFERENCE': There are hereby adopted by reference the following regulations governing all single - family residential buildings and appurtenances, multi - family residential buildings and appurtenances, and all other buildings and structures hereinafter erected, installed, altered, converted, remodeled or structurally repaired, demolished, moved or their use or occupancy established or changed collectively to be known as the OAK BROOK BUILDING CODE. INTERNATIONAL BUILDING CODE First Edition, (2000) published by the International Code Council, Inc. in cooperation with the Building Officials and Code Administrators International, Inc. (BOCA), International Conference of Building Officials (ICBO), and Southern Building Code Congress International, Inc. (SBCCI). '50 ILCS 220/1. Section 3: That Section 10 -1 -2 of the Village Code of the Village of Oak Brook be and is hereby amended to read as follows: Section 10 -1 -2: AMENDMENTS: The Oak Brook Building Code is amended and changed in the following respects: A. International Building Code Amendments: The International Building Code adopted in Section 10 -1 -1 of this Chapter is amended as follows: 1. Chapter 1 Administration a. Subsection 101.1 Title. Is amended by inserting the words "Village of Oak Brook, IL." b. Subsection 102.4 Referenced codes and standards Is amended to read as follows: The codes and standards referenced in this Code shall be considered part of the requirements of this Code to the prescribed extent of each such reference. Where differences occur between provisions of this Code, the referenced Codes and standards and any other provision of the Village Code, the most restrictive provision shall apply. C. Subsection 103.1 Creation of enforcement agency Is amended to read as follows- Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 3 The Department of Community Development is responsible for the enforcement of this Code. Any reference to a Department of Building Safety shall be interpreted to mean the Department of Community Development of the Village of Oak Brook. d. Subsection 103.2 Appointment Is deleted in its entirety. e. Subsection 103.3 Deputies. Is amended to read as follows- The Director of Community Development is authorized to designate one or more employees as deputies who may exercise all powers of the Director of Community Development under the direction of the Director. f Subsection 104.8 Liability. Delete reference to "member of the Board of Appeals." g. Subsection 105.2 Work exempt from permit. Is amended to read as follows: Exemptions from permit requirements of this Code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this Code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following- 1. Painting, papering, tiling, carpeting, cabinets, counter tops, siding, windows and similar work with the condition that no structural, plumbing, or electrical changes or alterations are associated with these activities h. Subsection 105.5.5 Expiration. Is amended by changing the timeframe from 180 days to 90 days. 1. New Subsection 105.5.1 "All building permits which do not expire for reasons stated in subsection 105.5 shall be in effect and valid for two years. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than, 180 days each. The extension shall be requested in writing and justifiable cause demonstrated." j. Section 107 Temporary Structures and Uses is amended by deleting any reference to Uses. k. Subsection 107.1 General. Is amended by deleting any reference to temporary uses I. Subsection 107.2 Conformance. Is amended by deleting any reference to temporary uses. M. Subsection 107.3 Temporary power. Is amended by deleting any reference to temporary uses. n Subsection 107.4 Termination of approval. Is amended by deleting any_reference to temporary uses. o. Subsection 108.2 Schedule of permit fees Is amended to read as follows: Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 4 On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as those specified in Section 10-4 -1 of this Code. P. Section 112 Board of Appeals is renamed "Appeals ". q. Subsection 112.1 General. Is amended to read as follows: A person shall have the right to appeal a decision of the building official. For the purposes of this Code, all appeals of decisions relating to this Code shall be referred to the Circuit Court of DuPage County r. Subsection 112.2 Limitations on authority. Is deleted in its entirety. S. Subsection 112.3 Qualifications. Is deleted in its entirety. t. Subsection 113.4 Violation penalties. Is amended to read as follows: Any person who violates a provision of this Code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the building official, or of a permit or certificate issued under the provisions of this Code, shall be subject to fines and penalties as those specified in Section 1 -3 -1 of this Code. 2. Chapter 12 Interior Environment a. Subsection 1203.1 Equipment and systems. Is amended to read as follows: Interior spaces intended for human occupancy shall be provided with space - heating systems capable of maintaining a minimum indoor temperature of 65° F (18° C) at a point 3 feet (914 mm) above the floor on the design heating day. 3. Chapter 18 Soils and Foundations a. Subsection 1805.1 General. Is amended by adding a statement, which prohibits the use of trench foundations. 4. Appendix A Employee Qualifications Is deleted in its entirety. 5. Appendix B Board of Appeals. Is deleted in its entirety. 6. Appendix D Fire Districts. Is deleted in its entirety. 7. Appendix H Signs. Is deleted in its entirety. 8. Automatic sprinkler systems shall be installed and maintained in full operating condition in all parts of all buildings and structures as specified in Sections 10 -2 -1 through 10 -2 -6 of this Code. r' Ordinance 2001-CD-BC-G-683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 5 B International Residential Code Amendments: The International Residential Code adopted in Section 10 -1- 1 of this Chapter is amended as follows. 1. Is amended to read as follows: Any person who violates a provision of this Code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the building official, or of a permit or certificate issued under the provisions of this Code, shall be subject to fines and penalties as those specified in Section 1 -3 -1 of this Code. g. Subsection 109.1 Application for appeal is amended to read as follows: A person shall have the right to appeal a decision of the building official. For the purposes of this Code, all appeals of decisions relating to this Code shall be referred to the Circuit Court of DuPage County Subsections 109.1 through 109 7 are deleted in their entirety. 2. Chapter 3 General Regulations a. Subsection 309.1 Space - heating systems. State of Illinois Plumbing Code Amendments- The State of Illinois Plumbing Code adopted in Section 10 -1- 1 of this Chapter is amended as follows: 1. All fees specified in the in the State of Illinois Plumbing Code shall be superseded and replaced by those set forth in Section 10-4 of the Village Code. 2. The State of Illinois Plumbing Code adopted pursuant to Section 10 -1 -1 of the Village Code is amended as follows: a. Section 890.230. Safe Pan Material and Construction. Is amended by deleting "ABS" from the entire Section. b. Section 890.320. Types of Joints. (e) Flared Joints. Is amended to read as follows: Flared joints for soft copper water tubing shall be made with approved fittings. The tubing shall be expanded with a proper flaring tool. (See Appendix C: Illustration B) (h) Brazed Joints. Is amended to read as follows: Brazed joins shall be made by first cleaning the surface to be joined down to the base metal, applying flux approved for such joints and for the filler metal to be used, and making the joints by heating to a temperature sufficient to melt the approved brazing filler metal on contact. (See Section 890.330(b) ) (k) Bituminized Fiber Pipe Joints is deleted in its entirety (1) Plastic Pipe Joints. Delete 2) Joints and Fittings in Plastic Pipe in its entirety. (n) No-Hub Soil Pipe Joints is deleted in its entirety. (p) Grooved Type Mechanical Couplings is deleted in its entirety. C. Section 890.330. Special Joints (c) Slip Joints Is amended to read as follows- In drainage and water piping, slip joints may be used on the inlet side of the trap or in the trap seal, and on the exposed fixture supply. Slip joints shall not be used in any inaccessible piping. (f) Grooved Type Mechanical Couplings is deleted in its entirety. (g) Plastic Pipe to Non - Plastic Pipe Joints. 1) Pressure Piping. A) Delete in its entirety. D) Delete in its entirety. Traps (e) Drum Traps. Is amended by adding the following: All traps must be visible and accessible. e Section 890.510. Grease Interceptor Requirements. Is amended as follows: a) (2) Minimum Size. Is amended by changing the words 'one -half' and "sixty" to read "one- hundred (100) percent " a) (7) Is added to read "No grease trap shall be allowed to handle more than one establishment." f. Section 890.920. Vertical Piping. b) Cast Iron Soil Pipe Is amended to read as follows: Cast iron soil pipe shall be supported at not less than every story height and at its base. e) Lead Pipe. Is deleted in its entirety g. Section 890.930. Horizontal Piping. b) Cast Iron Soil Pipe. Is amended to read as follows: Where joints occur, suspended cast iron pipe shall be supported within 18 inches of each hub or point and at not more than five (5) foot intervals; however, pipe exceeding five (5) feet in length may be supported at not more than ten (10) foot intervals. (e) Lead Pipe is deleted in its entirety. h. Section 890.1110. Quality of Water Supply. Is amended to read as follows: All premises intended for human habitation or occupancy shall be provided with a potable water supply. In buildings with municipal water and a private well, the municipal water system will be protected from contamination by use of an R P Z valve. Also, all piping from the well will be classified non - potable water and meet Section 890 1120 identification. i. Section 890.1150 Water Service Pipe Installation. Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 10 a) (3) Is amended by changing the minimum depth for any water service pipe from "36 inches" to "60 inches ". j. Section 890.1190. Water Supply Control Valves and Meter (a) Is amended to read as follows: A full -port shut -off valve shall be located near the curb or property line and immediately inside the building, both on the inlet and outlet side of the water meter. When underground, this valve shall be located in a stop box or meter vault. (See Appendix I: Illustration H.) (e) Is amended to read as follows: Valves in the water supply distribution system, except those immediately controlling one fixture supply, when fully opened shall have a cross - sectional area of the smallest orifice or opening through which the water flows at least equal to the cross - sectional area of the pipe in which the valve is installed. All valves shall be full port valves. k. Section 890.1200. Water Service Sizing. (a) Water Service Pipe Sizing. Is amended by changing the water service pipe and fittings from "at least three - fourths (3/4) inch diameter" to read "at least one (1) inch diameter'. I. Section 890 1320. Drainage System Installation (a) Drain - Filled Ground. Is amended to read as follows* A building drain installed in filled ground shall be of cast or ductile iron only. M. Section 890.1340. Determination of Sizes for Drainage System (b) Minimum Size of Building Drain, Horizontal Branches, Drainage Piping. (4) Is amended by changing the size of the drainage system installed from "two (2) inches in diameter" to read "four (4) inches in diameter " n. Section 890.1370. Floor Drains. Size. Is amended by changing the size of the floor drain or drain trap from "two (2) inches in diameter" to read "four (4) inches in diameter." o Section 890.1420. Stack Vents, Vent Stacks, Main Vents. (a) Design. Is amended by adding the NOTE: "No wet venting shall be allowed." (b) Installation. Is amended by adding the Note. "All fixtures and traps shall be vented individually (exceptions being for back to back fixtures) " (e) Building Sub -drain Sump Vent Sizes. Is amended to read as follows Building sub -drain sump vents shall be no smaller than two (2) inches in diameter Ordinance 2001- CD -BC -G- 683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 11 p Section 890.1480. Types of Fixture Trap Vents (c) Vertical Wet Vent. Delete in its entirety. q. Section 890.1490. Installation of Vents for Fixture Traps. (c) Horizontal Branch Drains. Is amended to read as follows. Where a water closet discharges into a branch drain, each fixture discharging into that branch drain shall be individually vented. r. Section 890.1500. Installation of Wet Venting is deleted in its entirety. S. Section 890.1510. Stack Venting. Is amended to read as follows: One - Bathroom Group. Except as provided in Section 890.1490(b), a group of fixtures, consisting of one (1) bathroom group may be installed without individual fixture vents, in a one -story building or on the top floor of a building, provided each fixture drain connects independently to the stack and water closet and bathtub or shower drain enters the stack at the same level and in accordance with the requirement in Appendix A: Table I. (See Appendix K: Illustrations W and X ) t. Section 890.1520. Circuit and Loop Venting. a) Battery Venting is deleted in its entirety. b) Dual Branches is deleted in its entirety c) Vent Connections is deleted in its entirety. f) Circuit and Loop Vented Fixtures is deleted in its entirety. u Section 890.1530. Pneumatic Ejectors is deleted in its entirety. v. Section 890.1580. Size and Length of Vents. (b) Size of Individual Vents. Is amended to read as follows: The diameter of an individual vent shall be at least one and one -half (1 Y2) inches and at least one -half (1/2) the diameter of the drain to which it connects whichever is greater. (d) Size of Circuit Vents is deleted in its entirety. w Section 890. Appendix A. Plumbing Materials, Equipment, Use Restrictions and Applicable Standards Table A. National Electrical Code Amendments: The National Electrical Code adopted in Section 10 -1 -1 of this Chapter is amended as follows: 1. Article 90 Introduction a. Subsection 90 -4 Enforcement. Is amended by adding the following. In addition to the responsibilities set forth in Section 2 -3 -2 of this Code for the Electrical Commission, a person shall have the right to appeal a decision. For the purposes of this Code, all appeals of decisions relating to this Code shall be referred to the Circuit Court of DuPage County. b. Subsection 90 -7 Examination of Equipment for Safety. Is amended by adding the following: a) In all non - residential structures, no secondary devices are allowed, including but not limited to, extension cords, surge strips, power strips or any device that connects the wall or floor receptacle with the unit to be powered Exception: Approved and UL listed battery back -up systems or uninterrupted power supply (U.P.S ) systems 2. Article 230 Service a Subsection 230 -2 Services. Is amended by adding the following f.) The main service to a single- family detached dwelling be a minimum 200 AMP, three (3) wire or greater. 3 Article 250 Grounding Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 14 a. Subsection 250 -2 General Requirements for Grounding and Bonding. Is amended by adding the following: e.) All electrical services must be grounded to the street side of the water service with a dumper across the water meter as well as an outside approved ground rod run to the first means of disconnect. f.) Grounding of swimming pools must be done at the site of the pool with an approved — engineered design ground system. 4. Article 300 Wiring Methods a. Subsection 300 -2 Limitations. Is amended by adding the following. b.) All electrical systems low or line voltage must be installed in metal conduit, E.M.T. (Electrical Metallic Tubing), I.M.C. (Intermediate Metal Conduit), or G.R.C. (Galvanized Rigid Conduit), unless granted special permission from the Electrical Commission. 5. Article 342 Nonmetalic Extensions a. Subsection 342 -3 (a) From an Existing Outlet is deleted. b. Subsection 342 -3 (c) Nonmetallic Surface Extensions is deleted. C. Subsection 342 -7 Installation is deleted. 6. Article 352 Surface Metal Raceways and Surface Nonmetallic Raceways. Is deleted. 7. Article 645 Information Technology Equipment a. Subsection 645 -11 Uninterruptible Power Supplies (UPS). Is amended by adding the following: All uninterruptible power supply (UPS) systems with wet cell battery must be in an approved location and include the following, 1) A listed exhaust fan system to the outside air. 2) An automatic gas detection system to turn on fan. 3) An alarm, both inside and outside of the room location that will sound upon activation. 4) A warning light with appropriate warning signs outside of the room location that will light upon activation 8. Article 700 Emergency Systems a. Subsection 700 -9 Wiring, Emergency System. Is amended by adding the following: Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 15 (e) All fire alarm systems must be installed in metal conduit (E M T. — Electrical Metallic Tubing, I.M.0 — Intermediate Metal Conduit, or G.R.C. — Galvanized Rigid Conduit) (f) All life safety systems must be installed in metal conduit To include but not limited to: 1) Nursing home emergency call systems. 2) Assisted living facilities having emergency call systems. 3) All emergency life safety systems. Safety Code for Elevators and Escalators Amendments: (Reserved) G Intemational Property Maintenance Code Amendments: The International Property Maintenance Code adopted in Section 10 -1 -1 of this Chapter is amended as follows: Chapter 1 Administration Subsection 101.1 Title. Is amended by inserting the words "Village of Oak Brook, IL ". Section 102.7 Referenced codes and standards. Is amended to read as follows: The codes and standards referenced in this Code shall be those that are listed in Chapter 8 and considered part of the requirements of this Code to the prescribed extent of each such reference. Where differences occur between provisions of this Code, the referenced standards and the Village Codes, the more restrictive provisions apply. Section 103 Department of Property Maintenance Inspection is amended to read as follows- Administration and enforcement Subsection 103.1 General. Is amended to read as follows: The official responsible for administration and enforcement of this Code shall be known as the Director of Community Development. Where references are made to the Chief Code Official through the Code, the title Director of Community Development shall be substituted. Subsection 103.2 Appointment is deleted in its entirety. Subsection 103.3 Deputies, is amended to read as follows. The Director of Community Development is authorized to designate one or more employees as deputies who may exercise all powers of the Director of Community Development under the direction of the Director. Section 103.6 Fees is deleted in its entirety Subsection 104.4 Right of Entry is amended to read as follows: The Director of Community Development, or his designee, is authorized to enter the structure or premises during reasonable times to conduct an inspection. Prior to entering into a space not otherwise open to the general public, the Director of Community Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 16 Development, or his designee, shall make a reasonable effort to locate the owner or other person having charge or control of the structure or premises, present proper identification and request entry. If requested entry is refused or not obtained, the Director of Community Development, or his designee, shall pursue recourse as provided by law including, but not limited to, the obtaining of a warrant. Subsection 106.1 Unlawful Acts is amended to read as follows: It shall be unlawful for any person to erect, construct, alter, extend, repair, remove, demolish, maintain, fail to maintain, provide, fail to provide, occupy, let to another or occupy or permit another person to occupy any premises, property, structure or equipment regulated by this Article, or cause same to be done contrary to or in conflict with or in violation of the provisions of this Article, or to fail to obey a lawful order of the Director of Community Development, or his designee, or to remove or deface a placard or notice posted under the provisions of this Article Subsection 111.2 Membership of Board is amended to read as follows: For the purposes of this Code, all appeals of decisions relating to this Code shall be referred to the Circuit Court of DuPage County. Subsection 111.7 Court review is deleted in its entirety Subsection 111.8 Stays of enforcement is deleted in its entirety Subsection 302 8 Motor Vehicles is amended to read as follows: Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 17 Except as provided for in other regulations, no unregistered or uninspected motor vehicle shall be parked, kept or stored except in an enclosed structure and no vehicle shall at any time be in a state of major disassembly, disrepair or in the process of being stripped or dismantled except in an enclosed structure. Subsection 302.10 is added which reads as follows: Maintenance of Water Features. All existing private and public water features, including stormwater retention /detention facilities, must be kept clear of garbage and debris, and any such area not occupied by water must be kept mowed in accordance with the provisions of this Code. Facilities designed to hold water on a continuous basis must be maintained so as to prevent such water from becoming a breeding site for mosquitoes or from becoming a nuisance due to odor or stagnation. Whenever any facility in the Village that is designated and approved as a stormwater management facility does not function as was originally designed, whether because of damage or because of failing into a state of disrepair, it shall be repaired and brought into compliance with its original design specifications, subject to the approval of the Village Engineer. Subsection 302.11 is added which reads as follows: Storage of Construction Materials. Construction materials, including, but not limited to, bricks, lumber, piles of dirt, stone, aggregate or other debris, shall not be stored in any exterior property area except in cases where construction is taking place. In such cases, compliance must be achieved within thirty (30) days of completion of the construction activity. Subsection 302 -12 is added which reads as follows. Storage of Non - construction Materials. Non- construction materials, including, but not limited to machinery, discarded appliances, furniture, household items and other similar items, shall not be stored in any exterior property area unless completely screened by view from all adjacent properties and rights of way. Subsection 303.3 Street Numbers is amended to read as follows: Each structure to which a street number has been assigned shall have such number displayed in a position easily observed and readable from the street addressed to and of a contrasting color from the background. All numbers shall be in Arabic numbers at least four inches (4 ") high. Subsection 303 15 Insect screens is amended to read as follows: Every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas, or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than sixteen (16) mesh per inch (16 mesh /25mm) and every swinging door shall have a self - closing device in good working condition Exception: Screen doors shall not be required where other approved means, such as air curtains or insect repellant fans, are employed. Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 18 Subsection 305 3 3 Screening of Containers is added which reads as follows: With the exception of one and two - family dwellings, all rubbish and garbage containers including commercial dumpsters shall be screened completely from public view by an approved enclosure permitted by the Department of Community Development. Chapter 6 Mechanical and Electrical Requirements Subsection 602.3 Heat Supply is amended to read as follows: Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period of October 15 to May 15 to maintain a temperature of not less than sixty five degrees Fahrenheit (65 °F) (18 °C) in all habitable rooms, bathrooms and toilet rooms. Exception: When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required, provided that the heating system is operating at its fully design capacity. The winter outdoor design temperature for the locality shall be as indicated in Appendix D of the plumbing code. Subsection 602.4 Occupiable work spaces is amended to read as follows: Indoor occupiable work spaces shall be supplied with heat during the period from October 15 to May 15 to maintain a temperature of not less than sixty five degrees Fahrenheit (65 °F) (18 °C) during the period the spaces are occupied. Exceptions: 1. Processing, storage and operation areas that require cooling or special temperature conditions. 2. Areas in which persons are primarily engaged in vigorous physical activities. Ordinance 2001- CD -BC -G -683 Amending Chapter 10 Relating to Buildings & Building Regulations, Page 19 Chapter 7 Fire Safety Requirements Subsection 702 12 Emergency escape. The exception is amended to read as follows- Buildings equipped throughout with ether an automatic fire suppression system or automatic fire alarm system. Section 4: The Village Clerk is authorized and directed to publish this Ordinance in pamphlet form. Section 5• This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner required by law.
