AN ORDINANCE REPEALING CERTAIN INDEMNIFICATION
REQUIREMENTS AND AMENDING CHAPTER 3 (GENERAL
PENALTY) AND CHAPTER 4 (ELECTED VILLAGE
OFFICIALS) OF TITLE 1 (ADMINISTRATION) OF THE
VILLAGE CODE OF THE VILLAGE OF OAK BROOK
WHEREAS, the Village Code provides for the indemnification of Village officials under certain
circumstances and adopted a comprehensive amendment to Chapter 3 (General Penalty) of Title 1
(Administration) of the Village Code with the passage of Ordinance 2005- IDEM- BD +PL -EX1 -G -776 on
March 22, 2005, and
WHEREAS, the Local Governmental and Governmental Employees Tort Immunity Act 745 ILCS
10/1 -101 et seq. also provides for the indemnification of the Village officials under the same
circumstances provided for in the Village Code; and
WHEREAS, the corporate authorities have determined that the indemnifications provided by the
Village Code are identical to the indemnifications provided by the Act and therefore the Village Code is
redundant and susceptible to misinterpretation
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows
Section 1 The foregoing preambles are restated and incorporated herein by reference as though
fully set forth herein
Section 2 • Sections 1 -3 -3 and 1 -4 -3 of the Village Code are hereby repealed.
Section 3 If any section, paragraph, clause or provision of this ordinance shall be held invalid,
the invalidity thereof shall not effect any of the other provisions of this ordinance
Section 4 All ordinances in conflict herewith are hereby repealed to the extent of such conflict
Section 5 This ordinance shall be in full force and effect from and after its passage, approval
and publication as provided by law
