S-1206 - 09/25/2007 - ZONING - OrdinancesORDINANCE 2007- ZO -SU -S -1206 AN ORDINANCE GRANTING A SPECIAL USE FOR AN EDUCATIONAL FACILITY FOR THE OAK BROOK PARK DISTRICT LOCATED AT 115 CANTERBERRY LANE IN THE VILLAGE OF OAK BROOK (P I.N 06 -36- 202 -017 AND 06 -36- 202 -018) WHEREAS, an application has been filed by Oak Brook Park District (the "Petitioner"), requesting a special use for an educational facility at 115 Canterberry Lane, Oak Brook, Illinois, and WHEREAS, on June 18, 2007, the Plan Commission reviewed the request for such special use and recommended approval of the special use subject to certain conditions, and WHEREAS, on August 22, 2007, the Zoning Board of Appeals conducted a public hearing on the request for such special use, pursuant to due and appropriate legal notice, and recommended approval of the special use subject to certain conditions, and WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the Petitioner satisfactorily addressed the factors required for approval of the requested special use and made specific findings, including that the special use would be operated so that the public health, safety and welfare will be protected, and that there will be no substantial injury to other property in the neighborhood, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, to be in the best interest of the Village, NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS Section 1 The recitals above are hereby incorporated into and made a part of this ordinance Section 2 The Petitioner is hereby granted a special use for an educational facility for the Oak Brook Park District, located at 115 Canterberry Lane, Oak Brook, Illinois, subject to the following conditions 1 The development is to be constructed in substantial conformance with the revised site plan, 2 Best efforts are to be made to enhance security on the property increasing additional patrol of the site, including control gates, 3 The site shall be open from 8 00 a m to dusk, 4 Signage to be added to prohibit biking, buses and dogs on the property, 5 Educational site, exhibits, gardens and signage, 6 Council circle, 7 ADA accessible paths, Ordinance 2007-ZO-SU-EX1 -S-1 206 Special Use for Educ Facility 115 Canterberry Ln , 06 -36- 202 -017, 06 -36- 202 -018 Page 2 of 3 8 ADA accessible fishing pier at pond constructed of natural limestone shelving, 9 Natural limestone shelving fishing piers at pond, 10 Two (2) 10 X 12 viewing shelters /benches in meadow, 11 One (1) 20 X 24 gathering /picnic shelter by parking lot; 12 Canoe launch on Salt Creek, 13 Pathways in prairie area, 14 Prairie, woodland and wetland /marsh restoration work, 15 Trail head to Salt Creek Greenway Trail. 16 Twenty -two (22) car parking lot adjacent to Canterberry with two (2) paved ADA accessible parking spaces, 17 Caretaker house /stable /barn /outbuilding improvements for administrative, educational and storage; and 18 Notwithstanding the exhibits contained in the case file, the Applicant shall meet all Village ordinance requirements in the building permit process except as specifically varied or waived Section 3 The special use and the scope of this ordinance are limited and restricted to the property located at 115 Canterberry Lane, Oak Brook, Illinois, which is legally described as follows THE SOUTHEAST % OF THE NORTHEAST % OF SECTION 36, TOWNSHIP 39 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN DUPAGE COUNTY, ILLINOIS ALSO KNOWN AS LOTS 1 AND 2 IN DEAN'S ASSESSMENT PLAT OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 36, TOWNSHIP 39 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 20, 1989 AS DOCUMENT R89- 145768 AND RERECORDED FEBRUARY 23, 1990 AS DOCUMENT R90- 023141, IN DUPAGE COUNTY, ILLINOIS PERMANENT PARCEL NUMBERS 06 -36- 202 -017 AND 06- 36- 202 -018 Section 4 This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law Section 5 All ordinances or parts thereof in conflict with the provisions of this ordinance be and the same are hereby repealed to the extent of such conflict APPROVED THIS 25th day of September, 2007 John Craig VillPresident PASSED THIS 25th day of September, 2007 Ayes Nays Absent r 09 �CF Ordinance 2007- ZO- SU -EX1 -S -1206 Special Use for Educ Facility 115 Canterberry Ln , 06 -36- 202 -017, 06 -36- 202 -018 Page 3 of 3 Trustees Carson, Kennedy, Manofsky, Saived, Sanford and Wolin None None ® • 7 It ATTEST Charlotte K.
