ORDINANCE GRANTING A SPECIAL USE FOR THE DEVELOPMENT OF ADDITIONAL SOCCER FIELDS AND RELATED IMPROVEMENTS AT 1315 AND 1425 KENSINGTON ROAD IN THE VILLAGE OF OAK BROOK (PIN 06 -26- 102 -008, 06 -26- 102 -009) WHEREAS, an application has been filed by the Hawks Soccer Club (the "Petitioner ") on behalf of the McDonald's Corporation, the property owner, requesting an amendment to Special Use Ordinance S -1050 for the development of additional youth soccer fields and related improvements at 1315 and 1425 Kensington Road, Oak Brook, Illinois, and WHEREAS, on August 20, 2007, the Plan Commission review the request for such special use and recommended approval of the special use subject to certain conditions, and WHEREAS, on September 4, 2007, the Zoning Board of Appeals conducted a public hearing on the request for such special use, pursuant to due and appropriate legal notice, and recommended approval of the special use subject to certain conditions, and WHEREAS, the Zoning Board of Appeals and the Plan Commission found that the Petitioner satisfactorily addressed the factors required for approval of the requested special use and made specific findings, including that the special use would be operated so that the public health, safety and welfare will be protected, and that there will be no substantial injury to other property in the neighborhood, and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals and deem the special use, as set forth below, to be in the best interest of the Village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The recitals above are hereby incorporated into and made a part of this ordinance Section 2 The Petitioner is hereby granted a special use for the development of additional youth soccer fields and related improvements at 1315 and 1425 Kensington Road, Oak Brook, Illinois, subject to the following conditions The development shall be in substantial conformance with the plans as submitted and revised 2 The amended conditions of the special use to include the following a The hours of operation are expanded to allow the soccer fields to be used Monday through Friday from 10 00 a m to 8 30 p m , Saturday from 8 00 a m to 8 30 p m and on Sunday from 8 00 a m to 7 00 p m b The locations of the soccer fields shall be revised in accordance with Page V of the case file (as prepared by Hussey Architects Ltd , Hinsdale, Illinois standards shall be installed in conformance with the Village Code and applicable standards All existing and proposed lights shall be properly shielded, not to exceed 5 -foot candles and are to have an automatic shut off installed to comply with the approved hours of operation d The construction of a shelter /garage shall be in substantial conformance with the plans submitted and to comply with all Village Building Codes and permit requirements e The addition of a drinking fountain shall comply with all Village Codes f The Petitioner is authorized to construct a wood rebound wall g The Petitioner is authorized to construct a five -foot (5') by six -foot (6') ground sign to be located near the corner of Kensington and Jorie Boulevard Flowers and landscaping are to be added around the sign h The Petitioner is authorized to construct a second gravel parking lot located on the west side of the property approximately 75 feet by 300 feet with a 50 -foot driveway, subject to the approval of the requested variations and stormwater management permit i The Petitioner shall use its best efforts to improve the landscaping with funds that are available 3 Final engineering approval 4 All other provisions of Special Use Ordinance S -1050 are to remain in full force and effect Section 3 The special use and the scope of this ordinance are limited and restricted to the property located at 1315 and 1425 Kensington Road, which is legally described as follows LOT 1 IN MCDONALD'S AUTUMN OAK SUBDIVISION, BEING A SUBDIVISION OF PART OF SECTION 26, TOWNSHIP 39 NORTH, RANGE 11, EAST
