G-764 - 11/09/2004 - TEXT AMENDMENT - OrdinancesORDINANCE 2004- ZO -TA -G -764 PAMPHLET FRONT OF PAMPHLET AN ORDINANCE AMENDING CHAPTER 14 (ADMINISTRATION AND ENFORCEMENT) OF TITLE 13 (ZONING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATIVE TO PUBLIC HEARING NOTIFICATION REQUIREMENTS PUBLISHED IN PAMPHLET FORM THIS 11th DAY OF November , 2004, BY ORDER OF THE CORPORATE AUTHORITIES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS �r I y Linda K Gonnella, CMC Village Clerk ORDINANCE 2004- ZO -TA -G -764 AN ORDINANCE AMENDING CHAPTER 14 (ADMINISTRATION AND ENFORCEMENT) OF TITLE 13 (ZONING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATIVE TO PUBLIC HEARING NOTIFICATION REQUIREMENTS WHEREAS, an application has been filed requesting a text amendment to Chapter 14 of Title 13 of the Village Code of the Village of Oak Brook to add notification requirements for public hearings associated with applications for map amendments, special uses and variations, and WHEREAS, on September 20, 2004, the Plan Commission reviewed the request for a text amendment and unanimously recommended its approval, WHEREAS, on October 5, 2004, the Zoning Board of Appeals conducted a public hearing on the request for a text amendment, pursuant to due and appropriate legal notice, and recommended its approval, WHEREAS, in recommending the proposed text amendment, the Zoning Board of Appeals and the Plan Commission found that the petitioner satisfactorily addressed the factors required for approval of a text amendment to the Zoning Regulations and found that the controlled placement of a sign on a property will provide additional opportunities for Village residents to learn of pending public hearings and provide them with the ability to participate in the process; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and Zoning Board of Appeals and deem the requested text amendment as set forth below to be in the best interest of the village NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DUPAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The recitals above are hereby incorporated into and made a part of this ordinance Section 2 Chapter 14 (Administration and Enforcement) of Title 13 (Zoning Regulations) of the Village Code of the Village of Oak Brook is hereby amended by adding a new Section 13 -14 -12 entitled "Public Hearing Notification Requirements" The new section will read as follows 13 -14 -12 PUBLIC HEARING NOTIFICATION REQUIREMENTS: All applicants filing an application with the Village of Oak Brook for a map amendment, variation or special use as provided for in this Title 13 shall provide notice of all public hearings related to their application in the following manner A All applicants shall provide notice of any public hearing related to their application to all record owners (as required by the Illinois Municipal Code) and to the general public in the manner and in the time -frame as provided in Division 13 (Zoning) of Article 11 of the Illinois Municipal Code 65 ILCS 5/11 -13 -1 et seq B In addition to the notice required by the Illinois Municipal Code, a sign shall be placed on the subject property informing the general public of an upcoming public hearing in accordance with the following requirements 1 Such sign shall be posted on the subject property at a location oriented to and Ordinance 2004- LC -TA -G -764 Amending Chap 14, Title 13, Relative to Public Hearing Signage Page 2 of 3 readable from the nearest adjacent street or roadway However, where a parcel abuts two or more streets or roadways, one such sign oriented to and readable from each abutting street or roadway is required 2 If no public road abuts the property, the sign shall be placed on the property in question in such a position as may be most readily seen by the public 3 Public notification signs shall be posted not less than 15 days prior to the public hearing and shall not be removed until after the public hearing has been completed unless otherwise directed to do so by the Community Development Director The applicant shall remove all signs within 48 hours after the closing of the public hearing 4 The public notification signs shall be weatherproof and measure no smaller than two (2) feet by three (3) or be no larger than twelve (12) square feet and shall be mounted at least three (3) feet above the ground 5.
