G-733 - 11/11/2003 - TEXT AMENDMENT - OrdinancesP a ORDINANCE 2003- ZO -TA -G -733 AN ORDINANCE AMENDING CHAPTERS 2 AND 3 OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK, ILLINOIS WHEREAS, the Planning Commission and Zoning Board of Appeals has recently recommended that the height of single family homes as required by the Zoning Ordinance be amended, and the Village Board has accepted that recommendation and increased that structure height in the Zoning Ordinance, and WHEREAS, the Planning Commission and Zoning Board Appeals has recommended and the Village Board directed that the Zoning Ordinance be further amended with respect to the definition of natural ground level and structure height in order to make those Sections of Chapter 2 and Chapter 3 of the Zoning Ordinance consistent with the newly determined residential structure height, and WHEREAS, the Zoning Board of Appeals has held the required public hearing concerning the hereinafter ordained changes to Chapters 2 and 3 of the Zoning Ordinance and presented findings and recommendations concerning same to the President and Board of Trustees, NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows Section 1 That the definition of "Natural Ground Level" in Section 13 -2 -2 of Chapter 2 of Title 13 of the Oak-Brook Village Code (Zoning Ordinance) is deleted in its entirety and replaced as follows NATURAL GROUND LEVEL The existing elevation, prior to any movement of organic or nonorganic matter which would require the issuance of a permit under the ordinances of the Village, or the proposed elevation as depicted on a subdivision grading plan approved by the Village, or as otherwise reasonably determined by the Village Engineer Section 2 That Section 13 -3 -8 of Chapter 3 of Title 13 of the Oak Brook Village Code (Zoning Ordinance) is hereby amended by deleting Paragraph (A) in its entirety and replacing it as follows STRUCTURE HEIGHT: A. No structure shall be erected, converted, expanded, reconstructed or structurally altered to exceed the height limit measured above the natural ground level, as determined by the Village Engineer, for the district in which the structure is located However, this height limit for skylights, steeples, flagpoles, chimneys, radio and television aerials, wireless masts, or electric and telephone service poles anywhere in the Village, and mechanical rooms, penthouses or roof structures for the housing of elevators, stairways, tanks, ventilating fans or similar equipment, towers, water tanks, or elevators or other appurtenances anywhere in the Village except residential districts, shall be fifteen feet (15') above the height limits of the district in which it is located Structure height may be measured from a base elevation other than natural ground level only with the express approval of the village However, an elevator housing enclosure for the purpose of providing a single elevator access to the penthouse level not to exceed three hundred twenty -five (325) square feet in area may be erected to heights which do not exceed by more than twenty -two feet (22') the height limits of the district in which it is located Section 3 All ordinances, rules, regulations of the Village of Oak Brook which are in conflict with the provisions of this Ordinance are hereby repealed � , I Ordinance zooa-Zo-TA-o733 Amending Chap u&aor Zoning Ord Page 2orz Section _4 _ This Ordinance shall be in full force and effect from and after its passage and publication oa provided bylaw This Ordinance shall be published m pamphlet form Approved this 11 thday of November )2003 Village 3yresident Passed this llJtb�doyof 2003 Ayes.
