S-1091 - 11/23/2004 - LIBRARY - OrdinancesORDINANCE 2004-LY-EX1 -S-1 091 PAMPHLET 06101 - 0 ; u 0:11 1 AN ORDINANCE ADOPTING AN AMENDMENT TO THE LIBRARY COMPUTER USE POLICY PUBLISHED IN PAMPHLET FORM THIS 24th DAY OF November , 2004, BY ORDER OF THE CORPORATE AUTHORITIES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS 0 ti 044 a cc) y ,r YXr c -- -,- -, � 1, -� c S-4-e� Linda K Gonnella, CMC Village Clerk t ORDINANCE 2004- LY -EX1 -S -1091 AN ORDINANCE ADOPTING AN AMENDMENT TO THE LIBRARY COMPUTER USE POLICY WHEREAS, on July 28, 1998, the Village Board passed an Ordinance S -908 entitled, "An Ordinance Adopting a Policy for Use of Public Access Computers and Electronically Delivered Information for the Oak Brook Free Public Library', and WHEREAS, because the use of computers and the internet at the library has increased markedly since the passage of this ordinance, the Library Commission and Library Director have reviewed and revised this policy, and WHEREAS, the Library Commission and Library Director have approved a revised policy regarding the use of computers in the library, which is attached hereto as Exhibit A, and WHEREAS, the Library Commission has recommended that the Village Board adopt the attached Amendment to the Computer Use Policy, and WHEREAS, it is in the best interests of the Village of Oak Brook that the attached Amendment to the Computer Use Policy be adopted. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 The provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2 The Amendment to the Computer Use Policy, a copy of which is attached hereto and incorporated herein as Exhibit A, is hereby approved and adopted in its entirety and supersedes all prior editions of the Library's computer use policy, including the policy adopted on July 28, 1998 by Ordinance S -908 Section 3 The Village Clerk is hereby authorized and directed to publish this ordinance in pamphlet form in the manner provided by law Section 4 All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of the conflict Section 5 This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law APPROVED THIS 23rd day of November, 2004y Kev Quinlan, V age Presiden b Ayes. ATTEST Linda K Gonnella, CMC Village Clerk :A EXHIBIT A Oak Brook Public Library Computer Use Policy Purpose To aid the Library in fulfilling its mission to provide electronic resources which will help users of the Library obtain information and reading material to meet their educational and recreational needs Use of Computers and Electronic Resources • The use of Library equipment and all electronic resources shall be in accordance with procedures established by the Library Director The use of electronic resources is permitted in accordance with license agreements binding the Oak Brook Public Library (OBPL). • Users are requested to be sensitive to others and understand that some sites, though not illegal, may cause discomfort to others As the Library is a public building, sensitivity and civility to others is appreciated. • Each person must complete the OBPL user form prior to first use of lab equipment Users under 18 years of age are required to have a parent /legal guardian sign the user form in person in the Library • Each person is required to display his /her OBPL photo ID in the pocket provided on the monitor throughout a computer use session on all except lobby or database -only stations • Library computers and electronic resources may be used for legal purposes only • Only authorized Library owned equipment may be attached to computer equipment • No files or bookmarks may be saved on Library computers • Unacceptable uses include, but are not limited to harassment of other users, solicitation, libeling or slandering of others; destruction of or damage to equipment, software, or data belonging to the Library or other users, disruption or unauthorized monitoring of electronic communications; or unauthorized copying of copyright- protected material Disciplinary Actions • Suspected infractions of State of Illinois or Federal law will be referred to the Oak Brook Police Department for investigation • Noncompliance with this Computer Use Policy will result in termination of the user session The user's computer use privileges will be suspended for the remainder of the day A disciplinary report will be completed and filed with the Library Director • A second incident of non - compliance will result in an immediate 30 day suspension of computer use privileges The action will be recorded on a disciplinary report filed with the Library Director. • A third incident of non - compliance will result in an immediate 90 day suspension of computer use privileges. Subsequent incidents will be dealt with individually and may result in revocation of computer use privileges Appeal Process A user may appeal an incident of non - compliance to the Library Director who will review the incident and make a decision. a An appeal of a suspension must be made in writing no more than 14 days after the suspension is received. The Library Director will review the request and determine whether the incident warrants the suspension. The decision of the Library Director is final Internet Disclaimer As an unregulated medium, the Internet differs from the Library's collection in that it is not organized, cataloged, or evaluated by the Library staff The Library assumes no responsibility for the quality, accuracy, or currency of any Internet information OBPL provides computers with limited Internet access in the Youth Services area. Limited Internet access may not block all material that users might find offensive Parents may wish to supervise their children's Internet sessions Children under the age of six (6) are not permitted to access the Internet unless their parent /legal guardian sits at the workstation and supervises throughout the session OBPL assumes no responsibility for any damages, direct or indirect, arising from use of its Internet services It is the responsibility of the Library user to check all computer files and software retrieved via the Internet for viruses before loading them onto his or her personal computer system.
