AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLES 1, 8 AND 9
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
RELATIVE TO WAIVERS OF FEES
WHEREAS, the Village Engineer, in order to maintain consistency in the Village Code relating to
waivers of fees, has recommended amendments to Chapter 14 (Fees) of Title 1 (Administration), Chapter
5 (Fees, Charges and Bonds) of Title 8 (Public Works) and Chapter 7 (Storm Water Management
Permits) of Title 9 (Storm Water, Floodplain, and Sedimentation and Erosion Control Regulations) of the
Village Code of the Village of Oak Brook, and
WHEREAS, the Village President and Board of Trustees have reviewed these amendments and
have approved the changes recommended by the Village Engineer
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1 Section 2 (Waiver of Fees) of Chapter 14 (Fees) of Title 1 (Administration) is hereby
deleted in its entirety and replaced with the following
WAIVER OF FEES Notwithstanding any other provision in this Village Code, the fees established
within this chapter, and plan review and inspection fees as required in this or other sections of this
Village Code, shall be waived and not required, except for outside consulting charges, for
Any municipal corporation,
2 Any homeowners' association organized as a not - for - profit corporation,
3 Any public utility whose franchise agreement states that it shall not pay said fees,
and
4 Any telecommunications retailer that is currently paying a telecommunications
infrastructure maintenance fee to the Village
Any charitable organization, as defined in an Act to Regulate Solicitation and Collection of
Funds for Charitable Purposes, may request a waiver of fees established within this
chapter, and plan review and inspection fees as required in this or other sections of this
Village Code, except for outside consulting charges Upon such requests, the Corporate
Authorities of the Village of Oak Brook may, in their discretion, waive any such fees or
charges by motion
Section 2 Sub - section B of Section 1 -2 (Ali Other Applicants) of Chapter 5 (Fees, Charges and
Bonds) of Title 8 (Public Works) is hereby deleted in its entirety and replaced with the following
Any homeowners' association organized as a not - for - profit corporation if the estimated cost
of the work, as approved by the village engineer, is less than $10,000 00, or
Section 3 Sub - subsection 4 (Exceptions) of sub - section A (Plan Review and Inspection Fees) of
Ordinance 2004- PW -SWM- FEE -G -770

Section 2 (Fees and Charges) of Chapter 5 (Fees, Charges and Bonds) of Title 8 (Public Works) is hereby
deleted in its entirety and replaced with the following
Fees and Charges Waived and not Required The plan review and inspection fees established in
this section shall be waived and not required as stipulated in Section 1 -14 -2 of this Village Code
Section 4 Subsection D (Fees Not Required) of Section 8 (Permit Fees) of Chapter 7 (Storm
Water Management Permits) of Title 9 (Storm Water Management) is hereby deleted in its entirety and
replaced with the following
Fees and Charges Waived and not Required The plan review and inspection fees established in
this section shall be waived and not required as stipulated in Section 1 -14 -2 of this Village Code
Section 5 This ordinance shall be in full force and effect from and after its passage, approval and
publication as required by law
Section 6 All ordinances, or parts thereof, in conflict with the provisions of this ordinance are
hereby repealed to the extent of such conflict
