G-834 - 04/24/2007 - BOARD OF TRUSTEES - OrdinancesORDINANCE 2007- BOT- EL -EO -G -834 AN ORDINANCE AMENDING TITLE 1, CHAPTER 4, SECTION 2 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS TO ESTABLISH THE DATE FOR COMMENCEMENT OF TERMS OF ELECTED OFFICERS WHEREAS, 10 ILCS 5/22 -9 provides that it shall be the duty of election authorities to canvass, add up and declare the result of every election held within the boundaries of a village; and WHEREAS, the election authorities responsible to canvass the results of the elections held within the Village of Oak Brook (the "Village ") are the DuPage County Election Commission for DuPage County electors (the "Commission ") and the Cook County Clerk for Cook County electors (the "County Clerk ") (collectively, the "Election Authorities "); and WHEREAS, the Village Board of Trustees (the "Board ") has heretofore determined, in Section 1- 4-2 (Commencement of Terms) of the Village Code, that the terms of newly elected officers shall commence as of May 1 immediately following the regular municipal election; and WHEREAS, the Board has determined that the Election Authorities will not always canvass the election results, and the official election results will not always be received by the Village from the Election Authorities prior to May 1 immediately following a regular municipal election; and WHEREAS, the Board has further determined that the Election Authorities will not conduct their canvass and the official election results for the regular municipal election on April 17, 2007 may not be received by the Village until May 8, 2007; and WHEREAS, the Board hereby declares that it is in the best interests of the Village to amend the provisions of Section 1 -4 -2 of the Village Code concerning commencement of terms for newly elected officers, in a manner consistent with the canvassing methods, timing and requirements of the Election Authorities, allowing for their canvass and the Village's receipt of the official election results from the Election Authorities, and providing that existing elected officers shall continue their terms until the newly elected officers are inaugurated; and NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Village of Oak Brook, DuPage and Cook Counties, Illinois, as follows: Section 1: That, due to the delay in receiving the official election results from the Election Authorities, the terms of existing elected officers shall end and the terms of newly elected officers shall commence as follows: 1. Existing elected officers shall serve until newly elected officers are inaugurated by the Board. 2. Newly elected officers shall commence their terms by their inauguration at the regular meeting of the Board on May 8, 2007. Section 2: That Section 2 (Commencement of Terms) of Chapter 4 (Elected Village Officials) of Title 1(Administration) of the Village Code is hereby amended by deleting the same in its entirety and substituting the following: The terms of the newly elected officers in any regular municipal election shall commence by their inauguration at the first regular or special meeting of the Village Board in the month of May after Ordinance 2007- BOT- EL -EO -G -834 Establishing Commencement of Terms for Elected Officers Page 2 of 2 the Village's receipt, from the appropriate election authorities of DuPage and Cook Counties, of the official election results of the regular municipal election at which the officers were elected. Existing elected officers shall continue to serve their terms until such time as the newly elected officers are inaugurated and commence their terms. Section 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Section 4: That all ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Ayes: Nays APPROVED THIS 24th day of April, 2007.
