G-990 - 01/22/2013 - BOARD - Ordinances Supporting DocumentsITEM 6.F. 1) AGENDA ITEM Regular Board of Trustees Meeting of January 22, 2013 SUBJECT: Oak Brook Hotel, Convention & Visitors Committee FROM: David Niemeyer, Village Manager BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: Motion to approve passage of ORDINANCE 2013 -BD- OBHCVC-G-990 An Ordinance Amending Sections 2 -5 -2A and 2 -5 -3B of the Village Code of the Village Oak Brook Relating to the Hotel, Convention and Visitors Committee. Background/History: Currently, the Oak Brook Hotel, Convention and Visitors Committee is made up of ten (10) members with terms that expire every February 28a'. The committee is consists of six (6) persons who operate or manage a hotel or motel within the Village of Oak Brook, one (1) representative of the Oak Brook Chamber of Commerce, one (1) representative of Oakbrook Center, and two (2) residents -at- large. This proposal reduces the number of appointed positions to seven (7), removes the Chamber of Commerce as a voting member of the Hotel Convention and Visitors Committee and reduces the number of Hotel General Managers by two (2). Since some of the Chamber's services are paid out of the Hotel Fund, we felt this created a conflict of interest in having a vote on the Committee. Also, the Village is down two (2) Hotel General Managers with the Renaissance and Drake Hotels no longer open. Recommendation: Motion to approve Ordinance G -990 relating to the Hotel, Convention and Visitors Committee. �n Last saved by DEFAULT J:\Agenda Items \AG - Hotel Commitee 1- 22- 13.doc Last printed 1/182013 8:20 AM ORDINANCE 2013 -BD- OBHCVC -G -990 AN ORDINANCE AMENDING SECTIONS 2-5 -2A AND 2 -5 -313 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATING TO THE HOTEL, CONVENTION AND VISITORS COMMITTEE WHEREAS, On September 25, 1990, the Village Board passed Ordinance G -452, creating a Hotel, Convention and Visitors Committee ( "Committee'), which ordinance has been codified as Title 2, Chapter 5, entitled "Hotel, Convention and Visitors Committee," of the Village Code of the Village of Oak Brook, Illinois; and WHEREAS, there are fewer hotels located within the Village than there were previously; and WHEREAS, the Village Board has determined that it is in the best interests of the Village and its residents to amend Sections 2 -5 -2A and 2 -5 -313 of the Village Code to reduce the number of members serving on the Committee; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Amendment to Section 2 -5 -2A. Subsection A, entitled "Appointments" of Section 2, entitled "Membership; Appointments," of Chapter 5, entitled "Hotel, Convention and Visitors Committee," of Title 2, entitled 'Boards and Commissions," of the Village Code shall be amended further, and shall read as follows: "2 -5 -2: MEMBERSHIP; APPOINTMENTS: A. Appointment: The Village President shall appoint tea (a 0) a Z persons to serve as diresters members of the Committee, subject to the advice and consent of the Board of Trustees. The Committee shall consist of six (6 persons who operate or manage a hotel or motel within the corporate limits of the Village, one (1) representative of Oakbrook Center, and two (2) residents -at -large of the Village." Section 3: Amendment to Section 2 -5 -313. Section B, entitled "Meetings," of Section 3, entitled "Officers; Meetings," of Chapter 5, entitled "Hotel, Convention and Visitors Committee," of Title 2, entitled "Boards and Commissions," of the Village Code shall be amended further, and shall read as follows: "2 -5 -3: OFFICERS; MEETINGS: B. Meetings: €ive (6) F9u[_ Committee members shall constitute a quorum for the transaction of its business. A majority vote of Committee members shall constitute approval of business before it. Special meetings may be called by the chairperson or by no less than fear (4) ih[ee members of the Committee. All meetings of the Committee shall be in accordance with the provisions of the Illinois Open Meetings Act." Section 4: Severability. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. Section 5: Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
