Gonnella, Village Clerk BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: I move to approve passage of Ordinance G -829, "An Ordinance Amending Title 4, Chapter 1, Section 8A of the Village Code of the Village of Oak Brook, Illinois Relative to the Number of Authorized Liquor Licenses" Background/History: Bear Creek Stores, Inc. d /b /a Harry and David has made application to the Village of Oak Brook for a Class B Liquor License for their, store located at 100 Oakbrook Center. A Class B liquor license allows the retail sale of alcoholic liquors in the original package, not for consumption on the premises where sold. The General Manager Brad Schulz's background check is being processed at this time. Mr. Schulz will attend the next BASSET session by our Police Department as required by the Village Code as well as provide their employee liquor training manual. The applicant has requested that this application be brought before you for your consideration at the Village Board's regular meeting of February 13, 2007. Enclosed for the Village Board's review is the following documentation: a. Application for a Liquor License b. Floor Plan c. Provided that all ordinance requirements are met, the Local Liquor Commissioner Kevin Quinlan, would presumably issue a Class B Liquor License to Bear Creek Stores, Inc. d/b /a Harry and David located at 100 Oakbrook Center. Background /History: Harry and David in Oakbrook Center currently has a Class B Liquor License under the corporate name of Bear Creek Stores, Inc. There has been a corporate re- organization wherein the corporate entity has changed. The new corporation is Harry & David, Inc., d/b /a Harry & David. Therefore a new license is required. Harry & David, Inc. has made application for a Class B Liquor License. The operation of the establishment is not changing nor is the layout or function. All owners and management will remain the same. All requirements and submittals for a liquor license under the new corporate name have been met. Since all ordinance requirements are met, the Local Liquor Commissioner, John Craig will issue a Class B Liquor License to Harry & David, Inc., d/b /a Harry & David located at 100 Oakbrook Center, Unit 444 as of January 7, 2008. The previous corporation will be required to relinquish their license. Recommendation: That the Board approve the issuance of a Class B Liquor License to Harry & David, Inc., d /b /a Harry & David located at 100 Oakbrook Center, Unit 444 as of January 7, 2008.
