Kallien, Jr., AICP, Community Development Director/ BUDGET SOURCE/BUDGET IMPACT: N/A MOTIONS: I move to amend Title 10 - Building Regulations of the Village of Oak Brook by adopting the current elevator codes and ordinances of the State of Illinois and approve Ordinance G -994. Backeround/History: Illinois municipalities who have entered into a safety program for elevators has received information from the Office of the Illinois State Fire Marshal regarding amendments to Section 140 of the Elevator Safety Act 225 ILCS 312/140 and the Administrative Rules adopted at 41 ILL. Adm. Code 1000 — effective April 24, 2007 and amended on October 1, 2012. If the amendment to this safety program is not entered to, Oak Brook would no longer be permitted to inspect elevators within its jurisdiction and that responsibility would be transferred to the State Fire Marshal's office. The State Fire Marshal has required several amendments to those adopted by the Village in 2011 under Ordinance G -941 and in order to maintain consistency with the State of Illinois elevator requirements, the following standards must be adopted by the Village of Oak Brook: American Society of Mechanical Engineers (ASME) Three Park Avenue New York, NY 10016 -5990 a) Safety Code of Elevators and Escalators (ASME A17.1- 2010 /CSA B44 -07) and Performance -Based Safety Code for Elevators and Escalators (ASME A17.7- 2007 /CSA B44.7 -07); BOT- Elevator State Code -Amend Regulations- 3- 2011doc b) Guide for Inspection of Elevators, Escalators, and Moving Walks (ASME A17.2- 2010); C) Safety Code for Existing Elevators and Escalators (ASME A17.3- 2005), but only as required under section 35(h) and (i) of the Act and subsection (d) of this Section; d) Safety Standard for Platform Lifts and Stairway Chairlifts (ASME At 8.1- 2008); C) Standards for the Qualification of Elevator Inspectors (ASME QEI -1- 2010). 2. Recommendation: Approve Ordinance G -994 Attachment BOT- Elevator State Code -Amend Regulations- 3- 2011doc ORDINANCE 2013- CD- BC -ELV -G -994 AN ORDINANCE UPDATING THE VILLAGE'S ELEVATOR STANDARDS AND AMENDING SECTION 10 -1 -1 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK RELATING TO THE BUILDING CODE WHEREAS, Section 140 of the Illinois Elevator Safety Act, 225 ILCS 3121140 ( "Act "), and the Administrative Rules adopted at 41 III. Adm. Code 1000, et seq., permit municipalities to enter into an agreement with the Office of the Illinois State Fire Marshal for the Village to operate a local elevator safe- ty program ( "Program'); and WHEREAS, on October 23, 2008, the Village entered into an Agreement with the Office of the Illinois State Fire Marshal to operate a Program; and WHEREAS, the Agreement, the Act, and the Administrative Rules require the Village to adopt safety standards that are at least as stringent as those provided by the Office of Illinois State Fire Marshal ( "State Standards "); and WHEREAS, the Village has adopted the State Standards and codified them in Section 10 -1 -11F of the Village Code of the Village of Oak Brook, Illinois; and WHEREAS, the Office of the Illinois State Fire Marshal recently adopted more stringent State Standards, thereby requiring the Village to amend its Village Code to incorporate these more stringent State Standards in order to continue to operate the Program ( "Amendment"); and WHEREAS, the Village President and Board of Trustees deem the Amendment to be in the best interest of the public health, safety and welfare of the Village and its residents; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Ordinance as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Amendment to Section 10 -1 -11F of the Village Code. Subsection F of Section 1, entitled "Building Codes Adopted ", of Chapter 1, entitled "Building Code ", of Title 10, entitled "Building Regulations," of the Village Code shall be deleted in its entirety and replaced with the following: "F. If any provision of this Ordinance or part thereof is held invalid by a court of competent jurisdiction, the remaining provisions of this Ordinance shall remain in full force and effect, and shall be interpreted, applied, and enforced so as to achieve, as near as may be, the purpose and intent of this Ordinance to the greatest extent permitted by applicable law. Section 4: Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
