SUBJECT: Amendment to Section 8 -5 -4 — Starting Work without Permit - Public Works

RECOMMENDED MOTION: I move to approve Ordinance 2008 -PW- FEE -G -856 which
amends Section 8 -5 -4 (Public Works) of the Municipal
Code regarding starting work without a permit.
Background/History:
When Titles 8, 9, and 10 were amended last January to increase permit fees, I did not remember
that section 8 -5 -4 also had a fee listed for starting work without a permit. That section currently
states a $50.00 fee. It appears that section 8 -5 -4 was not included in the past several years when
fees were updated.
Section 10 -4 -1 B24 (Building Regulations) states $150.00 for starting work without a permit.
Since it would be unreasonably cumbersome to have two amounts for starting work without a
permit in different parts of the Code to be administered by the Community Development and
Engineering Departments, section 8 -5 -4 needs to be increased to $150.00.
Recommendation:
I recommend that the Village Board approve increasing the fee in this section to $150.00 from
$50.00.

ORDINANCE 2008 -PW- FEE -G -856
AN ORDINANCE AMENDING SECTION 8 -5-4 (STARTING WORK WITHOUT PERMIT)
OF CHAPTER 5 (FEES, CHARGES AND BONDS) OF TITLE 8 (PUBLIC WORKS)
OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS
WHEREAS, the President and Board of Trustees of the Village of Oak Brook, Illinois have
heretofore, by ordinance, established rates, fees and service charges within Title 8 (Public Works) of the
Village Code, and
WHEREAS, the Village Engineer has recommended an increase in the fee charged to an
applicant who begins work without a permit contained in Section 8 -5 -4 of the Village Code, and
WHEREAS, the Village President and Board of Trustees have reviewed this proposed
amendment and have approved the change recommended by the Village Engineer, and
WHEREAS, the President and Board of Trustees deem the suggested amendment to Title 8 of
the Village Code to be in the best interest and in pursuance of the general welfare of the Village,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows
Section 1. That the words and numbers "fifty dollars ($50.00)" wherever they appear in
Section 8 -5 -4 entitled (Starting Work Without Permit) of Chapter 5 (Fees, Charges and Bonds) of Title 8
(Public Works) of the Village Code of the Village of Oak Brook be deleted therefrom and be replaced with
the words and numbers "one hundred and fifty dollars ($150 00)"
Section 2 That all ordinances in conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict
Section 3 That this ordinance shall be in full force and effect from and after passage,
approval and publication as provided by law
