G-857 - 04/08/2008 - POLICE DEPT. - Ordinances Supporting DocumentsG A 9�F COUN V .r J • I IFFIni I `).11.1) AGENDA ITEM Regular Board of Trustees Meeting of April 8, 2008 SUBJECT: Regulating the Use of Archery Equipment FROM: Mark Sterk, Village Attorney BUDGET SOURCE /BUDGET IMPACT: N/A RECOMMENDED MOTION: I Move For Passage Of Ordinance G -857, An Ordinance Regulating the Use of Archery Equipment and Amending Section 6 -1 -8 of the Village Code of the Village Of Oak Brook Background /History: Per action taken by the President and Board of Trustees, I have been directed to prepare the attached Ordinance which amends Section 6 -1 -8 (Discharging Firearms, Air Rifles) of Chapter 1 (Miscellaneous Offenses) of Title 6 (Police Regulations) to add "Arrows" and specify approved uses. Recommendation: I recommend that this Ordinance be passed. nfol ORDINANCE 2008- PD -OF -G -857 AN ORDINANCE REGULATING THE USE OF ARCHERY EQUIPMENT AND AMENDING SECTION 6 -1 -8 OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK WHEREAS, the Corporate Authorities have determined that the unregulated use of archery equipment within the corporate boundaries of the Village is inimical to the public health, safety and welfare NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows Section 1 The foregoing preamble is restated and incorporated herein by reference as though fully set forth herein Section 2 Section 6 -1 -8A of the Village Code is hereby amended to read as follow 6 -1 -8 DISCHARGING FIREARMS, AIR RIFLES, ARROWS. It shall be unlawful for any person to discharge any firearm, air rifle, paint gun, stun gun or similar device or to fire any arrow within the corporate limits of the Village The provisions of this subsection do not apply to 1 Law enforcement officials of this or any other jurisdiction, while engaged in the operation of their official duties 2 Duly enrolled members of any organized club, team or society using an indoor or outdoor range, including archery ranges, solely for target practice and in actual connection with the activities of said club, team or society Section 3 If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance Section 4 All ordinances in conflict herewith are hereby repealed to the extent of such conflict Section 5 This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law APPROVED THIS 8th day of April, 2008 PASSED THIS 8th day of April, 2008 Ayes Nays Absent John W Craig Village President Ordinance 2008- PD -OF -G -857 Regulating Use of Archery Equipment Page 2 of 2 ATTEST: Charlotte K Pruss Village Clerk
