Martens RECOMMENDATION: That the Village Board approve the attached ordinance granting a side yard variation to the property at 44 Meadowood Drive Pursuant to your direction, I have drafted the attached ordinance which grants a side yard variation to allow an additional nine -foot encroachment into the 40 -foot required side yard setback. I understand you will consider this ordinance at your regular meeting on April 9, 2002. Attachment 7. A. Michael Palazzetti, Program Services Division Manager, Forest Preserve, District of DuPage County, gave a brief over -view of what the Forest Preserve wishes to do with the Peabody Mansion property for public use. Motion by Trustee Savino, seconded by Trustee Craig, that the Village Board concur with the recommendations of the Plan Commission and Zoning Board of Appeals and authorize Attorney Martens to draft the necessary ordinance for final consideration at the April 23, 2002 board meeting. ORD 02 -zo-V4 -1012 44 MEADOWOOD DR. 2) ORDINANCE 2002- ZO -R -S -1013, "AN ORDINANCE REZONING A ORD02- zO -R -s -1013 CERTAIN PARCEL FROM R -1, SINGLE- FAMILY DETACHED 3308 MIDWEST RD RESIDENCE DISTRICT, TO R-2.--SINGLE-FAMILY DETACHED RESIDENCE DISTRICT 3308 MIDWEST ROAD, OAK BROOK, IL 60523" VILLAGE OF OAK BROOK Minutes Page 6 of 14 April 9, 2002 ORDINANCE 2002- ZO -V -S- 1012 AN ORDINANCE GRANTING A VARIATION FROM THE PROVISIONS OF SECTION 13 -6C -3F OF THE ZONING ORDINANCE OF THE VILLAGE OF OAK BROOK RELATIVE TO SIDE YARD REQUIREMENTS (44 Meadowood Drive, Oak Brook, IL 60523) WHEREAS, an application has been filed requesting a variation from the provisions of Section 13- 14-6 of the Zoning Ordinance of the Village of Oak Brook to permit the construction of an addition encroaching approximately 29 feet into the required 40 -foot side yard on the property hereinafter described; and WHEREAS, a public hearing on such application has been conducted by the Zoning Board of Appeals on March 5, 2002 pursuant to due and appropriate legal notice; and WHEREAS, the said Zoning Board of Appeals made explicit findings of fact that the variation requested conforms to the standards set forth in Section 13 -14 -6 of the Oak Brook Zoning Ordinance; and WHEREAS, the corporate authorities have reviewed the recommendation and findings made by the Zoning Board of Appeals and deem the granting of the variation requested to be appropriate and in the best interest and in furtherance of the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1; That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a variation is hereby granted from the provisions of Section 13 -6C -3F of the Zoning Ordinance of the Village of Oak Brook so as to permit construction of an addition encroaching approximately 29 feet into the required 40 -foot side yard, provided that the addition is constructed in substantial conformity with plans as depicted on the Plat of Survey, labelled Exhibit "K ", dated December 10, 1997, a copy of which is incorporated herein by reference. Section 3: That this Ordinance is limited and restricted to the property located at 44 Meadowood Drive, Oak Brook, IL, which property is legally described as follows: Lot 44 in Woodside Estates, a subdivision in the West Half of the Northeast Quarter of Section 24, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded October 26, 1948 as Document No. 556874 in DuPage County, IL. Permanent Parcel No. 06 -24- 204 -001. Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law.
