S-1071 - 05/11/2004 - PERSONAL PROPERTY - Ordinances Supporting Documentst � r _ . u i s { AGENDA ITEM Regular Board of Trustees Meeting of May 11, 2004 SUBJECT: Sale of Surplus Vehicles FROM: Kenneth Kubiesa, Village Attorney BUDGET SOURCE /BUDGET IMPACT: RECOMMENDED MOTION: I move to authorize the Village Manager to sell or dispose of certain vehicles that have been seized by and awarded to the Village of Oak Brook Police Department. Background/History: Detective Sergeant Jeffrey Weber asked us to prepare this ordinance authorizing the Village Manager to sell or dispose of certain vehicles seized by the police department pursuant to the Illinois Criminal Code. The vehicles are not in good condition and cannot be used by the Police Department. Recommendation: I recommend that the Village Board authorize the Village Manager to sell the vehicles identified in the ordinance. f MINUTES OF THE MAY 11, 2004 REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK APPROVED AS WRITTEN ON MAY 25, 2004. 1 CALL TO ORDER: The Regular Meeting of the Village Board of Trustees was called to order by President Quinlan in the Samuel E. Dean Board Room of. the Butler Government Center at 7 33 p.m. The Pledge of Allegiance was given. 2. ROLL CALL: Village Clerk Linda Gonnella called the roll with the following persons PRESENT: President Kevin M. Quinlan, Trustees- Stelios Aktipis, George T Caleel, John W. Craig, Susan Chase Korin and Elaine Zannis. ABSENT: None. Trustee Asif Yusuf arrived at 7:40 p.m. IN ATTENDANCE: Richard B. Boehm, Village Manager; Jeffrey P. Moline, Assistant Village Manager; Dale L. Durfey, Jr., Village Engineer; Bruce F. Kapff, Director of Information Services & Purchasing; Kenneth T. Kubiesa, Village Attorney; Sue Madorin, Interim Library Director, Nelson Patras, Interim Bath & Tennis Club Manager and Trey VanDyke, Golf Club Manager. 3 RESIDENTNISITOR COMMENT President Quinlan announced that the Oak Brook Bath & Tennis Club early bird membership rates will end May 15th and the hours will be extended that day to accommodate the public. 4. APPROVAL OF MINUTES: Regular Board of Trustees Meeting of April 27, 2004 Motion by Trustee Atkipis, seconded by Trustee Korin, to approve the minutes of the April 27, 2004 Regular Board of Trustees meeting. VOICE VOTE: Motion carried. 05 CON I SENT AGENDA: All items on the Consent Agenda are considered to be routine in nature and will be enacted in one motion. WATER SERVICE REQUEST FOR PROPOSED CONDOMINIUM DEVELOPMENT- NORTHEAST CORNER OF YORK ROAD AND I -88 VILLAGE OF OAK BROOK Minutes It 11 Page 2 of 9 May 11, 2004 ORDINANCE 2004 -PP -S -1071 AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PERSONAL PROPERTY OWNED BY THE VILLAGE OF OAK BROOK WHEREAS, the Village of Oak Brook (hereinafter the "Village ") has taken title to the below listed vehicles pursuant to court order and the seizure and forfeiture provisions of the Illinois Criminal Code (see 720 ILCS 5/36 -1 and following sections); and WHEREAS, in the opinion of a majority of the corporate authorities of the Village, it is no longer necessary or useful to or in the best interests of the Village to retain the below described vehicles which are surplus personal property now owned by the Village, and WHEREAS, the Village wishes to auction said vehicles over the internet or by other auction service; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows Section 1 That the foregoing recitals are incorporated herein as findings of the corporate authorities Section 2: That pursuant to 65 ILCS 5/11 -76 -4, the President and Board of Trustees find that the following described vehicles YEAR MAKE MODEL VEHICLE IDENTIFICATION NUMBER 1993 Chevrolet Astro Van 1 GNDM19ZOPB157367 1986 Toyota Corolla JT2AE86CXG0230637 now owned by the Village, are no longer necessary or useful to the Village and the best interests of the Village will be served by their sale or disposal. That pursuant to 65 ILCS 5/11 -76 -4, the Village Manager is hereby authorized and directed to sell the aforesaid vehicles, now owned by the Village, to the highest bidder by auction over the internet or by other auction service or to dispose of the vehicles if their sale is not possible Section 4 That this ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
