AGENDA ITEM Regular Board of Trustees Meeting of July 26,2005 SUBJECT: 2005 Budget Amendment FROM: Darrell Langlois BUDGET SOURCE/BUDGET IMPACT: Account 121- 7634 - Litigation Amongst the Corproate Authorities RECOMMENDED MOTION: I move the that the Village Board approve Ordinance #2005 -BU -S -1131, An Ordinance Amending the 2005 Budget. Background/Histo�: At the meeting of July 12, 2005, the Village Board approved settlement of attorney costs totaling $128,652 related to the lawsuit of Quinlan v. Aktpis et al. As required by Ordinance 2004 -BU- LIT -S -1097, the costs of the settlement were accounted for in a separate budget line item titled "Litigation Amongst the Corporate Authorities ". When the 2005 Budget was prepared funds were not budgeted for this settlement due to the significant uncertainties surrounding this case. Now that the settlement payments have been made Village Board action is required, by the above referenced ordinance, to address the budget variances created by the payments. Village Board policy instituted last year mandates budget transfers at any point in time when a line item exceeds it's annual budget by more than 10% (in prior years these variances were all addressed of the end of the year). Due to the significant amount of the transfer, it would be extremely difficult to find two or three offsets in the General Corporate Fund at this time of year to offset the transfer required. Thus, it is recommended that the entire budget for the General Corporate Fund be amended by $128,700 in order to budget funds for this payment By year end I am confident that enough offsets will be achieved by positive revenue variances or under budget expense performance so that on a "net" basis the General Corporate Fund will be in a more favorable financial position than projected in the 2005 Budget. All items on the Consent Agenda are considered to be routine in nature and will be enacted in one motion. Trustee Aktipis requested that Agenda Item 6. G. A Resolution Approving the Release of Closed Meeting Minutes be removed from the Consent Agenda for further discussion. Motion by Trustee Sanford, seconded by Trustee Kennedy, to approve the Consent Agenda and authorize expenditures as amended. ROLL CALL VOTE: Ayes: 6 - Trustees Aktipis, Craig, Kennedy, Manofsky, Sanford and Yusuf Nays: 0 - None. Absent: 0 - None. Motion carried. President Quinlan announced, with the approval of the Consent Agenda, that the Village of Oak Brook now has a Deputy Fire Chief position which has been awarded by Fire Chief James Bodony to Battalion Chief Thomas McEllin Battalion Chief Thomas McEllin thanked the Board of Trustees for this appointment. President Quinlan indicated that a swearing in ceremony for the Deputy Fire Chief would be announced, as this is one event that honors the public safety officers for the Village A.
