Pruss, Village Clerk BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: Motion for passage of Ordinance 2011- LC -AL -G -952, "An Ordinance Amending Title 4, Chapter 1, Section 8A of the Village Code of the Village of Oak Brook, Illinois Relative to the Number of Authorized Liquor Licenses" Background/History: Village Code requires that any change in the number of liquor licenses that are being held in the Village of Oak Brook must be passed by ordinance. Totopo Mexican Grill, Inc., d/b /a Totopo Mexican Grill, currently carries an A -1 liquor license for their restaurant and is located at 3041 Butterfield Road, Suite 117, in the Oak Brook Promenade. The owner, Mr. Raymond Maldonado informed the Village he was closing Totopo Mexican Grill because of economic reasons. The closure is expected to be permanent. This will decrease the number of A -1 liquor licenses by one, leaving the total number of A -1 licenses at 20. Recommendation: The recommendation is for Passage of Ordinance 2011- LC -AL -G -952. U "� ORDINANCE 2011- LC -AL -G -952 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, SECTION 8A OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK, ILLINOIS RELATIVE TO THE NUMBER OF AUTHORIZED LIQUOR LICENSES WHEREAS, Title 4, Chapter 1, Section 8A (4 -1 -8A) of the Village Code of the Village of Oak Brook authorizes certain numbers of liquor licenses and the number of such licenses issued for each class of license may be increased or decreased from time to time by ordinance approved by the President and Village Board due to changes in ownership of licensed premises, the creation of a new and deserving business enterprise, or the abandonment, revocation, surrender or other termination of an existing license; and WHEREAS, the President and Board of Trustees of the Village deem it advisable and in the best interest and in furtherance of the general welfare of the citizens of the Village that the Village Code of the Village of Oak Brook be amended so that the number of licenses authorized in each license class is equal to the number of licenses in actual use; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are incorporated into, and made a part of, this Ordinance as the findings of the Village President and Board of Trustees. Section 2: Amendments to Title 4 of the Village Code. Subsection 8A, entitled "Fees and Numbers Of Licenses Authorized," of Section 8, entitled "License Fees and Number," of Chapter 1, entitled "Liquor Control," of Title 4, entitled "Business and License Regulations," of the Village Code of the Village of Oak Brook, Illinois is hereby amended in its entirety to hereafter be and read as follows: "A. Fees and Number Of Licenses Authorized: The fees for the licenses issued and the number of licenses authorized pursuant to this chapter shall be as follows: Section 3: Effective Date.
