I a UK AGENDA ITEM Regular Board of Trustees Meeting of December 8, 2009 IT14A M 6.F. 4) ITEM 6.F . ) SUBJECT: Amendments to Chapter 2 of Title 3 and Chapter 2 of Title 10 of the Village Code — Relating to Fire Department Fees FROM: Thomas McEllin, Fire Chief BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: I move that the Village Board approve Ordinance G -910, "An Ordinance Revising The Fire Departmental Fees By Amending Chapter 2 (Fire Department) Of Title 3 (Public Safety) Of The Village Code Of The Village Of Oak Brook" and Ordinance G -911, "An Ordinance Revising The False Fire Alarm Service Charge By Amending Chapter 2 (Fire Prevention) Of Title 10 (Building Regulations) Of The Village Code Of The Village Of Oak Brook ". Baclkground/Ilist, ory_ i The cost to the Village to conduct Cardio Pulmonary Resuscitation (C.P.R.) courses is approximately $35.00 per person due to preparation, training, materials and processing fees. Currently, the Village Code states as follows: B Cardiopulmonary Resuscitation Classes: The village, through its fire department, currently provides cardiopulmonary resuscitation training to interested persons, and the corporate authorities of the village deem it appropriate to impose a user charge for such service in order to defray partially the cost to the village to provide such service. A fee is hereby imposed upon any nonresident requesting such service at the set fee of thirty dollars ($30.00) per person as determined by the village board or such other fee established by the village manager upon consultation with the village board Due to current budgetary constraints and costs incurred in C.P.R. training, it seems prudent to increase the fees, particularly since 1998 was the last time this section of the Code was modified. The graduated table (below) delineates course fees based on the number of students and instructors needed and represents an approximation of the $35.00 cost with the maximum number of participants in each category. These charges will, of course, be waived for schools and churches. The last time this section of the Code was amended was in 1992. This charge helps insure that alarms are maintained in a reliable condition and emergency units are not being repeatedly committed to false alarm activations. The fee is assessed for the second false alarm in a 90 day period. Fire Suppression System inspection fees were also raised in Amendment to Title 10 of the Village Code — Chapter 4 Building Regulations — Fees from $56 to $62 in order to more fully cover all of the staff costs. Recommendation: I recommend that both of these Ordinances be passed. ORDINANCE 2009 -FD- CPR -FP- FEES -G -910 AN ORDINANCE REVISING THE FIRE DEPARTMENTAL FEES BY AMENDING CHAPTER 2 (FIRE DEPARTMENT) OF TITLE 3 (PUBLIC SAFETY) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK WHEREAS, the President and Board of Trustees have determined that it is necessary to increase some of the current fire departmental service fees in order to defray the Village's increased costs relative public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The foregoing preamble is restated and incorporated herein by reference as though fully set forth herein. Section 2 Section 3 -2 -5 of Chapter 2 (Fire Department) of Title 3 (Public Safety) of the Village Code is hereby amended by deleting Subsection B in its entirety and substituting the following in lieu thereof B. Cardiopulmonary Resuscitation and First Aid Classes- The village, through its fire department, currently provides cardiopulmonary resuscitation and first aid instruction to interested persons, and the corporate authorities of the village deem it appropriate to impose a user charge for such service in order to defray partially the cost to the village to provide such service. Fees, as determined by the village board or such other fee established by the village manager upon consultation with the village board are imposed per the table below: Section 3- If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not effect any of the other provisions of this ordinance. Section 4: All ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Pruss Village Clerk Ordinance 2009 -FD- CPR -FP- FEES -G -910 Amending Section 3 -2 -5 Page 2 of 2 ORDINANCE 2009- FD -ALR -G -911 AN ORDINANCE REVISING THE FALSE FIRE ALARM SERVICE CHARGE BY AMENDING CHAPTER 2 (FIRE PREVENTION) OF TITLE 10 (BUILDING REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF OAK BROOK WHEREAS, the President and Board of Trustees have heretofore, by ordinance, established service charges relating to alarm systems within Title 10 (Building Regulations) of the Village Code; and WHEREAS, the Village Fire Chief has recommended an increase in the service charge for false fire alarms in Title 10 (Building Regulations) of the Village Code; and WHEREAS, the Village President and Board of Trustees have reviewed these proposed amendments and have approved the changes recommended by the Village Fire Chief; and WHEREAS, the President and Board of Trustees deem the suggested amendments to Title 10 of the Village Code to be in the best interest and in pursuance of the general welfare of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: That the words and numbers "two hundred dollars ($200.00)" wherever they appear in Section A. (False Fire Alarm Service Charge) of Section 10 -2 -5 entitled (Alarm Systems) of Chapter 2 (Fire Prevention) of Title 10 (Building Regulations) of the Village Code of the Village of Oak Brook be deleted therefrom and be replaced with the words and numbers "two hundred and fifty dollars ($250 00)" Section 2: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not effect any of the other provisions of this ordinance. Section 3: All ordinances in conflict herewith are hereby repealed to the extent of such conflict Section 4.
