Kallien, Jr., AICP, Community Development Director 9V BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: I move to approve Ordinance S -1360, which approves variations to Sections 13 -11 -4 and 13 -11 -10 to permit the installation of the 247.5 square foot wall signs on each of the buildings located at 2200 and 2222 Kensington Court. Background/History: At the November 27, 2012 meeting, the Village Attorney was directed to prepare the necessary ordinance granting approval of variations to permit the installation of wall signs for Ace Hardware to be located on each of the buildings at 2200 and 2222 Kensington Court subject to the condition that the background panel mounted to the raceway is to be of a material and placed in a location on the buildings on the properties that match the design, color and aesthetics of the buildings' architectural features and so as not to be visible when installed. Recommendation: Approve Ordinance S -1360. k Last saved by gpolanek JM -FROM BOB\Bot - PC - ZBA\BOT -FINAL Action - Ace Wall Signs- S- 1360.doc ORDINANCE 2012- ZO- V -EX -S -1360 AN ORDINANCE GRANTING VARIATIONS FROM CERTAIN PROVISIONS OF SECTIONS 13 -11 -10 AND 13 -11-4 OF TITLE 13 ( "ZONING REGULATIONS ") OF THE VILLAGE OF OAK BROOK RELATIVE TO WALL SIGNS FOR THE PROPERTIES AT 2200 AND 2222 KENSINGTON COURT IN THE VILLAGE OF OAK BROOK, ILLINOIS (PIN: 06 -26- 101 -012 AND 06 -26 -101 -013) WHEREAS, an application was filed by Ace Hardware Corporation ( "Petitioned on behalf of Oak Brook Kensington 1031, LLC ( "Owner'J, the owner of the properties located at 2200 and 2222 Kensington Court, Oak Brook, Illinois and legally described in Exhibit A attached hereto and incorporated herein (collectively, the "Properties'l, requesting variations from Sections 13- 11- 4A.7.d, 13- 11- 10C.8, 13- 11- 10D.2.c, and 13- 11- 10.E.4 ( "Variations") of the "Zoning Ordinance of the Village of Oak Brook," as amended ( "Zoning Regulations "), to allow for the construction of a wall sign on each of the Properties as depicted in Exhibit B attached hereto and incorporated herein ( "Wall Signs'l; and WHEREAS, the Petitioner's application also included a request for a variation to allow it to also construct a monument sign on the property located at 2222 Kensington Court, Oak Brook, Illinois ( "Monument Sign Variation"), which Monument Sign Variation has been withdrawn by Petitioner; and WHEREAS, Section 13- 11- 4A.7.d of the Zoning Regulations requires that the letters of wall signs are to be individually affixed to the walls of a building; and WHEREAS, Section 13- 11 -10C.8 of the Zoning Regulations does not allow for wall signs located in the ORA1 Zoning District to be in the center of a building face, except for those certain office buildings identified in Section 13- 11 -10C.8 of the Zoning Regulations; and WHEREAS, Section 13- 11- 10D.2.c of the Zoning Regulations does not allow for wall signs located in the ORA1 Zoning District that are mounted less than 50 feet high to have more than a 100 square foot sign face; and WHEREAS, Section 13- 11- 10.E.4 of the Zoning Regulations does not allow for wall signs located in the ORA1 Zoning District to extend beyond the roofline or to cover architectural features of the building to which it is affixed; and WHEREAS, the Petitioner is required to obtain the Variations for each of the two Wall Signs because the Properties are located in the ORA1 Zoning District and the Wall Signs: (i) will be mounted on a background panel that is then attached to a raceway and attached to the building (ii) will be located in the center of each building face (iii) will have approximately 247.50 square feet of sign face per sign on the north elevation of each building on the Properties; and (iv) will extend approximately 24 inches beyond the roofline and will cover a portion of the glass wall panels and decorative architectural features lines; and WHEREAS, on November 5, 2012, the Oak Brook Zoning Board of Appeals ( "ZBA ") conducted a public hearing on the requests for the Variations, pursuant to due and appropriate legal notice; and WHEREAS, after the close of the public hearing, the ZBA found that the Petitioner satisfactorily addressed the standards required for approval of the requested Variations set forth in Section 13 -14 -6D of the Zoning Regulations and, in a letter to the President and Board of Trustees dated November 16, 2012, recommended approval of the Variations subject to certain conditions; and Ordinance 2012- ZO- V -EX1 -S -1360 Ace Hardware — 2200 and 2222 Kensington Court Variation — Wall Signs PIN: 06 -26- 101 -012 AND 06-26- 101 -013 Page 2 of 8 WHEREAS, the President and Board of Trustees have reviewed the recommendations of the Zoning Board of Appeals and deem the Variations, as set forth below, to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1. Recitals. The foregoing recitals are restated and incorporated herein as the findings of the President and Board of Trustees. Section 2. Grant of Variations to Sections 13- 11 -10C.8 13- 11- 10D.2.c, and 13 -11-10.E.4 of the Zoning Regulations. Pursuant to the standards set forth in Section 13 -14 -613 of the Zoning Regulations, and subject to and contingent on the conditions set forth in Section 4 of this Ordinance, the Petitioner is hereby granted variations from Sections 13- 11- 10C.8, 13- 11- 10D.2.c, and 13- 11- 10.E.4 of the Zoning Regulations to allow for the construction of the Wall Signs. Section 3. Grant of Variations to Section 13- 11- 4A.7.d. of the Zoning Regulations. Pursuant to the standards set forth in Section 13 -14 -6D of the Zoning Regulations, and subject to and contingent on the conditions set forth in Sections 4 and 5 of this Ordinance, the Petitioner is hereby granted a variation from Section 13- 114A.7.d. of the Zoning Regulations to allow for the construction of the Wall Signs. Section 4. General Conditions. The approval of the Variations granted in Sections 2 and 3 of this Ordinance are expressly subject to and contingent upon each of the following conditions: A. Substantial Conformance with Plans. The Wall Signs shall be constructed in substantial conformance with the approved plans, attached hereto and incorporated herein as Exhibit B, including but not limited to, the removal of the existing wall sign located on the building at 2200 Kensington Court, Oak Brook, Illinois; and B. Compliance with Zoning Regulations and Village Code. The Owner and Petitioner shall comply with the Zoning Regulations and all of the provisions contained in the "Village Code of the Village of Oak Brook, Illinois," as amended, that were in effect on the date that the Petitioner submitted his building permit application to the Village except as specifically varied or waived by this Ordinance; and C. Compliance with Applicable Law. In addition to the other specific requirements of this Ordinance, the Properties, the Wall Signs, and all of the Owner and Petitioner's operations and activities conducted on and in the Properties, must comply at all times with all applicable federal, state, and Village statutes, ordinances, resolutions, rules, codes, and regulations. Section 5. Conditions On Background Panel Mounted to a Raceway Siqn. If the Petitioner or Owner affix the Wall Signs using a background panel mounted to a raceway, the approval of the Variations granted in Section 2 and Section 3 of this Ordinance are expressly subject to and contingent upon the Wall Signs being of a material and placed in a location on the buildings on the Properties that match the design, color and aesthetics of the buildings' architectural features, and so as not to be visible when installed. Section 6. Failure to Comply with Conditions. Upon failure or refusal of the Owner and Petitioner to comply with any or all of the conditions, restrictions, or provisions of this Ordinance, the Variations granted in Sections 2 and 3 and of this Ordinance will, at the sole discretion of the President and Board of Trustees, by ordinance duly adopted, be revoked and become null and void. Binding Effect: Non - Transferability. The privileges, obligations, and provisions of each and every section and provision of this Ordinance are for and inure to the benefit of and run with and bind the Properties, unless otherwise explicitly set forth in this Ordinance. Section 8. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance. Section 9. Effective Date. A. This Ordinance will be effective only upon the occurrence of all of the following events: i. Passage by the President and Board of Trustees of the Village of Oak Brook in the manner required by law; ii. Publication in pamphlet form in the manner required by law; and iii. The filing by the Petitioner and Owner with the Village Clerk, for recording in the Office of the DuPage County Recorder of Deeds, of an unconditional agreement and consent to accept and abide by each and all of the terms, conditions, and limitations set forth in this Ordinance. The unconditional agreement and consent must be executed by the Petitioner and Owner. The unconditional agreement and consent must be substantially in the form attached hereto and incorporated herein as Exhibit C. B. In the event that the Owner and Petitioner do not file with the Village Clerk the unconditional agreement and consent required by Paragraph 9.A.iii. of this Ordinance within 60 days after the date of final passage of this Ordinance, the Board of Trustees of Trustees will have the right, in their sole discretion, to declare this Ordinance null and void and of no force or effect. The Owner and Petitioner acknowledge and agree that the Village is not and will not be, in any way, liable for any damages or injuries that may be sustained as a result of the Village's issuance of any permits for the construction or use of the Wall Signs on the Properties, and that the Village's issuance of any such permits does not, and will not, in any way, be deemed to insure the Owner or Petitioner against damage or injury of any kind and at any time. 4. The Owner and Petitioner agree to and do hereby hold harmless and indemnify the Village, the Village's corporate authorities, and all Village elected and appointed officials, officers, employees, agents, representatives, and attorneys, from any and all claims that may, at any time, be asserted against any such parties in connection with the construction, operation, and use of the Wall Signs, the Properties, or the Village's adoption of the Ordinance. 5. This Unconditional Agreement and Consent may not be amended, modified, released or annulled except upon the express, prior written approval of the Village of Oak Brook. Background/History: The Zoning Board of Appeals at its meeting on November 5, 2012, held the required public hearing and completed its review and deliberations on a petition from Ace Hardware Corporation on behalf of the property owner, Oak Brook Kensington 1031, LLC seeking several variations to permit the placement of a wall sign on each of the buildings located at 2200 and 2222 Kensington Court. In addition, the applicant is also seeking variations in order to construct a 12 foot high, 204 square foot monument sign at 2222 Kensington Court along the frontage with I-88. In particular, the applicant is seeking variations to the following sections of the Sign Regulations: /T • Section 13-11-10C.8 — to permit the two (2) wall signs to be centered in the middle of the building instead of anchored to a corner of the building; • Section 13-11-1OD.2b — to permit the construction of an approximate 204 square foot, single- face monument sign on the property which is in excess of the permitted 100 square foot per face monument sign; • Section 13-11-1OD.2c — to permit the installation of a 247.5 square foot wall sign on the north elevation of the buildings at 2200 and 2222 Kensington Court (maximum now permitted is 100 square feet for a building that is less than 50 feet in height); • Section 13-11-10E.3 — to permit the proposed monument sign to be 12 feet in height which exceeds the 10 foot maximum height; • Section 13-11-1OE.4 — to permit the proposed wall signs to extend above the roof-line of the buildings; and • Section 13-11-4A.7d—to permit the requested wall signs internally illuminated channel letters to be mounted on a new background panel instead of to the existing wall. NEW BUSINESS NEW BUSINESS `3 ACE HARDWARE — 2200 AND 2222 KENSINGTON COURT — ACE HARDWARE- 2200 AND 2222 VARIATIONS—SIGN REGULATIONS KENSINGTON CT- VARIATIONS - SIGN REGULATIONS Chairman Davis swore in all who would testify at this hearing. Chuck Ungaro, Corporate Property Manager for Ace Hardware Corporation, introduced the attendees that were there in support of the Ace request as follows: Ray Griffith, CEO, Ace Hardware Corporation, Jim Falk, Director of Community Development Kallien of Property and Loss Prevention, Ace Hardware Corporation, David Lind, CB Richard Ellis, Judy Oswald, Inland Real Estate, representing the property owner, Joe Endress, Vice President Real Estate/Facilities, McDonald's Corporation, Cathy Bushman, Group Director, Tiffany and Company, Tracey Mulqueen and Valentina Tomov, Chamber of Commerce, and Mike Mele,Kieffer Signs. Mr. Ungaro presented the background and information regarding the requested variations. He noted that Ace Hardware Corporation has been a corporate citizen in the Village of Oak Brook community since 1974. Per the Village's 2011 annual report, Ace Hardware was ranked as the fourth largest single employer in the Village and yet they remain one of its best kept secrets. They are a globally recognized brand and bring in guests from all over the world for various events, booking over 5,000 room nights every year in Oak Brook hotels. Their corporate campus is home to the Ace global headquarters and employs over 900 full time employees and still their guests cannot find them. Their campus consists of over 276,000 square feet of office space spread across four buildings on an 18 acre campus and has invested $2.75 million in property taxes and operating and maintenance expenses, plus an average of$1 million annually in other capital improvement projects. Still many vendors are surprised at where they are located and have difficulty finding them. They are seeking approval of variances to the sign code that they feel represents the minimum relief necessary to overcome certain hardships resulting from the unique architectural features of their Mies van der Rohe designed building that VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 12 of 18 November 5, 2012 II was constructed in 1973. They recognized that the Village adopted a new more open signage policy; however, Ace Hardware has been unable to benefit from any of the changes due to the limitations that remain in the new regulations that are restrictive to their building design. The limited signage available to them makes it difficult for vendors, guests and future employees to find their location and many people are scratching their heads as to where they are located. Prior to this meeting they went to their immediate neighbors to let them know about their desire to improve the signage on their campus. Both neighbors submitted written support that was submitted for the case file. Ace Hardware is committed to maintain a positive image in the community and if approved, Ace would invest almost $100,000 for the proposed signage and it is consistent with the look and character of the village. Mike Mele, Kieffer Signs, reviewed the sign variances being requested. The first request is to allow the sign to be center justified instead of oriented to a corner due to the topography of the land and retaining walls that were constructed by the Toll Authority. They are also seeking a larger size sign on the wall of the building. The existing sign is 86.25 square feet. They are seeking a 247.50 square foot sign for each building. The new sign regulations did not benefit Ace, because it would only allow 100 square feet of signage. The buildings are about 300 feet long and only 3-1/2 stories tall. The sign for the college across the street is on a very tall building, so they are allowed a much larger sign, based on the new sign regulations. In support of the request for the larger signs, they believe that when traveling 55+ miles per hour on the highway, a 100 foot sign is not safe to view. The distance from the farthest end of the highway is approximately 500 feet to see a sign where the "A" is 36 inches and is the largest part of their sign. The "C and E" get smaller and in the word "Hardware" the "e" is only 16 inches tall. He reviewed the changes in the topography along the rear of their block. They are also seeking to allow the sign to be located a little above the roof line. The letters are supposed to be individually mounted to the building, but the building consists of glass panes and vertical I-beam mullions that make it impossible to mount the letters to the building. They designed a background panel for the letters to be installed individually to it and would match the building and the architecture instead of using a raceway that would be seen behind the letters. They believe that Ace Hardware would benefit from and would need. Jim Falk said that they would like to extend the sign approximately 2 feet above the roof line and 2 feet below (into the windows) so that it could be seen from the road. A lot of people when they come to visit did not even know that they VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 13 of 18 November 5, 2012 /f•a, • • were in Oak Brook, which is their world headquarters. They are seeking better visibility from the road. They talked to their neighbors and both sent letters in support. The reason it is larger is also due to the fact that the A is a much larger letter than the rest of the sign and the sign regulations require that it be measured from the largest point. The monument sign is about 2 feet higher than allowed by the code; due to the topography and the redesign of I-88 they feel that their hardship is that people can no longer see them. He also noted the location of their existing and proposed signs. Mr. Ungaro said that the monument sign on the 2222 would be a new sign facing I-88,the existing 86.25 sign on the 2200 building would be removed and the proposed new signs would be located at the center of each building. Mr. Falk said that when the economy improves they are expecting the market to get very competitive for new employees. They are investing $8.5 million on their buildings over the next 2-3 years to upgrade everything. They are trying to create an environment, so that when people walk in they will feel like it is a great place to work. The signs are part of their identity and part of their brand. The Ace brand is one of the top 100 in the United States and they are trying to capitalize on the brand value. It tells people that they are in Oak Brook as a solid Oak Brook partner. They are now at 834 employees and are a strong growing company. They are asked how they make it against Home Depot and Lowes, and they are more of a convenience type format and business is growing. Their retails same store sales are at a 3 percent increase and wholesale are at 4 percent. When the economy pops, they want to be able to attract good talent. Visibility is very important to them and is a benefit to the community as well. Ace is located in over 60 countries and they bring people in from throughout the world. Ray Griffith, CEO of Ace Hardware, thanked the Zoning Board for its time attention and consideration. He said that it was important to Ace Hardware. He was prepared to answer questions so that the Village would be comfortable with the plan. They have support from McDonald's to the Chamber of Commerce and their neighbors. They are the friendly hardware people and are in neighborhoods and communities, which is how they built their brand and that is what they stand for. They have a beautiful 18-acre campus and are proud to be in Oak Brook. No one knows they are there unless they are going to the post office and find it by mistake. Although he lives in Naperville, when he mentions that he is the CEO for Ace in Oak Brook, they have no idea where it is located. By increasing the size of the signs,people traveling the I-88 corridor would be able to see that Ace Hardware's corporate headquarters is in Oak Brook. Mr. Griffith responded that they call their general number and when given their address, they have no idea, where it is, so they always ask if they know where McDonald's is and they guide them in from McDonald's. They would like to have their own presence. Joe Enders, McDonald's Corporation, said that they support the requested variations. He also acts in the capacity of the Board of Directors for the Chamber and their goal is to have strong businesses in Oak Brook and to really build the strength of all the businesses. This is a case where they do not have an identity. He drove down I-88, going slowly through the I-pass, trying to see the sign and was barely able to see the existing sign. They truly do not have an identity in the Oak Brook area. Tracey Mulqueen, Chamber of Commerce said that they definitely support the signage request. In terms of economic development they cannot stress enough what it means to Oak Brook when a sign like Ace is seen. This is exactly what the Village wants to see, that Ace Hardware's corporate headquarters is located in Oak Brook. Judy Oswald represented Inland Real Estate, the property management company and she represented the ownership of the property. They support and believe that the signage is something that the buildings need. They have approved all of the signage requested and would allow them to have a better presence in the community. . Chairman Davis said that the standards were addressed by their testimony and were addressed in writing on page D of the case file; he asked that they be briefly addressed for the record. Mr. Mele addressed the required variation as follows: 1. a. The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations governing the district in which it is located. RESPONSE: The signs cannot be seen, no one knows where to go and the architecture of the building would not allow the sign to be constructed per the code as well. The topography impacts the ground sign, which is the reason for the additional two foot height request. VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 15 of 18 November 5, 2012 i i 1. b. The plight of the owner is due to unique circumstances. RESPONSE: As explained in the first response. 1. c. The variation, if granted, will not alter the essential character of the locality. RESPONSE: They are trying to maintain the architectural integrity of the building by the addition of the background panel that would blend into the building. The building architect Mies van der Rohe was a designer of famous buildings and it was important to them and property ownership to maintain the integrity and overall aesthetic of the design, which is in keeping with the original character within the Village. 2. b. The condition upon which the petition for variation is based would not be applicable generally to the other property within the same zoning classification. RESPONSE: The topography and architecture are impacts following the code. 2. c. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. RESPONSE: The letters of approval and the support of the business community at the public hearing would agree. 2. d. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. RESPONSE: The sign will not impair the light and air because they are only going about 2 feet above the building. 2. e. That the purpose of the variation is not based exclusively upon a desire to make more money out of the property RESPONSE: It does not; Ace is trying to have a visible presence in Oak Brook. They are proud to be in Oak Brook and would Oak Brook to be proud that they are here. This is their corporate headquarters 2. f. That the alleged difficulty or hardship has not been created by any person presently having an interest in the property. RESPONSE: The said hardship and difficult is an existing unique situation of the lot. VILLAGE OF OAK BROOK Zoning Board of Appeals Minutes Page 16 of 18 November 5, 2012 Mr. Ungaro said that they have talked about the hardship and topography. They have also talked about the low height and 300 foot length of the building. There is also about 1,000 feet of frontage across the rear of their property. These were all things not of their making and not under their control. They did not install the I-88 highway or install the retaining walls and did not design or build the buildings. Those were conditions that they had and over the years with the changes to I-88 that worsened the problem and they were trying to live with over the years. None of the conditions were of their making and none that they could readily change in any way shape or form, which is why they are seeking the variations. Chairman Davis said that the standards had been addressed in their testimony and in writing on page D of the case file. Please see the case file for additional information regarding this request. Staff Comments: • Ace Hardware has been a corporate tenant in Oak Brook since 1974. The existing signage is both undersized and understated when compared to other large corporate entities that exist along I-88. • The building at 2200 Kensington Court has an existing 86 square foot wall sign, while the building at 2222 Kensington Court does not. The existing wall sign will be removed and replaced with the approval of the new wall signs. • The architecture of the buildings prevents traditional wall signage to be installed. • Because the length of the two (2) Ace buildings are approximately 300 feet each along with the distance from the buildings to I-88 which is also approximately 300 feet,the size and location of the proposed wall signs appear to be reasonable. • The proposed monument sign along the I-88 toll road needs to be at least 12 feet in height to account for the grade change from the road to the Ace property. • Even though the proposed monument sign is over 300 square feet in size, its scale in comparison to the overall length of the Ace campus (approximately 1,000 feet) appears to be reasonable. • Based on renderings provided by the applicant,the sign would appear to be consistent with the "look and character" of other wall and monument signs that have been installed along 22nd Street/I-88 since the new sign regulations were approved in 2010. • The applicant is proposing the use of a background panel to affix the wall sign letters. It is important that the materials and color of the background panel match the existing building. RESPONSIBILITIES OF HEARING BODIES: The Zoning Board of Appeals has the responsibility to make a recommendation on a request for a variation. Please include in your consideration your findings with respect to the standards specified in the Zoning Ordinance for a variation. The materials submitted by the applicant specifically address these standards (see the case file). Those standards are: "Section 13-14-6 D. Standards: 2 • • STAFF REPORT—ACE HARDWARE 2200-2222 KENSINGTON COURT—VARIATIONS—SIGNAGE CASE No: 2012-17-ZO-VAR 1. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the danger of fire, or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood. e. That the purpose of the variation is not based exclusively upon a desire to make more money out of the property. f. That the alleged difficulty or hardship has not been created by any person presently having an interest in the property." CONCLUSION: If the Zoning Board of Appeals is of the opinion that the applicant has satisfied the requirements for a variation to the Zoning Ordinance for the property located at 2200 and 2222 Kensington. Location And Design Of Light Source: Whenever an external artificial light source is used for a sign, such source shall be located, shielded and directed so as not to be directly visible from any public street or private residence. No receptacle or device housing a permitted light source for a sign shall protrude more than twelve inches (12") from the face of the sign or building to which it is attached; provided, however, that a receptacle or device housing a permitted light source for a sign may be located more than twelve inches (12")from the face of the sign if such light source is ground mounted, locked in place, and cannot be redirected. 2. Level Of Illumination: In no event shall the illumination of any sign, resulting from any internal or external artificial light source, exceed one hundred seventy five (175)foot-candles when measured with a standard light meter held perpendicular to the sign face at a distance equal to the narrowest dimension of such sign face. All artificial illumination shall be so designed, located, shielded, and directed as to prevent the casting of glare or direct light upon adjacent property or streets. Internal Illumination: Internal illumination shall be provided by interior white lighting of reasonable intensity with primary and secondary images lit or silhouetted (i.e., backlit) on an opaque background. The background of all signs must be opaque. No additional background lighting or illuminated borders or outlines shall be permitted. 7. Additional Lighting Standards: The following are additional lighting standards for specific sign types: a. Signs Without Permits: Signs permitted pursuant to section 13-11-6 of this chapter shall be illuminated only as permitted in that section. b. Awning And Canopy Signs: Awning and canopy signs shall be illuminated using a direct light source. Direct illumination shall be aimed at the exterior of the awning/canopy, not the underside. c. Monument Signs: Monument signs shall be backlit, directly lit, or internally illuminated. All letters must be individually affixed. Real estate signs if limited to one single or double faced, nonilluminated sign per zoning lot, not to exceed twenty four(24) square feet in area per sign face, and set back a minimum of twenty five feet(25') from the property line. The name, address and telephone number of the person responsible for such removal shall be marked on the sign. Real estate signs indicating that the property has sold or is under any contractual obligation shall not be permitted pursuant to this subsection. Real estate signs, large size may indicate that the property is for sale or lease. Real estate signs, large size require a village sign permit. Real estate signs, large size shall not be in place for more than twelve (12) months, at which time the sign must be removed or another permit must be issued for another twelve (12) month period. Real estate signs, large size must be constructed of quality materials and maintained in good condition. Signs not maintained in good condition may be removed by the village. One monument sign per street frontage for zoning lot frontage that is less than seven hundred feet(700') in length, and up to two (2) monument signs per street frontage for zoning lot frontage that is seven hundred feet(700') or more in length. 6. Maximum Gross Surface Area Of Signs Permitted: 1. Total Sign Area: The total area of all signs on a zoning lot shall not exceed one square foot per foot of zoning lot frontage or one thousand five hundred (1,500) square feet, whichever is less; provided, however, that construction signs, real estate signs,joint identification signs, and signs allowed without permits, shall not be counted toward the total allowance gross sign surface area permitted on a zoning lot. The maximum amount of sign area shall be allocated proportionally based on the linear zoning lot frontage. For the zoning lots that contain the office buildings located at 1211, 1301, 1415 and 1515 22nd Street, the maximum permitted signage is two thousand (2,000) square feet. 2. Individual Sign Area Limitations: The following individual sign area limitations shall apply to all signs within the B4, 03, 04, ORA1 and ORA2 districts, whether counted toward the total allowable gross sign surface area established in this chapter or not: a. Awning And Canopy Signs: Not to exceed fifty (50) square feet per sign face. No sign identifying an individual tenant of a multi-tenant building shall cover more than five percent(5%) of the wall to which it is affixed. b. Monument Signs: Not to exceed one hundred (100) square feet per sign face, nor more than two hundred (200) square feet total. c. Wall Signs: Not to exceed one hundred forty (140) square feet per sign face for signs mounted greater than fifty feet(50') high and not to exceed one hundred (100) square feet per sign face for signs mounted less than fifty feet(50') high, and in no case covering more than five percent(5%) of the wall to which it is affixed. For ground floor restaurants in an office building or hotel, a special permit is required to erect a wall sign. These signs are permitted to have a maximum area of one hundred (100) square feet. This site is Ace Hardware's corporate headquarters for which we are the sole occupant in both buildings and employ over 840 full-time employees. The desired location and size of the signs we are requesting are outside of what is allowed by the current Village code, but also represent the minimum amount of relief necessary to provide reasonable visibility and exposure of our business in the community. While we recognize that the Village has recently updated its sign code, we were unable to take advantage of the changes as other businesses in the community already have due to the unique architectural features of our buildings that limit the signage area. As a result a much larger sign layout that is centered on the building is needed for optimal viewing and visibility. The proposed Ace Hardware wall signs will be approximately 140 square feet larger then what code allows (247.50 sq ft vs. 100 allowed) and given the building construction (glass with architectural metal) the proposed channel letter sign must be mounted to a background panel that is necessary to provide contrast. The panel will then attach to a raceway system that will mount to the building. The final design will extend approximately 2 feet over the roofline and 2 feet below the window line. The color will match the building's architectural metal to provide a seamless look. We also are seeking approval to install a new monument sign that will run parallel to I-88. Our lot topography is unusual in that it rests above the I-88 roadway in some points and well below it in others. This is a condition created by the toll way and not one of our own making. In addition, our buildings sit back more than 250' from the actual roadway which adversely affects visibility. The proposed monument sign will be approximately 108 square feet larger than what code allows (204.80 sq ft vs. 100 allowed) in order to be readable by traffic on I-88. The location we have identified to place the sign is the most level and visible location along the over 1,000 feet of frontage on our property.
