SUBJECT: Authorization of Amendment No.l to Amend Phase III Engineering
Services Agreement with Engineering Resource Associates, Inc. for the
22nd Street and York Road Beautification and Lighting Project.

BUDGET SOURCE/BUDGET IMPACT: $39,850 from Motor Fuel Tax Fund
RECOMMENDED MOTION: I move the Village Board approve Amendment No. 1
and amend Phase III Engineering Services Agreement with Engineering Resource
Associates, Inc. for the 22nd Street and York Road Beautification and Lighting Project
and approve Resolution R-1666.
Background/History: On May 10 2016, the Village Board approved Resolution
R-1562, an Engineering Service Agreement for Phase III Resident Engineering of the
22nd Street and York Road Beautification and Lighting Project. Construction of the
beautification and lighting projects were expected to run simultaneously (the engineer
would be on-site for construction observation of both projects). Although the electrical
contractor was able to work throughout our light winter, the beautification contractor
could not, which more than doubled the engineer's hours of construction observation.
The Amendment is for 73 additional days worked during the winter construction season.
Recommendation:
I recommend the Village Board approve Authorization of this Amendment.

RESOLUTION 2017-ENG-AG-R-1666
A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AMENDMENT TO THE AGREEMENT BY AND BETWEEN
THE VILLAGE AND ENGINEERING RESOURCE ASSOCIATES, INC.
WHEREAS, the Village of Oak Brook ("Village's previously contracted with Engineering
Resource Associates, Inc. ("ERA's for ERA to provide the Village with engineering services in relation to
Phase III of the 22 d Street and York Road Beautification and Lighting Project; and
WHEREAS, construction of the beautification and lighting projects ("Projects")were expected to
run simultaneously(the engineer would be on-site for construction observation of both projects); and
WHEREAS, the engineer's hours of construction observation were doubled due to the
beautification contractor not being able to work through the winter; and
WHEREAS, this resulted in the engineer working 73 additional days, at an additional cost of
$39,850; and
WHEREAS, the Village desires to amend the Agreement with ERA to reflect the cost of the
additional engineering hours ("Amendment's, which Amendment is attached and incorporated herein as
Exhibit A; and
WHEREAS, the President and Board of Trustees, being fully advised in the premises, have
determined that it is in the best interests of the Village and its residents to approve the Amendment, and
to authorize the payment to ERA for the Project;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of Amendment. The President and Board of Trustees hereby approve
the Amendment with ERA in substantially the same form as attached as Exhibit A, and in final form
approved by the Village Attorney and Village Manager.
Section 3: Execution of Agreement. The Village Manager and Village Clerk shall be, and
hereby are, authorized to execute the Amendment after receipt of the final Amendment fully executed by
ERA.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
