DEAN BOARD ROOM OAK BR , "K - BUTLER GOVERNMENT CENTER 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS 630-368-5000 AGENDA ITEM Regular Board of Trustees Meeting of November 14, 2017 SUBJECT: New Cingular Wireless PCS, LLC Ground Lease Agreement Amendment FROM: Jim Fox, Information Technology Director BUDGET SOURCE/BUDGET IMPACT: NA RECOMMENDED MOTION: I move that the Village Board approve Ordinance 2017- TELECOM-TWR-S-1515 to approve an Amendment to the Ground Lease Agreement with New Cingular Wireless PCS, LLC for celluar communication equipment installed at 1200 Oak Brook Road. Backizround/History: On November 9, 2010 the Village Board approved a ground lease with New Cingular Wireless (AT&T) for a ground lease to construct an extension to the Village's monopole communication tower at 1200 Oak Brook Rd and to lease ground space to support their celluar communication equipment. On October 24, 2017,the Village Board approved Ordinance 2017-TELECOM-TWR-S-1516 with Verizon Wireless to construct a new 120 foot monopole communication tower at 1200 Oak Brook Rd on the grounds of the Butler Government Center to replace an existing 95 foot monopole tower. In an effort to avoid having two (2) monopole towers at 1200 Oak Brook Rd, Village staff has negotiated with AT&T (a tenant on the current tower) to move their equipment from the current tower to the new monopole tower being constructed by Verizon. AT&T has determined the relocation costs of their equipment will be approximately $50,000. The proposed lease amendment will allow AT&T to abate their current monthly rent until the abatement is equal to the lesser of $50,000, or the actual expenses directly attributable to relocating the equipment described within the agreement. After the abatement period, rental payments shall again become due at the figures set forth in the Option and Structural Lease Agreement. The agreement also requires AT&T to deliver to the Village written evidence of the relocation costs so the Village can confirm the value and schedule of the abatement. �G BOT AGENDA Page 1 Since the Village does not wish to have two(2)monopole towers at 1200 Oak Brook Rd for an extended period of time, this ordinance contains a clause that if the lease amendment with the other current tenant-- Sprint-- is not approved within 90 days from the date of this Ordinance it shall become null and void. Recommendation: I move that the Village Board approve Ordinance 2017-TELECOM-TWR-S-1515 to approve an Amendment to the Ground Lease Agreement with New Cingular Wireless PCS, LLC for celluar communication equipment installed at 1200 Oak Brook Road.
