G-1127 - 03/27/2018 - ORDINANCE - OrdinancesORDINANCE 2018-CD‐PD‐FEE‐G l127 AN ORDINANCE MAK:NG MULT:PLE CHANGES TO THE OAK BR00K VILLAGE CODE RECARDING ORD:NANCE V:OLAT:ONS WHEREAS,a number of Sec∥ons ofthe V∥age Code of Ord nances ofthe V∥lage of Oak Brook deal with Ordinances relating to violations that are genera∥y enforced by the Po∥ce Department and relate to the power of a non―home rule unit to create Ordinances governing a series of act ons which are enher prOhibled in whole or regulated and many of which resu∥n administra,ve adiudiCaton rather than hearings ln the Circu t Courll and llVHEREAS,the V∥lage of Oak Brook maintains a Code of Ordinances which is both ava∥able for review at theヽ /∥lage Ha∥and can be accessed th「ough the V∥lage's websitel and VVHEREAS,the V∥age Code is maintained and updated through Ster∥ng Codinersi and llVHEREAS, the most effective way to amend a variety of Code provisions is through an Ordinance specifying the secuons ofthe code which are being amended and the spec ic changes be ng madei and WHEREAS,the V∥age has revlewed the minimum ine assessed for a variety of Code offenses in Oak Brook with the fne estab∥shed in other municipalities, and it has been concluded that the minimum nne shOuld be increased from$1000010S250 001 and VVHEREAS,the Vi∥age has concluded that a number of Code viola∥ons sha∥be processed using the Administralve Adludica∥on processi and WHEREAS,this Ordinance w∥l effectuate a number of other changes to the Oak Brook V∥age Code and in each case the specinc title and Section ofthe Code w∥l be specined NOVV,THEREFORE,BEIT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BR00K,DUPAGE AND C00K COUNTIES,lLL NOIS,as fo∥ows 201 8-CD-PD-FEE-G-1 127 Multiple OrdinanceViolations Changes Police Depadment Page 2 oi 4 SECTION 1. ln Title 1, Administration: Section 1-3-1(A), the minimum fine currently listed as $100.00 shall be increased to $250.00. SECTION 2. ln Title 4, Business and License Regulations: Section 4-1-23(F)1 Age Restrictions shall have added the following sentence "A violation of 4-1-23(F)(1) shall be treated as an infraction, and shall, upon conviction, be punishable as set forth in Section 1-3-1A of this code.' SECTION 3. Title 6, Police Regulations: Section 6-1-4, Public lndecency. Subsection (c) shall be amended to read 'A person convicted of the offense of public indecency shall be flned not less than $750.00 for each offense and may be enjoined from continuing the conduct determined to be public indecency.' SECTION 4. Title 6, Police Regulations: Section 6-1-17(B) Curfew for Minors. Subsection 5 shall be amended to read "Violation; Penalty: any person convicted of a violation of subsection 81 of this Section, shall be fined upon conviction two hundred fifty dollars ($250.00) for the first violation in any twelve (12) month period; four hundred dollars ($400.00) for a second violation in any 12-month period; and seven hundred flfty dollars ($750.00) for a third or subsequent violation in any twelve (12) month period." SECTION 5. Title 6, Police Regulations: Section 6-1-17(C) Social Hosting. Subsection 4 shall hereafter read as follows: "Violation; Penalty: any person who violates subsection C2 of this Section shall be fined the maximum amount permitted in Section 1-3-1A of this code." SECTION 6. Title 6, Police Regulalions: Amend Title 6. Section 6-2-10 Animal Control, Penalties: shall hereafter read as follows: "Any person convicted of a violation of any provision of this chapter shall be subject to the penalties contained within Section 1-3-'1A." 2018-CD-PD-FEE-G-1't27 Multiple Ordinance Violations Changes Police Department Page 3 of4 SECTION 7. Title 4, Business and License Regulations; Taxicabs; Section 4-2-13. Business and Licenses. Penalties: shall hereafter read as follows: "Any person convicted of a violation of any provision of this chapter shall be subject to the penalties contained within Section 1-3-1A." SECTION 8. Title 4, Business and License Regulations: Limousines; Section 4-10-'l 1 shall hereafter read as follows: Penalties: Section 4-10-11A. Any person convicted of a violation of any provision of this chapter shall be sub.iect to the penalties contained within Section 1-3-1A. SECTION 9. Title 7, Motor Vehicles and Traffic. Shall be amended in that Section 7-1-'1430 dealing with U-turns shall be deleted. SECTION 10. Title 1, Administration. Section l-15-4: VIOLATIONS SUBJECT TO ADMINISTRATIVE ADJUDICATION shall be amended in that the following additional violations of this Code subject to administrative adjudication under this chapter and being added with the additional letter designation shall be: H. Those set forth in title 4, Section 4-4A Commercial Solicitation. l. Those set forth in Title 4, Section 4-48 Non-commercial solicitation. J. Those set forth in Title 4, Section 6. Tobacco. SECTION 11. All of the modifications and amendments in this Ordinance shall be modifications to the Code of Ordinances of the Village of Oak Brook and shall be modified in the official copy of the Code of Ordinances in the office of the Village Clerk and shall be codified by Sterling Codifiers in accordance with their procedures. SECTION 12.
