Pruss, Village Clerk BUDGET SOURCE/BUDGET IMPACT: N/A RECOMMENDED MOTION: Motion to approve Resolution R-1299, A Resolution Approving the Release of Closed Meeting Minutes Background/History: Effective January 1, 1982 the Open Meetings Act (S ILCS 12012.06) requires that all public bodies shall keep written minutes of all their meetings, whether open or closed. The public body shall periodically,but no less than semi-annually, meet to review minutes of all closed sessions that had not been released to the public. At this time,the Board of Trustees has reviewed minutes from 2003 through 2005 that have been previously approved, as written or amended, but were either not released to the public at an earlier time or only partially released. It has been determined that the minutes listed in the exhibit attached to Resolution R-1299 no longer require confidential treatment and are available for public inspection. Recommendation: That the Board pass Resolution R-1299. U'� RESOLUTION 2013-BD-CL-MIN-R-1299 A RESOLUTION FOR THE APPROVAL AND RELEASE OF CLOSED MEETING MINUTES WHEREAS, the Village Board of the Village of Oak Brook has met from time to time in closed meeting for purposes authorized by the Illinois Open Meetings Act; and WHEREAS, pursuant to the requirements of 5 ILCS 120/2.06(c), the Village Board has met in closed meeting to review all closed Meeting minutes; and WHEREAS, the Village Board has further determined that there is no longer a need for confidentiality as to the closed meeting minutes from the meetings set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the 2003 to 2005 closed meeting minutes attached hereto as Exhibit 1 and described in Schedule A having been previously not released or released with redactions, may now be released in their entirety. Section 2: That the Village Clerk is hereby authorized and directed to make minutes identified in Section 1 available for inspection and copying in accordance with the standing procedures of the Clerk's office. Regarding the Stanfa v. Jarvis and Bushy litigation, an appeal of the court decision has been withdrawn by Firefighter Stanfa. By random selection, Judge Bonnie Wheaton is the new judge in the DuPage Housing Authority and Forest Preserve of DuPage County v. Oak Brook. He informed the Board that a new lawsuit had been filed by Firefighter Garry Watkins in federal court. 4. TO SET A PRICE FOR THE SALE OR LEASE OF PROPERTY OWNED BY THE VILLAGE: Attorney Martens explained the process for setting the price for the sale of the Westchester Park property. It was the consensus of the Board that the pending contract with Auctioneer Sheldon-Good be removed from the Board's agenda and that the Village staff submit its recommendation for the pricing and sale of these parcels at the next meeting. Village of Oak Brook 03 C 2621. He indicated that Judge Zagel in the United States District Court for the Northern District of Illinois had granted a motion to dismiss the case. The DuPage Housing Authority and Forest Preserve District have been given twenty-eight days to file an amended complaint in federal court. The Board discussed the possibilities to negotiate a settlement. 4. Board members requested the following salary data to be given to them for further comparison of other municipalities: Winnetka, Wilmette and River Forest; list the number of our employees receiving the various ranges in merit bonus; list the number of municipalities in this area that provide bonuses to their employees; and the impact of the proposed plan to the 2004 budget. Manager Boehm will review some different salary surveys and will provide the Board with the requested Data. President Quinlan stated the Board will review this data in closed session at their next Board meeting. 3. Zagel has denied the Motion to Dismiss all five (5) counts, which includes the two (2) federal counts in the DuPage Housing Authority v. Village of Oak Brook 03 C 2621. This requires the Village now to respond to the Complaint and begin discovery. Attorney Kubiesa suggested hiring a law firm to analyze the case for presentation to the Village Board in the next two weeks. It was the consensus of the Village Board to hire a law firm to analyze the law suit as well as Trustee Aktipis meeting with individual DuPage Forest Preserve Commissioners to discuss reaching a settlement. It was a consensus of the Board that they submit their candidate names to Manager Boehm. Manager Boehm will forward any new resumes that may arrive to the Board members. President Quinlan explained that he had requested the Board to submit candidate names four weeks prior. A second request went to the Board indicating interview schedules and requesting times of availability. The normal search process was held from April 27, 2004 through May 27, 2004 as Dan McCollum informed the Board at their first May Village Board meeting that the process had begun for the search of a new Police Chief. The Board was to submit names at the June 8, 2004 meeting. He indicated that the Board did not submit any naives during this process. Trustee Zannis stated that the Board had not reached a consensus on the interview process and thus it would not move forward. Attorney Kubiesa stated for the record, that the Illinois Municipal Code and the Village Code state that the Village President shall appoint with approval by the Board of Trustees on the basis of merit, fitness and experience of the job. President Quinlan reconvened the meeting at 5:46 p.m. The Board of Trustees interviewed applicant Fire Battalion Chief Thomas McEllin. President Quinlan recessed the meeting at 6:30 p.m. so that he could locate the next applicant for the interview. President Quinlan reconvened the meeting at 6:44 p.m. The Board interviewed applicant Fire Battalion Chief James Bodony. President Quinlan recessed the meeting at 7:26 p.m. and then reconvened the meeting at 7:28 p.m. The Board discussed the two candidates for the VILLAGE OF OAK BROOK Minutes Page 1 of 2 July 12, 2005 3. a. position of Oak Brook Fire Chief. It was the unanimous consensus of the Board of Trustees to appoint James Bodony as the new Fire Chief. The Board further considered the creation of the Deputy Fire Chief position and to offer that appointment to Thomas McEllin. The Board concurred with Village Manager Boehm's suggestion that a salary differential between the two positions be considered. He further indicated that it is typically the Fire Chief's job to appoint a Deputy Fire Chief. It was the consensus of the Board of Trustees to nominate James Bodony as the new Oak Brook Fire Chief in the open session of the regular Board of Trustees meeting and recommend the creation of the position of Deputy Fire Chief and suggest to the Fire Chief the consideration of appointing Thomas McEllin as the Deputy Fire Chief. 4. Alan Borkovec who was the immediate past CALEA Accreditation Manager for the Police Department. After discussion, the Board of Trustees concurred that Village Manager Boehm and Police Chief Sheahan interview former Accreditation Manager Alan Borkovec for the position of a part-time Accreditation Manager to determine if he is qualified for the position. The Board concurred with training other pclice officers earlier and mid-term in their career of the CALEA. accreditation process. Police Chief Sheahari then discussed Agenda Item 10. C. 2. from the open Board meeting of his recommendation to hire 1/0 Solutions to conduct a study of the Oak Brook Police Department and its current organization structure. The Board discussed this issue and President Quinlan recommended that the evaluation occur within thirty days. Trustee Yusuf suggested that further information on this company be provided and to consider other providers. Chief VILLAGE OF OAK BROOK Minutes Page 1 of 3 July 26, 2005 3. a. Sheahan will meet with Manager Boehm to determine the evaluation to be presented to the Board of Trustees for approval at their next regular Board meeting. Police Chief Sheahan exited the meeting at 8:40 p.m. b. To consider litigation, when an action against, affecting or on behalf of the particular body has been filed and is pending before a court or administrative tribunal IRMA Attorney James De Ano gave an update to the Board in the DuPage Housing Authority v. Village of Oak Brook before Judge Zagel in federal court. In the Gaik v. Oak Brook Police Department, Attorney De Ano gave an update to the Board of the proceedings. The Board discussed the feasibility of a settlement in the case. Trustee Aktipis argued that the Board of Trustees is entitled to know that a settlement was brought before the Village in this case and has a right to authorize settlement. Attorney De Ano explained that IRMA was not willing to settle as one was only a monetary demand of a $200,000 settlement and a response was provided to the demand. Attorney De Ano indicated that if the Board wishes to settle the lawsuit that it would at the Village's expense, as IRMA is not willing to pay the settlement demand. He exited the meeting at 9:10 p.m. Trustee Aktipis said that regardless of the IRMA position on this matter, the Board should have had the opportunity to decide whether the case could be settled. Trustee Kennedy responded that in his view it would have been premature to settle the case. c. He indicated that the sergeants act in a supervisory capacity in Oak Brook and he suggested there is merit by the Village Board to proceed in filing an objection with the Labor Relations Board that they not be recognized as a bargaining unit. Village Attorney Kubiesa concurred with this suggestion. Police Chief Sheahan also indicated that the Police Sergeants act in a supervisor capacity. It was a consensus of the Village Board of Trustees to appeal this matter to the Illinois Labor Relations Board. President Quinlan reminded the Board members not to discuss this with anyone. October 25, 2005 Closed Meeting Minutes Trustee Aktipis requested that the October 25, 2005 Closed Meeting Minutes be amended on page 2, Agenda Item 3.a. to insert the following: "Trustee Aktipis suggested that the Village delay issuing a permit until the matter can be resolved between the residents of Oak Brook Hills Road and Ginger Creek." The Board reviewed the minutes as presented and concurred with Trustee Aktipis' request for revision to the October 25, 2005 closed meeting minutes. b. Village Manager Boehm gave an update of the DuPage Mayors and Managers Conference recommendation for settlement in the Infrastructure Maintenance Fee Act. The Conference has been in court with this Primeco VILLAGE OF OAK BROOK Minutes Page 1 of 3 December 13, 2005 70 3. b. litigation and has suggested an arrangement that would commit the Village of Oak Brook to half of its IMF funds into a pool for potential settlement. Attorney Kubiesa explained that the funds are half of the fees the Village collected in the three years the Infrastructure Maintenance Fee taxes were collected for usage of public rights-of-way for telecommunications. The Infrastructure Maintenance Fee taxes were challenged in court and overturned as a law. It was a consensus of the Village Board to concur with the recommendation in this litigation matter. Trustee Aktipis requested an update of the DuPage Forest Preserve District litigation. Attorney Kubiesa explained that motions for summary judgment have been filed and briefed. Judge Zagel informed the Village that he will give his ruling in writing and rescheduled the status to January 13, 2006. The Village filed motions of siunmary judgments on the federal counts of ADA, fair housing and the condemnation counts. The DuPage County Forest Preserve filed their motions on the same two federal counts but filed a motion for summary judgments on the exclusionary zoning count. 4. NEW BUSINESS: a. To consider the appointment, employment, compensation, discipline, performance or dismissal of specific employees of the public body Trustee Manofsky asked that this be placed on the agenda to explain her concern for placing items on the Village Board agenda as a Board of Trustee member. She inquired into what procedures are to be followed for placing items on the Board of Trustees meeting agenda as she had contacted Manager Boehm several times since July and her request for agenda items were not addressed until this evening. Manager Boehm explained that the Board members responded in November to her request and it was then placed on the December 13"' Board meeting agenda. It was clarified that the procedure for placement of agenda items by a Trustees is to contact the Village Manager in writing requesting an agenda item be addressed by the Board of Trustees-at their meetings. 5. . CALL TO ORDER: The Closed Meeting of the Village Board of Trustees was called to -order by President Quinlan in the Upper Level . Conference. Room of the Butler Government Center at 10:35 p.m. 2. ROLL CALL: Village Cleric Linda Gonnella called the roll with the following persons: PRESENT: President Kevin Quinlan, Trustees Stelios Aktipis, John W. Craig, Jeffrey Kennedy, Kathryn Manofsky, Robert Sanford and Asif Yusuf. ABSENT: None. IN ATTENDANCE: Richard B. Boehm, Village Manager and Kenneth T. Kubiesa, Village Attorney. 3. UNFINISHED BUSINESS: a. To discuss minutes of meetings lawfully closed under the Open Meetings Act, whether for the purpose of approval by the body of the minutes or for semi-a imal review of the minutes as required by the Open Meetings Act. 1. To consider litigation, when an action against, affecting or on behalf of the particular body has been filed and is pending before a court or administrative tribuiial. lip VILLAGE OF OAK BROOK Minutes Page 1 of') December 13, 2005 3. b. litigation and has suggested an arrangement that would commit the Village of Oak Brook to half of its IMF funds into a pool for potential settlement. Attorney Kubiesa explained that the funds are half of the fees the Village collected in the three years the Infrastructure Maintenance Fee taxes were collected for usage of public rights-of-way for telecommunications. The Infrastructure Maintenance Fee taxes were challenged in court and overturned as a law. It was a consensus of the Village Board to concur with the recommendation in this litigation matter. Trustee Aktipis requested an update of the DuPage Forest Preserve District litigation. Attorney Kubiesa explained that motions for summary judgment have been filed and briefed. Judge Zagel informed the Village that he will give his ruling in writing and rescheduled the status to January 13, 2006. The Village filed motions of summary judgments on the federal counts of ADA, fair housing and the condemnation counts. The DuPage County Forest Preserve filed their motions on the same two federal counts but filed a motion for summary judgments on the exclusionary zoning count. 4. NEW BUSINESS: a. To consider the appointment, employment, compensation, discipline, performance or dismissal of specific employees of the public body Trustee Manofsky asked that this be placed on the agenda to explain her concern for placing items on the Village Board agenda as a Board of Trustee member. She inquired into what procedures are to be followed for placing items on the Board of Trustees meeting agenda as she had contacted Manager Boehm several times since July and her request for agenda items were not addressed until this evening. Manager Boehm explained that the Board members responded in November to her request and it was then placed on the December 13'h Board meeting agenda. It was clarified that the procedure for placement of agenda items by a Trustees is to contact the Village Manager in writing requesting an agenda item be addressed by the Board of Trustees at their meetings. 5. .
