G/L Account to be charged: RESOLUTION 2016 -SR -FP -EX -R-1561 A RESOLUTION APPROVING THE FINAL PLAT FOR THE BILSHAUSEN ESTATES SUBDIVISION IN THE VILLAGE OF OAK BROOK, ILLINOIS 2525 35" Street PIN: 06-33-400-045 and 06-33-400-046 WHEREAS, at its meeting on March 21, 2016, the Plan Commission completed its review and deliberations on an application by Robert and Beverly Bilshausen ("Owners'l, the owners of the 2.001 acres located at 2525 35" Street ("Subject Property'l, seeking approval of a two -lot final plat of subdivision; and WHEREAS, the Subject Property is legally described as follows: THAT PART OF THE NORTH 7.5 CHAINS OF THE EAST HALF OF THE SOUTHEAST QUARTER OF SECTION 33, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED BY BEGINNING AT THE NORTHWEST CORNER OF SAID EAST HALF OF THE SOUTH EAST QUARTER AND RUNNING THENCE EAST ALONG THE NORTH LINE OF SAID SOUTH EAST QUARTER 176.1 FEET; THENCE SOUTH PARALLEL WITH THE WEST LINE OF SAID EAST HALF OF THE SOUTHEAST QUARTER 494.6 FEET TO A FENCE; THENCE WEST 176.1 FEET TO A POINT ON THE WEST LINE OF THE EAST HALF OF THE SOUTHEAST QUARTER THAT IS 495 FEET SOUTH OF THE POINT OF BEGINNING; THENCE NORTH ALONG SAID WEST LINE, 495 FEET TO THE POINT OF BEGINNING, IN DUPAGE COUNTY, ILLINOIS; and WHEREAS, the Subject Property is currently improved with a single family residence; and WHEREAS, by a vote of 4 to 1, the Plan Commission recommended approval of the request for a final plat of subdivision for the Subject Property; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendations of the Plan Commission and deem the final plat of subdivision for the Subject Property, as set forth below, to be in the best interests of the Village; NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1. Recitals. The foregoing recitals are incorporated herein by reference as though fully set forth herein. Section 2. Aooroval of Final Plat of Subdivision A. Approval of Final Plat. Subject to and contingent upon the conditions set forth in Section 3 of this Resolution, the final plat prepared by Engineering Resource Associates, Inc., dated February 5, 2016, and attached to this Resolution as Exhibit A ("Final Plat"), is hereby approved. B. Authorization and Execution. The Village President, Clerk, and other appropriate Village officials are hereby authorized and directed to execute and seal, on behalf of the Village, the Final Plat and the customary certifications indicating such approval. C. Recordation. Upon the execution of the Final Plat by all required parties, the Village Clerk is hereby directed to record the Final Plat with the Recorder of Deeds of DuPage County, Resolution 2016 -SR -EX -R-1561 Bilshausen Estates Subdivision —Final Plat 2525 35th Street —Two Lot Subdivision PIN 06-33-400-045 and 06-33-400-046 Page 2 of 3 Illinois, and the Village Clerk will then be authorized and directed to assess against and collect from the Owner any costs in connection with those actions and this Resolution. Section 3. Conditions. The approvals granted in Section 2 of this Resolution are hereby expressly subject to and contingent upon each of the following conditions: A. The Final Plat be approved by the Village Engineer; and B. The Owner and all subsequent owners of the Subject Property shall comply with all requirements of law, including without limitation, federal, state, and local laws, ordinances, resolutions, and regulations, relating to the Subject Property. C. Access to the flag lot put in place by this subdivision must be created and maintained. Section 4. Severability. If any section, paragraph, clause or provision of this Resolution shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Resolution. Section 5.
