S-1362 - 02/12/2013 - ORDINANCE - OrdinancesORDINANCE 2013-ZO-MA-EX-S-1362 AN ORDINANCE REZONING AND GRANTING A MAP AMENDMENT ON A PARCEL OF APPROXIMATELY 5 ACRES LOCATED AT 3324 ROSLYN ROAD IN THE VILLAGE OF OAK BROOK, ILLINOIS PINS: 06-33-104-035 and 06-33-104-036 WHEREAS, an application has been filed by Mary Murphy, Joseph Senese and Lucien Senese (collectively, the "Owners"►, the owners of certain property commonly known as 3324 Roslyn Road, Oak Brook, Illinois and legally described in Exhibit A attached hereto and incorporated herein ("Property'l, requesting an amendment to the Village's Zoning District Map, as provided for in Section 13-14-8 of the "Zoning Ordinance of the Village of Oak Brook," as amended ("Zoning Regulations"), to rezone approximately five acres of Property from R1 (Single -Family Detached Residential District) to R3 (Single - Family Detached Residential District) ("Proposed Map Amendment'j; and WHEREAS, at its meeting on November 19, 2012, the Oak Brook Plan Commission ("PC") reviewed the request for the Proposed Map Amendment, found that the Owner had addressed and satisfied the requirements for the requested relief, and recommended that the President and Board of Trustees approve the Proposed Map Amendment; and WHEREAS, on December 4, 2012, the Oak Brook Zoning Board of Appeals ("ZBA") conducted a public hearing on the Proposed Map Amendment pursuant to due and appropriate legal notice, and WHEREAS, after the close of the public hearing, the ZBA found that the Owner satisfactorily addressed the factors required for approval of the Proposed Map Amendment as set forth in Section 13- 14-8 of the Zoning Regulations and recommended approval of the Proposed Map Amendment; and WHEREAS, the President and Board of Trustees have reviewed the recommendation of the PC and ZBA and deem the Proposed Map Amendment as set forth below to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1. Recitals. The foregoing recitals are restated and incorporated herein as the findings of the President and Board of Trustees. Section 2. Approval of Map Amendment. Pursuant to the standards set forth in Section 13- 14-8 of the Zoning Regulations, the Proposed Map Amendment is hereby approved and the Village's Zoning District Map, as set forth in Section 13-14-2 of the Zoning Regulations, is hereby amended to rezone the Property legally described in Exhibit A and depicted in Exhibit B, attached hereto and incorporated herein, from the R1 Single -Family Detached Residential District to the R3 Single -Family Detached Residential District. Section 3. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance. Section 4, Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
