Pruss Village Clerk Village of Oak Brook DuPage and Cook Counties, Illinois ORDINANCE 2016-ZO-SU-EX-S-1468 AN ORDINANCE APPROVING AN AMENDMENT TO A SPECIAL USE FOR CHRIST CHURCH OF OAK BROOK TO IMPLEMENT A FACILITIES DEVELOPMENT PLAN FOR THE PROPERTIES LOCATED AT 501 OAK BROOK ROAD, 3202, 3212, 3222, AND 3306 YORK ROAD IN THE VILLAGE OF OAK BROOK Christ Church of Oak Brook — 501 Oak Brook Road, 3202, 3212, 3222, and 3306 York Road PINS: 06-36-107-001, 06-36-107-002, 06-36-100-004, 06-36-103-005, and 06-36-103-006 WHEREAS, on August 10, 1971, the Village Board of the Village of Oak Brook passed Ordinance S-237, which approved a special use for the property hereinafter describe for construction of a church sanctuary and steeple; and WHEREAS, in subsequent years, several ordinances amending the special use have been approved to permit additional parking, the operation of a not-for-profit preschool, the construction of additions to the church, various roadway and grading modifications, the construction of a choir rehearsal room, additional classrooms, building of the Oak Tree Discovery Center for children, an outdoor playground, construction of other internal modifications to the building that are consistent with the approved special use for a church, and related improvements; and WHEREAS, an application was filed by Christ Church of Oak Brook ("Christ Church") owner of the property located at 501 Oak Brook Road, 3202, 3212, 3222, and 3306 York Road and legally described in Exhibit A attached hereto and incorporated herein ("Property") requesting an amendment to its existing special use to allow for the implementation and construction of its Facilities Development Plan ("Facilities Plan"), which includes: i) revoking the special use for the property located at 3306 York Road, PIN 06-36-103-006; ii) eliminating all references in prior Village ordinances to Christ Church's Master Plan; iii) approving a Facilities Development Plan for the Property, including enhanced parking lot screening along York Road, modified parking lot orientation to eliminate any parking spaces from abutting or facing York Road, establishing parking lot lighting standards, and modifying access onto Oak Brook Road; and iv) related improvements; and WHEREAS, on January 18, 2016 and on April 18, 2016, the Plan Commission ("PC") reviewed the request for an amendment to such special use; and WHEREAS, on April 18, 2016, the PC recommended approval of the proposed special use amendment, subject to certain conditions; and WHEREAS, on May 23, 2016, the Oak Brook Zoning Board of Appeals ("ZBA") conducted a public hearing, pursuant to due and appropriate legal notice, on the proposed special use amendment; and WHEREAS, after closing the public hearing, the ZBA found that Christ Church satisfactorily addressed the factors required for approval of the special use set forth in Section 13-14-9E of the Zoning Regulations and, in a letter delivered to the President and Board of Trustees dated June 7, 2016, recommended approval of the Special Use to allow the construction of the Facilities Plan subject to certain conditions; and WHEREAS, on June 14, 2016, the Village President and the Board of Trustees reviewed and concurred with the findings and recommendations made by the ZBA and PC, and deemed the amendment to the special use, as set forth below, to be in the Village's best interests; and Ordinance 2016-ZO-SU7EX-S-1468 Christ Church of Oak Brook — 501 Oak Brook Road, 3202, 3212, 3222 and 3306 York Road Special Use - Facilities Development Plan PINS: 06-36-100-004, 06-36-103-005, 06-36-103-006, 06-36-107-001 and 06-36-107-002 Page 2 of 7 WHEREAS, the applicable requirements of Section 13-14-9E of the Village Code relating to the granting of special uses to the Zoning Regulations have been met. The foregoing recitals are incorporated as though fully set forth herein. Section 2. Grant of Special Use. Subject to, and contingent on the conditions, restrictions, and provisions set forth in Section Three of this Ordinance, the Village Board of Trustees shall, and does hereby approve an amendment to the special use previously granted to allow for the following: 1. Revocation of the special use for the property located at 3306 York Road, PIN 06-36-103- 006. 2. Elimination of all references in prior Village ordinances to Christ Church's Master Plan. 3. Approval of a Facilities Development Plan for the Property, including enhanced parking lot screening along York Road, modified parking lot orientation to eliminate any parking spaces from abutting or facing York Road, parking lot lighting standards, and modified access onto Oak Brook Road, all as set forth in the case file plans approved by the Village, all of which are incorporated herein by reference ("Plans"). Section 3. Conditions. The approval granted in Section 2 of this Ordinance is expressly subject to and contingent upon each of the following conditions: A. Substantial Conformance with Plans. All work performed on the Property shall substantially comply with the Plans, including, without limitation: 1. The Facilities Plan shall be constructed in substantial conformance with the site plan on Sheets C2.0 through C5.1 prepared by V3 Companies dated March 25, 2016, page 12 of the case file. 2. The Landscape Plan shall be constructed in substantial conformance with the plan on Sheets L-1, L-2, L-3 and L-4 prepared by Ives/Ryan Group, Inc., dated March 28, 2016, page 14 of the case file, attached hereto and incorporated herein collectively as Exhibit B, and shall include a four (4') foot tall permanent landscaping to screen the southerly exposure of the new parking lot. 3. All lighting and photometric improvements shall be constructed in substantial conformance with the Photometric Plan located on page 13 of the case file dated April 7, 2016 as prepared by Archibald and Meek. In addition, all proposed lighting shall comply with the following backlight, uplight, and glare ("BUG") ratings in new parking areas shown as lots 1, 2 and 3: i. BUG rating (26 W) — B2 UO G1 — 22 fixtures ii. BUG rating (43 W) — B3 UO G1 — 23 fixtures 4. Christ Church shall promptly seek DuPage County's approval of a crosswalk traversing 31st Street (a.k.a., Oak Brook Road) between the proposed full access driveway near the Property's northwest corner and Lincoln Road. Upon DuPage County's approval, Christ Church shall promptly construct the crosswalk at Christ Church's sole cost. Christ Church shall promptly seek the approval from the Village Police and Public Works Departments to install traffic control signage to minimize traffic travelling from the Property onto Lincoln Road. 6. The proposed garage structure located near the Property's northwest corner shall be designed and constructed in a manner that is aesthetically consistent and complimentary to the design and character of the church facility located on the Property. The proposed garage structure and any outdoor storage of goods or materials shall be fully screened by landscaping in an amount and type approved by the Village to minimize its visibility from adjacent rights of way. 7. Any change to the Property's vehicle access points located on York Road or 31st Street (a.k.a., Oak Brook Road) requires DuPage County's advance written approval. 8. In parking lots 2 and 3, the number of overhead lighting fixtures will be limited to seven, not to exceed 20 feet from grade, and shall employ accessory shields as necessary to limit visibility. In parking lots 2 and 3, vehicular access and use will be limited to daytime and closed every evening at 6:00 p.m., and chained and not lighted except on twelve (12) nights per year as designated and published each year on the Christ Church website. B. Compliance with Law and Regulations. Christ Church's Facilities Plan and all other work or activities performed or undertaken on the Property shall comply with all federal, state, and Village ordinances, resolutions, rules, and regulations, as amended. C. Previous Special Use Approval. All provisions of prior special use ordinances approved for the Property, including all ordinances approving special use amendments for the Property, shall remain in full force and effect, except those provisions modified by or in conflict with this Ordinance. In the event of a conflict between this Ordinance and other village ordinances, the more restrictive ordinance shall control. D. Contingent on Variation Approval. The Special Use is subject to the Village's approval of Ordinance S-1467 approving Variations for the Facilities Plan. Section 4. Failure to Comply with Conditions. Upon failure or refusal of Christ Church to comply with any or all of the conditions, restrictions, or provisions of this Ordinance, the Special Use granted in Section 2 of this Ordinance will, at the sole discretion of the President and Board of Trustees, by ordinance duly adopted, be revoked and become null and void. Section 5. Binding Effect. This Ordinance and the privileges, obligations, and provisions contained herein shall inure solely to the benefit of, and be binding upon, the Christ Church and any and all of Christ Church' heirs, successors, and assigns, and upon any and all current and successor legal or beneficial owners of all or any portion of the Property Section 6. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this Ordinance. Section 7. Effective Date. A. This Ordinance will be effective only upon the occurrence of all of the following events: i. Passage by the President and Board of Trustees of the Village of Oak Brook in the manner required by law; ii.
