SUBJECT: Award of Contract - 2018 Street Improvements

BUDGET SOURCE/BUDGET IMPACT: $1,233,725 from account 461-90700,
Street Improvements.
RECOMMENDED MOTION: I move the Village Board award a contract to Burke
LLC, Rosemont, Illinois, in the amount of $1,233,725, subject to final attorney review, for
the Construction Management Contract for Designer-Led Design-Build of the 2018 Street
Improvements, and approve Resolution R-1744.
Background/History:
We have postponed the annual road project while we contracted with Christopher B. Burke
Engineering to conduct a complete evaluation of all village streets. The preliminary
evaluation is completed and we are working to merge this report with the Water Master
Plan. When evaluating the streets, it was determined that surface repairs were needed to
Village streets that had premature pavement failure, these repairs will require grinding of
the surface course and replacing the top 2-inches with a hot-mix asphalt. Some patches will
require full depth repairs, up to 8-inch removal to repair the base. There are also two areas
that will need reconstruction, Grant Street and the front driveway at Fire Station #93.
The 2018 Street Improvements will include areas marked out in Brook Forest, Trinity
Lakes, on Jorie Boulevard and Grant Street at Fire Station’s # 93 and #94, also repairs
made to large utility excavations in the Oakbrook Center Mall and Brandywine
Association.

Please be advised that the remaining balance, $107,976.06 of the CBBEL Professional
Services Contract for design and construction management will be forfeited.
This project will be paid through the Village’s Street Improvement fund.
Recommendation:
That the Village Board award a contract to Burke LLC, Rosemont, Illinois, in the amount
of $1,233,725, subject to final attorney review, for the Construction Management
Designer-Led Design-Build of the 2018 Street Improvements, and approve Resolution
R-1744.
RESOLUTION 2018-ENG-ST-PRJT-R-1744
A RESOLUTION APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT
BY AND BETWEEN THE VILLAGE OF OAK BROOK AND BURKE, LLC
FOR CONSTRUCTION ENGINEERING SERVICES RELATED TO THE 2018 STREET IMPROVEMENT
WHEREAS, the Village of Oak Brook (the “Village”) has budgeted funds for construction
engineering for the 2018 Street Improvement Project, which includes certain street and infrastructure
improvements to Brook Forest, Trinity Lakes, Jorie Boulevard, Grant Street at Fire Stations #93 and #94,
as well as repairs made to utility excavations in the Oakbrook Center Mall and Brandywine Association
(collectively, the "Project"); and
WHEREAS, the Village desires to retain an engineer to provide surface repairs to Village streets
that have premature pavement failures ("Services"); and
WHEREAS, BURKE, LLC ("Burke") previously provided satisfactory engineering services to the
Village; and
WHEREAS, pursuant to the Local Government Professional Services Selection Act ("Act"), 50
ILCS 510/0.01 et seq., and Section 1-7-6 of the Village Code, the Village is not required to follow the notice,
evaluation, and selection procedures set forth in the Act for engineering services provided by engineers
who have a satisfactory relationship with the Village; and
WHEREAS, the Village and Burke desire to enter into and execute an agreement for Burke to
provide the Services to the Village for an amount not to exceed $1,233,725 ("Agreement”), which
Agreement is attached to this Resolution as Exhibit A; and
WHEREAS, the President and Board of Trustees have determined that it is in the best interest of
the Village to enter into the Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of,
this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the Agreement. The President and Board of Trustees hereby approve
the Agreement by and between the Village and Burke in substantially the same form as attached as Exhibit
A, and in a final form approved by the Village Attorney.
Section 3: Authorization and Execution of the Agreement. The Village Manager and Village
Clerk shall be, and hereby are, authorized to execute the Agreement after receipt of the final Agreement
fully executed by Burke.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
