SUBJECT: Intergovernmental Agreement between the County of DuPage and the
Village of Oak Brook

RECOMMENDED MOTION: I move that the Village Board approve this
Intergovernmental Agreement (IGA) between the County of DuPage and
the Village of Oak Brook for the implementation of the National Pollutant
Discharge Elimination System (NPDES) Program in The Salt Creek
Watershed and approve Resolution R-1719.
Background/History: DuPage County as well as over 40 municipalities and townships in
the County are permitted to discharge storm water through coverage under the IEPA's
NPDES General Permit ILR40 for Discharges from Small Municipal Separate Storm
Sewer Systems (MS4). In order to avoid overlap of efforts, DuPage County partners with
municipalities in completing many of the minimum control measures required by this
permit. These measures include education & outreach on water quality impacts, public
involvement, staff training, workshops, and illicit discharge inspections.
In order to further combine efforts and share services where possible, Storm water
Management staff has been working on establishing a Countywide Water Quality
Program, referred to by the IEPA as a Qualifying Local Program. This will allow us to
combine the efforts of the County and the municipalities on a watershed basis to provide
the water quality measures required by the IEPA under one streamlined and more
efficient program. This IGA addresses the Qualifying Local Program to meet the NPDES
requirements on a watershed basis.

Recommendation: I move that the Village Board approve this Intergovernmental
Agreement (IGA) between the County of DuPage and the Village of Oak Brook for The

RESOLUTION 2018-DUP-NPDES-IGA-R-17
A RESOLUTION APPROVING AND AUTHORIZING THE
EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT BY
AND BETWEEN THE VILLAGE OF OAK BROOK AND DUPAGE
COUNTY IN RELATION TO THE IMPLEMENTATION OF THE
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
(NPDES) PROGRAM IN THE SALT CREEK WATERSHED
WHEREAS, the Village and DuPage County ("COUNTY") desire to execute an
intergovernmental agreement in relation to the implementation of the National Pollutant Discharge
Elimination System Program in the Salt Creek Watershed ("NPDES Salt Creek Watershed
Agreement"); and
W HEREAS, the Village is authorized to enter into the NPDES Salt Creek Watershed
Agreement with County pursuant to the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.;
and
WHEREAS, the President and Board of Trustees have determined that it is in the best interests
of the Village to enter into the NPDES Salt Creek Watershed Agreement in substantially the form
attached and by this reference incorporated into this Resolution as Exhibit A.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part
of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Approval of the NPDES Salt Creek Watershed Agreement. The President and
Board of Trustees hereby approve the NPDES Salt Creek Watershed Agreement by and between the
Village and County in a form substantially the same as attached to this Resolution as Exhibit A and in
final form acceptable to the Village Attorney.
Section 3: Authorization and Execution of the NPDES Salt Creek Watershed
Agreement. The Village President and Village Clerk shall be, and hereby are, authorized to
execute the final NPDES Salt Creek Watershed Agreement on behalf of the Village.
Section 4: Effective Date. This Resolution shall be in full force and effect upon passage and
approval in the manner provided by law.
