SUBJECT: Award of Contract – for Removal of Buckthorn, Ash Trees, and other Dead
Trees at the Sports Core Property, along Bath and Tennis Drive and around the Pool.

(335-76800)
RECOMMENDED MOTION: I move that the Village Board waive further bidding and
award a contract, pending final attorney review and approval, to Homer Tree Care,
Lockport, Illinois, in the amount of $49,640, for the Removal of Invasive Brush, Ash Trees
and Dead Trees at the Sports Core property, along Bath and Tennis Drive, and around the
pool in the areas highlighted on the attached maps.
Background/History:
During the 2018 Budget Meetings, staff was directed to include money to start the
removal of invasive Buckthorn, Ash Trees, and standing Dead Trees at the Sports Core
Property. The areas included in this contract are, a clear path, forty (40) feet wide, on
both sides of Bath and Tennis Drive, and the areas around the pool and pond. (see
attached maps)
First, staff requested an estimate from our current tree service contractor Winkler’s Tree
Service but were informed that the area is too large for them, and since they do not have
the equipment required to cut back the Buckthorn, it would all need to be done manually.
Also, Winkler’s stated that they would have to contract through Homer Tree Care to
complete the work. Staff then reached out to other tree maintenance vendors to obtain
estimates for the work but were told by each that they do not have the equipment needed
to properly complete the work either. Homer is the only local contractor that has the
expertise and specialty equipment needed for this type of brush and tree removal.

Recommendation:
Staff recommends that the Village Board waive further bidding and award a contract,

A RESOLUTION WAIVING COMPETITIVE BIDDING AND AUTHORIZING
THE EXECUTION OF A CONTRACT
BETWEEN THE VILLAGE OF OAK BROOK AND HOMER TREE CARE
IN RELATION TO REMOVAL OF BUCKTHORN, ASH AND DEAD TREES
AT THE SPORTS CORE PROPERTY
WHEREAS, Staff was directed to obtain quotes for removal of invasive Buckthorn, Ash, and Dead
Trees at the Sports Core Property; and
WHEREAS, Homer Tree Care (“Homer”) is a local contractor that has the expertise and specialty
equipment needed to remove invasive Buckthorn, Ash, and Dead Trees (“Tree Services”); and
WHEREAS, the Village desires to enter into a Contract (“Contract”) with Homer for the Tree
Services, which Contract is attached to this Resolution as Exhibit A; and
WHEREAS, Village staff recommends that the Village waive competitive bidding and enter into a
Contract with Homer for Tree Services; and
WHEREAS, the President and Board of Trustees, being fully advised in the premises, have
determined that it is in the best interests of the Village and its residents to waive competitive bidding for
Tree Services and approve the Contract;
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows:
Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of,
this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook.
Section 2: Waiver of Competitive Bidding Requirements. The advertising and bidding
requirements for Tree Services shall be, and they are hereby, waived in accordance with Section 1-7-4 of
the Village Code of the Village of Oak Brook, Illinois.
Section 3: Approval of Contract. The President and Board of Trustees hereby approve the
Contract for Tree Services with Homer in substantially the same form as attached as Exhibit A.
Section 4: Authorization and Execution of Contract. The Village Manager and Village Clerk
shall be, and hereby are, authorized to execute the Contract for Tree Services between the Village and
Homer after final approval by the Village Attorney and receipt of the final Agreement fully executed by
Homer.
Section 5: Effective Date. This Resolution shall be in full force upon passage and approval
in the manner provided by law.
