PROFESS10NAL SERVICE AGREEMENT BETWEEN THE ViLLAGE OF OAK BR00K AND HOMER
TREE CARE,iNC.:N RELAT10N TO REMOVAL OF BUCKTHORN,ASH TREES,AND DEAD TREES
AT THE SPORttS CORE PROPERTY
WHEREAS, the Village of Oak Brook(the“ИIIage")WiShes to remove certain vegetation,
including buckthorn, Ash ttrees, and dead trees, from the Sports Core property, around the Village's
tennis courts,and neartheヽ ハ∥age's golf maintenance building(the“ッИo■で');and
WHEREAS,the Vi∥age solicned bids from five tree seⅣice contractors to complete the Work:and
VVHEREAS,four ofthe contractors indicated that they were unab:e to undertake the Work due to
a lack of equipment,manpower,or bothi and
WHEREAS, the nfth cOntractor, Homer Tree SeⅣlce, inc.(aka, HOmer Tree Care, :nc)
(“″omeノ '),submitted a bid to complete the VVork in an amount notto exceed$62,60000;and
WHEREAS,pursuant to Section l-7-4A ofthe Oak Brook Vi∥age Code,the Vi∥age has authorlty
to waive competitive bidding by a vote oftwo―thirds(2/3)of the Village trustees then holding officei and
NOW THEREFORE,BE ltt RESOLVED BY ttHE PRESIDENtt AND BOARD OF ttRUSttEES OF
THE VILLAGE OF OAK BR00K,DU PAGE AND C00K COUN丁 !ES,ILLINOIS,as fo!lows:
Section l: Rectals tthe foregoing recitals are hereby incorporated into,and made a part
ofithis Resolution as the findings ofthe President and Board of l‐rustees ofthe Vi∥age of Oak Brook
Section 2: VVaiver of Connpeujve Biddlng tthe Board of Trustees authorizes the adoption of
this Reso!ution without the need for competitive biddlng, and finds that Homer is the lovvest responsive
and responsible bidder
Section 3: Approval of Aoreement tthe President and Board of Trustees hereby approve
the Agreement by and between the V∥lage and Homer in substantia∥y the same form as attached as
Exhibit A,and in a finalform approved by the Vi∥age Attorney
Secuon 4: AuthonzatiOn and Execution ofthe Agreement tthe Vlllage Manager and Village
Clerk sha∥be,and hereby are,authorized to execute the Agreement after receipt of the final Agreement
fu∥y executed by Homer
Section 5: Effective Date tthls Resolution sha∥be ln fu∥force and effect upon passage and
approvalin the manner provided by law ′
