RECOMMENDED MOTION: I move the Village Board award a contract to Burke LLC, Rosemont, Illinois, in the amount of $2,885,165, and approve Resolution R-1773 subject to final attorney review. A Construction Management Contract for Designer-Led Design-Build of the Storm Sewer Improvements at the Bath and Tennis Club, the B&T Circle and Drive-Up Road Reconstruction, Drainage Improvements and Site Work for the Salt and Combined Storage Facility. Background/History: We had postponed the Bath & Tennis Club Circle and Drive-Up Road Reconstruction while we reviewed the storm water drainage issues around the Bath & Tennis Club and in the area of the proposed Salt and Storage Facility. We have combined these projects to obtain a better price for the underground drainage and site work. These projects will correct the drainage issues in the B&T Circle, around the Pool and around the Golf Maintenance building. The Salt and Storage Facility will clean up and combine multiple storage and spoil sites around the property. This drainage area will include a storm water drainage system that would contain any potential run off before it enters into DuPage County Storm sewers or the Salt Creek Floodplain. The Bath and Tennis Circle Reconstruction will include Brick Pavers in the circle as a Permeable Surface, the landscape within the circle and the area in front on the B&T were designed as Best Management Practice (BMP) to help control storm water runoff. RESOLUTION 2019-SC-B&T/-ENG-AG -R-1773 A RESOLUTION APPROVING AND AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT BY AND BETWEEN THE VILLAGE OF OAK BROOK AND BURKE LLC FOR SPOTS CORE DRAINAGE IMPROVEMENTS AND BATH & TENNIS CIRCLE DRIVE RECONSTRUCTION WHEREAS, the Village of Oak Brook (the “Village”) wishes to reconstruct the Bath & Tennis Circle and access road and undertake certain stormwater improvements in and around the Bath & Tennis property and the proposed salt storage facility (the “Services”); and WHEREAS, Burke LLC (“Burke”) previously provided satisfactory engineering design services to the Village; and WHEREAS, pursuant to the Local Government Professional Services Selection Act ("Act"), 50 ILCS 510/0.01 et seq., and Section 1-7-6 of the Village Code, the Village is not required to follow the notice, evaluation, and selection procedures set forth in the Act for engineering services provided by engineers who have a satisfactory relationship with the Village; and WHEREAS, the Village and Burke desire to enter into and execute an agreement for Burke to provide the Services to the Village for an amount not to exceed $2,885,165.00 ("Agreement”), which Agreement is attached to this Resolution as Exhibit A; and WHEREAS, the President and Board of Trustees have determined that it is in the best interest of the Village to enter into the Agreement; NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Approval of the Agreement. The President and Board of Trustees hereby approve the Agreement by and between the Village and Burke in substantially the same form as attached as Exhibit A, and in a final form approved by the Village Attorney. Section 3: Authorization and Execution of the Agreement. The Village Manager and Village Clerk shall be, and hereby are, authorized to execute the Agreement after receipt of the final Agreement fully executed by Burke. Section 4: Effective Date.
