DEAN BOARD ROOM BUTLER GOVERNMENT CENTER 1200 OAK BROOK ROAD OAK BROOK, ILLINOIS 630-368-5000 AGENDA ITEM Regular Board of Trustees Meeting of May 28, 2019 SUBJECT: Award of Contract – Bath & Tennis Club Pool Renovation Project FROM: Doug Patchin, Public Works Director BUDGET SOURCE/BUDGET IMPACT: $750,000 is budgeted in Swimming Operations, Structural Improvements #812-90400. RECOMMENDED MOTION: I move that the Village Board waive bidding and award a contract to Mid-America Pool Renovation, Inc., Grandview, MO in the revised amount of $1,048,975, and approve Resolution R-1806, subject to final attorney review. Background/History: At the February 26, 2019 meeting, the Village Board approved $944,702 to repair the leaks in the Bath and Tennis pools by replacing the gutter system, filtration system and coating the pools with INTER-GLASS, a fiberglass coating with a 25 year Limited Warranty. The additional $104,273 is for paying Prevailing Wage, as we are required to according to the Illinois Prevailing Wage Act, on all Public Works Projects. Part of the gutter replacement project required that Mid-America Pool Renovation submit Engineered Plans and Drawings to the Illinois Department of Public Health (IDPH) to obtain a construction Permit. IDPH requires that to renovate a gutter system on an existing pool the system must be brought up to their current standards. This requires that a surge tank be installed as part of the gutter system to allow for both skimming, suction and water returns. As part of the gutter system and surge tank installation, Mid-American Pool Renovation also looked at the existing pool filtration system. The existing filter system is a Diatomaceous Earth (DE) filter, diatomaceous earth is made of amorphous silicon dioxide. Silica dust has been identified as a hazardous substance, working with and handling silica is regulated by OSHA. Stringent respiratory safety and handling precautions must be followed when working with or around diatomaceous earth. By replacing the filtration system with a new sand filter this will remove this safety hazard. ITEM 8.C.4 BOT AGENDA Page 2 The new filtration system would require demolition of the existing filter pit in the Bath and Tennis basement and replacing it with three (3) horizontal fiberglass sand filters. Maintenance of the sand filters requires back flushing which only flushes out the impurities and not the sand, this requires less maintenance and is less expensive then to continue the use of DE. The above work is classified as a Public Works Project, paid for using public funds, which require the Village to pay prevailing wage. Recommendation: Staff recommends that the Village Board waive bidding and award a contract to Mid- America Pool Renovation, Inc., Grandview, MO, in the revised amount of $1,048,975, and approve Resolution R-1806, subject to final attorney review. RESOLUTION 2019-R-1806 A RESOLUTION WAIVING COMPETITIVE BIDDING AND AUTHORIZING THE EXECUTION OF A FURTHER REVISED CONTRACT BETWEEN THE VILLAGE OF OAK BROOK AND MID-AMERICA POOL RENOVATION, INC. TO PROVIDE BATH & TENNIS CLUB POOL REPAIRS WHEREAS, the Village of Oak Brook (the “Village”) wishes to repair certain leaks and other deficiencies associated with the pool located on the Village’s Bath & Tennis Club property (the “Work”); and WHEREAS, on January 8, 2019, the Village approved a resolution awarding a contract to Mid- America Renovation, Inc., (“Mid-America”) to complete the W ork for an amount not to exceed $728,958.00; and WHEREAS, on February 26, 2019, the Village approved a resolution requiring Mid-America to provide additional pool gutter and filtration system services, and increasing the contract cost to $944,702; and WHEREAS, to comply with the Illinois Prevailing Wage Act (820 ILCS 130/0.01, et seq.), the contract amount must be increased by another $104,273, producing a total not to exceed figure of $1,048,975 (the “Additional Work”); and WHEREAS, the Village wishes to approve a further revised contract with Mid-America incorporating the Additional Work; and WHEREAS, pursuant to Section 1-7-4A of the Oak Brook Village Code, the Village has authority to waive competitive bidding by a vote of two-thirds (2/3) of the village trustees then holding office; and NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: Recitals. The foregoing recitals are hereby incorporated into, and made a part of, this Resolution as the findings of the President and Board of Trustees of the Village of Oak Brook. Section 2: Waiver of Competitive Bidding. The Board of Trustees authorizes the adoption of this Resolution without the need for competitive bidding, and finds that Mid-America is the lowest responsive and responsible bidder. Section 3: Approval of Contract. The President and Board of Trustees hereby approve the Contract by and between the Village and Mid-America in substantially the same form as attached as Exhibit A, and in a final form approved by the Village Attorney. Section 4: Authorization and Execution of the Contract. The Village Manager and Village Clerk shall be, and hereby are, authorized to execute the Contract after receipt of the final Contract fully executed by Mid-America. Section 5: Effective Date. This Resolution shall be in full force and effect upon passage and approval in the manner provided by law. FROM: Doug Patchin, Public Works Director BUDGET SOURCE/BUDGET IMPACT: $750,000 is budgeted in Swimming Operations, Structural Improvements #812-90400. RECOMMENDED MOTION: I move that the Village Board waive bidding and award a contract to Mid-America Pool Renovation, Inc., Grandview, MO in the amount of $728,958. and approve Resolution R-1774, subject to final attorney review. Background/History: During the 2018 pool season staff noticed that we were losing water in the pool at a rate of 8,000 gallons per day. Before the season ended we contracted with a leak detection company to check the interior of the pool under water for leaks, a few were found but nothing drastic. After the pool closed for the season we drained the pool half way and placed blue dye into the filtration gutter and filled them with water, within 1 hour the dye started to be visible along the bottom of the pool where the walls meet the floor and along the cold joints on the walls and floor, (the cold joint is between two separate concrete pours) within 30 minutes the all joints were showing blue dye leaking into the pool. Over a matter of hours, the entire pool was blue. Staff obtained multiple estimates for pool repairs using concrete, plaster and fiberglass spot patching with no guaranty to a total reconstruction of the pools estimated at $3,991,533. Mid-America Renovation was another company we contacted to look at the pool, they were highly recommended by multiple pool maintenance companies and the Park District. BOT AGENDA Page 2 After inspecting the pool Mid-America recommended INTER-GLASS coating, a strong flexible coating that uses Polymeric materials to create a deep penetrating and sealing Protective Barrier System, along with fully bonded, seamless closed-coat water containment system that becomes an integral part of the pool and carries a 25-Year Limited Warranty. The INTER-GLASS coating is applied in a multi-step process. 1.Clean pools using 40,000 psi. Ultra High Pressure Water Jetting to remove existing paint. 2. Remove all hollow lifted or blistered areas. 3. Hydro-blasting 5,000 psi. water blasting to completely clean the prepared pool surface. 4. Installation of a penetrating rubber modified barrier system that bonds and seals the pool shell. 5. Stress and structural crack repair as needed. 6. Install contrasting color highlight tiles to demark the edge. 7. Install the new tiled racing lines, targets and transition lines on the lap pool. 8. The final phase is a multi-part process that ensures a strong pool surface. The INTER-GLASS gel and fabric is hand applied to ensure custom fit, strength and consistency. It chemically bonds to the penetrating resin and becomes part of the pool shell. Recommendation: Staff recommends that the Village Board waive bidding and award a contract to Mid- America Pool Renovation, Inc., Grandview, MO in the amount of $728,958. and approve Resolution R-1774, subject to final attorney review.
