The following is a summary of changes to be made to the Construction Manager's Bid Manual for this project. Please review and incorporate all changes into your bid. This addendum shall be noted on the bid form verifying inclusion of this work in your bid. ADDENDUM NO. 3 1. The following change applies to all bid packages: A. All addenda shall be noted on the front page of the bid form. Bid addenda can be verified on PROCORE. B. New bid form attached. C. Revised alternate sheet attached 2. In the SCOPE OF WORK sections, make all changes as outlined below: A. Bid Package #06A – General Trades Item Revision: 8. Miscellaneous Furnish and install all carpet and resilient base as shown and indicated on the contract documents. 3. Was it a mandatory job walk? And is it possible to go to the site and do a field take off? FREEDOM OF INFORMATION ACT REQUIREMENTS: 1 2 3 a. 7. PREVAILING WAGE PROJECT: The general prevailing rate of wages in the locality for each craft or type of worker or mechanic needed to execute the contract or perform such work and the general prevailing rate for legal holiday and overtime work, shall be not less that the prevailing rate of wages as found by the Board, the Illinois Department of Labor, or the court on review, and be paid for each craft or type of worker needed to execute the contract or to perform such work; It shall be mandatory upon the contractor to whom the contract is awarded and upon any subcontractor, to pay not less than the specified rates to all laborers, workmen, and mechanics employed in the execution on the contract of such work. All Contractors' bonds shall include such provision as will guarantee the faithful performance of such prevailing wage clause as provided by contract (820 ILCS 130/0.01 et seq) It is contesting its liability for the tax or the amount of tax in accordance with procedures established by the appropriate Revenue Act; or 9. CERTIFICATION FOR CONTRACT: The Contractor is not currently delinquent in the payment of any tax administered by or owed to Illinois Department of Revenue or otherwise in default upon any such tax as defined by the Illinois The Contractor is fully aware of and able to comply with all Local, State and federal Safety and other Laws, Codes and regulations applicable for the construction of the Project. The contractor ensures that they operate a drug-free environment and that drugs are not allowed in the workplace or satellite locations as well as the project site in accordance with the Drug Free Workplace Act of January 1992. This project is subject to the State of Illinois Prevailing Wage requirements for DuPage County, IL, and as such the provisions of the Prevailing Wage Act shall be complied with in all applicable work to be performed at the Village of Oak Brook Police (820 ILCS 130/0.01 et seq.). The Bidder acknowledges that the Freedom of Information Act, 5 ILCS 140/1 et seq. (the “Act”) places an obligation on Village of Oak Brook, (the, “Owner”), to produce certain records that may be in the possession of Bidder. Bidder shall comply with the record retention and documentation requirements of the Local Records Retention Act 5 ILCS 160/1 et seq. and the Act and shall maintain all records relating to any work being done for the Owner in compliance with the Local Records Retention Act and the Act (complying in all respects as if the Bidder was, in fact, the Owner). Bidder shall review its records promptly and produce to the Owner within two business days of request by the Owner the required documents responsive to a request under the Act. If additional time is necessary to comply with the request, the Bidder may request the Owner to extend the time do so, and the Owner will, if time and a basis for extension under the Act permits, consider such extensions. Bidder further acknowledges that the Act, as amended and effective January 1, 2010, provides for severe criminal and civil penalties for willful failure to comply with its terms. Accordingly, Bidder does hereby agree, as an additional condition of being awarded a bid or the Construction Manager agreeing to contract with Bidder to provide labor, services or materials to the Owner, that it will hold harmless and indemnify, including costs and reasonable attorneys fees, the Construction Manager, the Owner and its Trustees, officers, agents and employees, against all damages incurred or penalties or fees assessed against it or them because of non-compliance with this agreement or the Act or the production requirements imposed under the Act.
