S-1241 - 09/09/2008 - VARIATION - OrdinancesORDINANCE 2008-ZO-V-S-1241 AN ORDINANCE GRANTING A VARIATION FOR THE CONSTRUCTION OF A GROUND SIGN AT 1400 16T" STREET IN THE VILLAGE OF OAK BROOK (PIN: 06-23-102-025) WHEREAS, an application has been filed by InSite Goshen, LLC, InSite Freeport, LLC and InSite Oak Brook, LLC (collectively the "Petitioner') requesting a variation to Section 13-11-8A of the Zoning Ordinance to allow the construction of a ground sign; and WHEREAS, on August 5, 2008, the Zoning Board of Appeals conducted a public hearing on the request for the variation, pursuant to due and appropriate legal notice, and by a vote of 6 to 0 recommended approval of the variation subject to certain conditions; and WHEREAS, the Zoning Board of Appeals found that the Petitioner satisfactorily addressed the factors required for approval of the requested variation and made specific findings, including that the variation will not endanger the public health, safety and welfare, and that there will be no substantial injury to other property in the neighborhood; and WHEREAS, the Village President and Board of Trustees have reviewed the recommendation of the Zoning Board of Appeals and deem the variation, as set forth below, to be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS, as follows: Section 1: The foregoing preambles are restated and incorporated herein by reference as though fully set forth herein. Section 2: The Petitioner is hereby granted a variation to Section 13-11-8AA of the Zoning Ordinance to allow the construction of a ground sign to be placed thirty-one (31) feet from the front lot line along 16'x' Street subject to the following conditions: 1. The development shall be in substantial conformance with the plans as submitted on pages 12, 13 and 15 of the case file. 2. The sign is subject to engineering approval by the Village. 3. The installation of appropriate landscaping in accordance with the Zoning Ordinance requirements. 4. The Petitioner shall meet all Village Code requirements existing as of the time that the building permit application is submitted to the Village except as specifically varied or waived by this ordinance. Section 3: The variation and the scope of this ordinance are limited and restricted to the property located at 1400 16"' Street, which is legally described as follows: LOT 3 IN THE BUCKIERNIE PYLE 2"d RESUBDIVISION OF PART OF THE NORTHWEST QUARTER OF SECTION 23, TOWNSHIP 39 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF Ordinance 2008-ZO-V-S-1241 Variation.
