Village of Oak BrookT1200OakBrookRoad N/A Oak Brook, Illinois 60523 Z, 'Sn ORDINANCE 2002- ZO -SU -S- 1030 AN ORDINANCE GRANTING A SPECIAL USE FOR A NON - RESIDENTIAL, POST BACCALAUREATE SCHOOL 2122 YORK ROAD, OAK BROOK, IL) WHEREAS, an application has heretofore been filed for an amendment to Section 13 -10E -2 of the Village Code of the Village of Oak Brook to allow as special uses in the 0-4 Zone District non - residential, post baccalaureate schools, provided that not more than twenty percent (20 %) of the course offerings may be prerequisite to admission to the post baccalaureate programs; and WHEREAS, pursuant to Ordinance 2002- ZO -TA -G- 710 , the Village President and Board of Trustees of the Village of Oak Brook have amended the Zoning Ordinance of the Village of Oak Brook to incorporate the same as a Special Use in the 0-4 Zone District; and WHEREAS, a petition for a special use has been filed pursuant to said text amendment to authorize the use of not more than 15,000 square feet of the building located at 2122 York Road for a non- residential post baccalaureate school, provided not more than 20% of the course offerings may be prerequisite to admission to the past baccalaureate program; and WHEREAS, the Plan Commission of the Village of Oak Brook has submitted its report on the subject petition to the Zoning Board of Appeals and the President and Board of Trustees and has recommended the approval of the issuance of a special use, subject to certain conditions; and WHEREAS, a public hearing on such petition has been conducted by the Zoning Board of Appeals of the Village on November 5, 2002 pursuant to due and appropriate legal notice, and said Board has submitted its report on the subject petition to the President and Board of Trustees and has recommended approval of the special use; and WHEREAS, the President and Board of Trustees have reviewed these recommendations and concur with the recommendations and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble heremabove set forth are hereby adopted as though fully set forth herein. Section 2: That a Special Use pursuant to the provisions of Section 13- 10E -2, as amended, be and is hereby granted for the use of a non - residential, post baccalaureate school, provided that not more than twenty percent (20 %) of the course offerings may be prerequisite to admission to the post baccalaureate programs at the property located at 2122 York Road, which property is legally described as follows: Parcel 2: Lot 3 of Butler Company — M -1, Inc.
