Ginex,Village Manager BUDGET SOURCE/BUDGET IMPACT: NA RECOMMENDED MOTION: I move to Approve Resolution 2020 DCL-EM- VOB-COVID-I9-R-1867,A Resolution Approving and Authorizing A Declaration of Emergency COVID-19. Background/History: Village President Gopal Lalmalani issued a disaster proclamation for the Village of Oak Brook in response to the COVID-19 situation. By issuing a disaster proclamation,the Village officially activated its Emergency Operations Plan and will continue to work with local, state, and federal partners to respond to the COVID-19 outbreak. This resolution of a state of emergency in Oak Brook, allows the Village to become eligible for additional funding for our operational response. It will expire 60 days from the date of passage. Recommendation: That the Village Board approves the resolution. PRUSS, Village Clerk JOHN BAAR PHILIP CUEVAS MICHAEL MANZO MOIN SAIYED EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 26th day of March, 2020 RESOLUTION R-1867 A RESOLUTION APPROVING AND AUTHORIZING A DECLARATION OF EMERGENCY COVID-19 WHEREAS, the United States Centers for Disease Control (CDC), the United States Department of Health and Human Services (HHS), and the World Health Organization (WHO) have each determined that SARS-CoV-2 virus causes the COVID-19 respiratory disease; WHEREAS, the SARS-CoV-2 virus is a new strain of coronavirus that had not been previously identified in humans and is easily spread from person to person and the COVID-19 disease can result in serious illness or death; WHEREAS, dozens of confirmed cases of COVID-19 have been identified in the State of Illinois; to date, all of the cases in Illinois are in the greater Chicagoland area; WHEREAS, on January 31, 2020, the Secretary of HHS declared a public health emergency for the entire United States of America concerning COVID-19, on March 9, 2020, Governor Pritzker issued a disaster proclamation concerning the spread of COVID-19 in Illinois, on March 11, 2020, WHO declared that the spread of COVID-19 is a global pandemic, on March 13, 2020 President Trump declared a national emergency concerning the COVID-19 pandemic and on March 15, 2020 DuPage County Board Chairman Cronin issued a disaster proclamation concerning the spread of COVID-19 in DuPage County and on March 20, 2020 Governor Pritzker issued an order for all residents of Illinois to "shelter in place"; WHEREAS, the Illinois Department of Public Health has now confirmed localized community person-to-person transmission of COVID-19 in Illinois, significantly increasing the risk of exposure and infection to Illinois' general public and creating an extreme public health risk in the Village and throughout the State; WHEREAS, as has been experienced in other locales in the United States and around the world, the SARS-CoV-2 virus has the potential to infect large numbers of people in a short amount of time, placing extreme burdens on the health care system and the economy; and WHEREAS,that the Corporate Authorities of the Village of Oak Brook understand that this is a fluid situation ever changing and in order to prevent the spread of COVID-19 in the Village, and to protect the residents of the Village from disease and death, it is necessary to issue this Declaration to implement emergency regulations and orders, all as set forth in this Declaration. Section One - Statement of Authority This Declaration is issued pursuant to the authority granted under the Village of Oak Brook Code of Ordinances, as amended; Section 11-1-6 of the Illinois Municipal Code, 65 ILCS 5/11-1- 6; and Section 11 of the Illinois Emergency Management Agency Act, 20 ILCS 3305/11. 2 Section Two — Declaration The Corporate Authorities of the Village of Oak Brook hereby declare that a state of emergency and a state of disaster exists in the Village of Oak Brook for the reasons set forth in this Declaration. Section Three - Emergency Regulations and Orders The Village hereby directs and orders as follows: a) Emergency Purchasing. The Village may enter into contracts for the emergency purchase of goods and services that may be necessary for the preparation for, response to, and recovery from, the COVID-19 pandemic. The Village President and the Village Manager are hereby authorized to execute such contracts in accordance with applicable law. b) Emergency Staffing. This Declaration constitutes a declaration of civil emergency under the Village's collective bargaining agreements. Accordingly, the Village President is authorized and directed to implement such emergency staffing protocols and procedures as may be necessary for the preservation of public health and safety, and for the preservation of the health of Village employees. Specifically, and without limitation of the foregoing, the Village President is authorized to implement alternative staffing protocols, procedures, and shifts for the Village Fire, Police, and Public Works Departments. C) Cooperation with Other Government Agencies. All Village officials and employees are directed to take all practicable steps to coordinate the Village's resources and emergency operations with the State of Illinois, the County of DuPage, and other local governments in and around the Village, to best utilize resources of all agencies in the area for the preparation for, response to, and recovery from, the COVID-19 pandemic. d) Consistent with Governor Pritzker's Executive Order 2020-10, which authorizes each municipality to determine its Essential Government functions, the Village excludes all Emergency Responders from coverage under the Families First Coronavirus Response Act, Public Law 116-127, to the maximum extent permitted by federal law. Section Four- Other Actions Authorized The Village President is hereby authorized to issue additional emergency regulations and orders in furtherance of this Declaration. Notice of any additional regulations and orders will be provided to the Village Clerk, posted on the Village website, and otherwise provided to the general public as quickly as practicable. Section Five - Effective Date and Period of Emergency This declaration shall take effect immediately and shall expire 60 days from the effective date set forth herein. Section Seven—Publication This declaration shall be published in book or pamphlet form as provided by the Illinois Municipal Code. 3 Section Ten—Recording This declaration shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
