Kruger Jr., Chief of Police Al BUDGET SOURCE/BUDGET IMPACT: None RECOMMENDED MOTION: I move that the Village Board approve Ordinance 2020- PD-PASS-G-1168 creating Schedule XVIII and prohibiting vehicular passing on the left on 35"' Street between Midwest/Cass and Meyers Road. Background/History: The Village has received significant complaints regarding speeding and unsafe operation of motor vehicles on 35"' Street, west of Midwest Rd, east of Meyers Rd. As a means to provide for increased traffic safety and traffic calming, the street was striped as a "No Passing Zone". This ordinance and creation of a new schedule in our traffic code would codify that marking and allow for regular enforcement, especially in the event of a traffic crash. This zone would not prohibit the passing of a vehicle parked on the side of the roadway or stopped in traffic. It is meant to prohibit overtaking a moving motor vehicle. Recommendation: Staff recommends that the Village Board approve Ordinance 2020-PD-PASS-G-1168. PRUSS, Village Clerk JOHN BAAR PHILIP CUEVAS MICHAEL MANZO MOIN SAIYED EDWARD TIESENGA ASIF YUSUF Village Board Published in pamphlet form by authority of the President and the Board of Trustees of the Village of Oak Brook on this the 11 th day of August, 2020 ORDINANCE NO.2020-PD-PASS-G-1168 AN ORDINANCE AMENDING TITLE 7 CHAPTER 2 SECTION 7-2-1 OF THE VILLAGE OF OAK BROOK CODE OF ORDINANCES WHEREAS,the Village of Oak Brook(hereinafter referred to as the"Village")is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois; WHEREAS,the Village has in full force and effect a codified set of ordinances which are of a general and permanent nature,which said codified set is known and designated as the Village Code of the Village of Oak Brook,as amended; WHEREAS, pursuant to Illinois Motor Vehicle Code the Village has the authority to regulate traffic within the corporate boundaries of the Village; WHEREAS,Title 7,Chapter 2 provides for regulation of streets and thoroughfares within the corporate boundaries of the Village of Oak Brook; WHEREAS,the Village by and through it's the Village of Oak Brook Police Department continuously monitors and reviews traffic and traffic patterns within the corporate boundaries of the Village; WHEREAS,due to numerous resident concerns relating to speeding and unsafe operation of automobiles,the Police Department has been monitoring 35th Street between Midwest Road and Meyers Road for several years; WHEREAS,the Police Department has closely examined the issues and concerns and is of the opinion that certain traffic calming measures be implemented in the area: WHEREAS, the Police Department has recommended that a No Passing Zone be implemented on 35th Street,West of Midwest Road,East of Meyers Road in order to provide for increased traffic safety and traffic calming;and WHEREAS,the Corporate Authorities of the Village of Oak Brook are of the opinion that that it is in the best interests of the safety, health and welfare of the residents to amend the village's code of ordinances as referenced herein. NOW, THEREFORE, BE IT ORDAINED, in open meeting assembled by the Village President and Board of Trustees of the Village of Oak Brook,Cook and DuPage Counties,Illinois as follows: Section One-Recitals The Board of Trustees hereby find that all of the recitals hereinbefore stated as contained in the preamble to this ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this ordinance as legislative findings. 2 Section Two—Amend Title 7 Chapter 2 Section 7-2-1 Title 7 Chapter 2 Section 7-2-1 shall be amended by the addition of the following Schedule: Schedule XVIII The following streets shall be marked accordingly to provide for no passing zones: Schedule XVIII Traffic On No Passing Zone 35th Street West of Midwest Road-East of Meyers Road Section Three—Codification The title, chapter(s)and section(s)adopted by this Ordinance shall be numbered and placed in an appropriate title, chapter(s), and sections(s) sections when and during the codification of the Oak Brook Municipal Code. Section Four-Conflict Clause That all ordinances,parts of ordinances or board actions in conflict with the terms of this ordinance shall be repealed to the extent of said conflict. Section Five—Effective Date These provisions of the Village Code amended herein shall become effective as of publication as required by law. Section Six-Constitutionality Clause Any part or parts of this ordinance declared by a court of law to be invalid or unconstitutional shall not affect the validity of the remaining provisions of this ordinance or the Oak Brook Municipal Code. Section Seven-Passage Clause That this ordinance shall take full force and effect from and after its passage,approval and publication as provided by law. Section Eight-Publication This ordinance shall be published in book or pamphlet form as provided by the Illinois Municipal Code. 3 Section Nine-Recording This ordinance shall be entered into the minutes and upon the journals of the Board of Trustees of the Village of Oak Brook.
