SUBJECT: Revision to the Village Code for the Oak Brook Public Library
FROM: Jacob Post, Head Librarian, and the Library Commission
BUDGET IMPACT: Forgoing approximately$3,000 a year in fines.
RECOMMENDED MOTION: I move that the Village Board approve and pass
Ordinance 2020-LY-G-1172, An Ordinance Amending Title 11, Chapter 1, Section 3 of
the Village Code of Oak Brook, Illinois by Revising the Fee Schedule.
Background/History:
The Library's General Policy is reviewed and/or revised as needed by the Head Librarian
and Library Commission. It was most recently reviewed at the October 19, 2020 Library
Commission meeting. The Commission voted unanimously to update the policy. The
revisions include grammatical changes and an update of the fines/fee structure. The update
includes no longer charging overdue fines on items returned late. The General Policy was
last updated on June 12, 2018. Because the changes to the General Policy include fees, the
Village Code for the Library needs to be updated as well to reflect the changes.
Recommendation
Staff recommends that the Village Board approve Ordinance 2020-LY-G-1172, An

Of The Village Code Of Oak Brook,Illinois
By Revising The Fee Schedule
WHEREAS,the Library Commission and Head Librarian have recommended amending Chapter 1,
entitled"Municipal Library'of Title 11,entitled"Library",of the Village Code of the Village of Oak Brook;
and
WHEREAS,the Village President and Board of Trustees have reviewed these amendments and have
approved the changes recommended by the Village Manager.
NOW,THEREFORE,BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF OAK BROOK,DU PAGE AND COOK COUNTIES,ILLINOIS as follows:
Section 1:That the provisions of the preamble hereinabove set forth are hereby adopted as though fully
set forth herein.
Section 2:That Chapter 1 of Title 11 of the Village Code of the Village of Oak Brook is amended to read
as set forth in the attached exhibit labeled Exhibit A and incorporated herein by reference.
Section 3:All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to
the extent of the conflict.
Section 4:This ordinance shall be in full force and effect from and after its passage,approval and
publication as required by law.

11-1-1:LIBRARY CREATED:
Pursuant to 75 Illinois Compiled Statutes 40/1 et seq.,there is hereby created the Oak Brook free public
library.The operations of the Oak Brook free public library shall be governed by the general policy
adopted by the village board,as may be amended from time to time.(Ord.5-225,5-25-1971;Ord.G-
539,8-9-1994;Ord.G-565,12-12-1995)
11-1-2:DEFINITIONS:
SENIOR CITIZEN:Any person sixty(60)years of age or older.
STUDENT:Any person eighteen(18)years of age or under who is enrolled as a student in preschool
through twelfth grade.(Ord.G-565,12-12-1995;Ord.G-583,2-25-1997)
11-1-3:FEES AND CHARGES:

The maximum charge for any item not returned shall not exceed the replacement cost of such item plus
plus a five dollar($5.00)processing fee.
Library users shall pay the costs incurred by the library in providing photocopies,printouts from
computers or other services requiring specialized equipment;the library
director shall determine these costs on a per unit basis from time to time.
In house online searches and outsourced searches will be used at the discretion of the librarians.If an
Oak Brook cardholder requests online or outsourced searches,the requester shall pay the database
charges incurred by the search before search results are provided.Charges are determined by the actual
