Final engineering approval of the final plat of consolidation; and 2. Authorization for the Village Attorney to prepare the necessary resolution approving and adopting the final plat of consolidation at the October 27, 2020 Board of Trustees meeting. Background/History: The applicant and owner of the property, Luai Abuhilal has submitted a petition requesting approval of a final plat of consolidation to combine four(4) existing nonconforming lots into one lot consisting of 3/ acres or 34,174 ft2. The property is zoned R-3 Single-Family and is improved with a single-family home that the owner plans to demolish in order to construct a new single- family home in its place. The minimum lot area in the R-3 District is 25,000 ft2 and minimum lot width is 100'. The proposed new lot complies with the applicable district requirements for both lot size and lot width. A zoning variation petition has also been submitted separately and received an affirmative recommendation from the Zoning Board of Appeals (ZBA) on October 6, 2020 for a rear yard setback reduction from 40' to 31'. All PC members were in attendance in addition to the petitioner. Staff and the petitioner provided an overview of the application to the PC members and explained the request. The PC did discuss the request and raised several questions about the new single-family home plans and the possibility of construction traffic. No members of the public spoke at the public meeting and no written comments were submitted to the PC concerning the request. A more detailed account of the above-related commentary can be reviewed in the Plan Commission meeting minutes provided in the packet. Recommendation: The final plat is in technical compliance with the Village's subdivision and zoning regulations and no variations are being requested for the lot area or lot width. The subdivision plat is also consistent with the Village's 1990 comprehensive land use plan which references single-family residential in this particular location. An affirmative recommendation was provided by the Plan Commission with a vote of 7-0 subject to the accompanying conditions in the Recommended Motion. This recommendation is also being forwarded to the Board of Trustees for additional review, consideration and a final decision. The request to combine the four (4) lots will create a single lot of 0.784 acres or 34,174 square feet. The existing lots consist of Lot 116— 7,344 square feet, Lot 117 — 7,342.99 square feet, Lot 118 — 13,503.66 square feet and Lot 124— 7,344 square feet. The owner intends to demolish the existing home and construct a new single-family home in its place.The minimum required lot area in the R-3 district is 25,000 square feet and the lots when consolidated will exceed the lot sizes immediately adjacent to the property. The front building setback was originally at 35 feet and this proposal brings the setback line to 40 feet to comply with the R-3 district standard. The Commission was in receipt of the village consultant engineer's written review, which complies with the village's subdivision regulations and recommended approval of the final plat subject to his review and approval prior to recording. The Commission was made aware of the petitioner's additional request for a variation that will have a public hearing before the Zoning Board of Appeals. See the application, proposed plat and other relevant materials in the case file for additional information regarding the requested final plat. Public Comment All interested parties were notified of the virtual public meeting. No one signed up to speak in support of or in opposition to the request. 9. She reviewed the rules and procedures for discussion, deliberation and voting. She asked for an overview of the request. Luai Abuhilal, 325 Brentwood Place, Downers Grove, owner of 3004 Lincoln and the 3 lots that abut the property provided a brief explanation of the petition to consolidate the four lots. He explained the four existing parcels were non-conforming and stated that consolidating the lots would bring the property into compliance with R-3 district zoning standards. His family was excited to become part of the Oak Brook community. Member Doyle was in support of the consolidation. He raised concerns about construction traffic during the building process due to the width of Lincoln Road. He wanted assurance there would be enough space in case emergency service vehicles had to enter. There are handicap persons living on Lincoln Road. Planner Von Drasek responded that the village engineer would be reviewing the construction site and that designated staging areas would be required. She believed the lot was large enough to accommodate staging areas. Mr. Abuhilal mentioned he was a civil engineer and aware of the concerns. The new home will be set back 10-feet further from Lincoln Road than the existing home. The entire lot should provide enough space for construction vehicles to park. He did not believe any construction vehicle would affect road movement. Planning Technician Polanek noted that the building permit requires the submittal of a construction vehicle-parking plan. Planner Von Drasek added that the village building inspectors and consulting engineer would likely observe if there was a violation to the parking plan. Member Iyer was also in support of the consolidation and wanted to know when the members would have the opportunity to see the new home plans. Planner Von Drasek reminded the Commission that the petition was for the plat of consolidation and the design of the home was not part of the discussion. Mr. Abuhilal said he had preliminary designs for the house and has a variation before the Zoning Board of Appeals in October. The plans are to build an approximate 6500 square-foot French chateaux style 2-story home for his family. Chairwoman Tropinski asked the petitioner if he felt that he had the ability to present his petition adequately and if he was comfortable with the Plan Commission moving forward with a motion. Mr. Abuhilal responded that he was. Chairwoman Tropinski noted that there were no public comments. Motion by Member Wilczak, seconded by Member Lal to recommend approval of the Final Plat to consolidate the three parcels and property at 3004 Lincoln Road, subject to the following condition: 1. This lot area will exceed the size of lots adjacent to the property and in this neighborhood. The lots immediately adjacent to the property are 26,208 SF(East), 14,696 SF (South), and 20,862 SF (West). • The proposal complies with the minimum lot size, lot frontage and setback requirements for the R-3 Single-Family Detached Residence District. • The Westchester Park Subdivision front building setback was originally at 35 feet, this proposal brings the setback line to 40 feet to comply with the R-3 District standard. • A Variation was granted to the property in 1974, Ordinance S-294. The Variation approval included a restrictive covenant, which prohibits access to Grant Road from Lot 124. • One zoning variation is being requested to allow for a portion of the proposed house to be within 31 feet of a rear property line.
