Illinois 60523 ORDINANCE 98-ZO-SU-S-906 AN ORDINANCE GRANTING A SPECIAL USE FOR DRIVE THROUGH PRESCRIPTION PICK UP (220522 nd Street, Oak Brook, IL 60523) WHEREAS, the contract purchaser of the property at 2205 22nd Street has applied to the Village for a special use to permit construction of two drive-through lanes for prescription pick-up; and WHEREAS, the Plan Commission on May 18, 1998 recommended approval of the requested special use subject to certain conditions; and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on June 2, 1998 pursuant to due and appropriate legal notice; and WHEREAS, the Zoning Board of Appeals recommended approval of the requested Special Use subject to certain conditions; and WHEREAS, the President and Board of Trustees have reviewed the recommendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set forth below: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That a special use, pursuant to Section VII(E)(2)(c) of the Code of Ordinances of the Village of Oak Brook is granted to permit the construction of two drive-through lanes at the property commonly known as 2205 22nd Street and legally described as follows: Lot 1 (except the West 144.79 feet thereof) and (except that part beginning at the point of intersection of the North line of said Lot 1 and the West line of Midwest Road; thence South 0 degrees 24 minutes 59 seconds West along said West line of Midwest Road a distance of 30.31 feet; thence North 89 degrees 35 minutes 01 second West 10.00 feet; thence North 0 degrees 24 minutes 59 seconds East 29.97 feet to the North line of said Lot 1; thence North 88 degrees 27 minutes 28 seconds East along said North line of Lot 1 a distance of 10.01 feet to the place of beginning) and that part of Lot 3 lying East of the East line of the West 144.79 feet of said Lot 1 extended South, in Lestak's 22nd Street Assessment Plat in the Northwest Quarter of Section 27, Township 39 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded December 19, 1956 as Document 827346 in DuPage County, Illinois. Section 3: That the special use permit herein granted pursuant to Section 2 of this Ordinance is expressly subject to compliance with the following conditions: Ordinance 98-ZO-SU-S-906 Granting a Special Use Permit Drive-Througn Prescription Pick Up 2205 22nd St., Page 2 a. That the two drive through lanes for prescription pick up be constructed substantially in conformance with the Site Plan prepared by Stewart Nasky Architects, Ltd., dated April 14, 1998, and incorporated herein by reference. b. That on-site traffic signage shall be incorporated to alert customers wishing to travel north on Midwest Road to use the 22nd Street exit. C. That the drive through lanes for prescription pick-up shall be substantially completed on or before July 14, 2000. In the event this condition is not satisfied, this Special Use Permit shall automatically become null and void without further action by the Village Board. d. That the Special Use Permit herein granted shall automatically lapse and expire without further action by the Village Board at such time as the use of the subject property ceases to be used as a Walgreen's pharmacy. Section 4: That this ordinance shall be in full force and effect from and after passage and approval pursuant to law. PASSED THIS 14thday of July, 1998.
