SUBJECT: Hotel and Tourism District 2% Infrastructure Fund - Windsor Drive

RECOMMENDED MOTION: I Move to Approve Resolution 2021-HTL/MTL-FUND-
R-1926,a Resolution Authorizing the Use of Hotel/Motel Infrastructure Funds for the
North Windsor Drive Widening and Beautification Improvements Project.
Background/History:
At the January 12th Board meeting there was discussion regarding using the 2%Hotel
Infrastructure Fund, which is earmarked for infrastructure costs in the Hotel District, for the
widening of Windsor Drive. This roadway is in the Hotel and Tourism District and the new Hyatt
House Hotel is located there since September of 2017. The projected remaining costs is
approximately $3,806,250 dollars. Presently, we have $4,425,000 in the 2%Hotel Infrastructure
Fund. There was Board consensus to do so and they asked staff to bring forward a resolution
authorizing the use of those funds for Windsor Drive.
Recommendation:
The resolution is passed as presented.

A RESOLUTION AUTHORIZING
CERTAIN EXPENDITURES TO BE
ALLOCATED AND PAID FROM
THE HOTEL&TOURISM FUND FOR
THE NORTH WINDSOR DRIVE WIDENING AND
BEAUTIFICATION IMPROVEMENTS PROJECT
WHEREAS,the Village of Oak Brook(hereinafter referred to as the"Village")is an Illinois
Municipal Corporation organized pursuant to the laws of the State of Illinois;
WHEREAS,the Village has the authority to adopt ordinances and to promulgate rules and
regulations that pertain to its government and affairs that protect the health,safety and welfare of
its residents including the adoption and imposition of certain taxes;
WHEREAS,the Village pursuant to 65 ILCS 5/8-3-4 has previously adopted a Hotel and
Motel Tax which has been implemented for the purpose of promoting tourism and conventions or
otherwise to attract nonresident overnight visitors to the Village of Oak Brook;
WHEREAS, the Village currently utilizes the funds derived from said tax to promote
tourism and conventions as well as provide certain infrastructure improvements that will enhance
those designated areas and zones in which hotels and motels are located in order to support the
continued development and patronage of those areas,zones and the Village at large;
WHEREAS, the Village is currently in the process of making certain improvements to
Windsor Drive which will only augment and further support the hotels and motels in the designated
area and zone further enhancing the ability of the patrons to utilize the services of those
businesses in the respective areas and zones as well as throughout the Village;
WHEREAS,the Corporate Authorities of the Village desire to allocate funds from the Hotel
and Tourism Fund to assist in the payment for the improvements in and around Windsor Drive,
currently referred to as The North Windsor Drive Widening and Beautification Improvements
Project;
WHERAS, the Corporate Authorities of the Village of Oak Brook further find that the
allocation and use of the funds from the Hotel &Tourism Fund is necessary and proper and
without the use of said funds the project referenced herein would be unable to proceed;and
WHEREAS,the Corporate Authorities of the Village of Oak Brook are of the opinion that
that it is in the best interests of the safety,health and welfare of the residents to allocate the funds
as referenced herein.
NOW, THEREFORE, BE IT RESOLVED, in open meeting assembled by the Village
President and Board of Trustees of the Village of Oak Brook,Cook and DuPage Counties,Illinois
as follows:

Section One-Recitals
The Board of Trustees hereby find that all of the recitals hereinbefore stated as contained
in the preamble to this resolution are full,true and correct and do hereby,by reference,incorporate
and make them part of this resolution as legislative findings.
Section Two—Allocation of Hotel&Tourism Funds/Windsor Drive Improvements
The Village Board hereby authorizes the use of funds from the Hotel&Tourism Fund in
an amount not to exceed $3,806,250.00 (three million eight hundred and six thousand two
hundred fifty dollars and no cents)for the purpose of assisting in the payment of enhancements
and improvements to Windsor Drive otherwise referred to as the North Windsor Drive Widening
and Beautification Improvements Project.
Section Three—Effective Date
This resolution shall be in full force and effect from and after its passage, approval and
publication as provided by law.
Section Four-Conflict Clause
That all resolutions,parts of resolutions or board actions in conflict with the terms of this
resolution shall be repealed to the extent of said conflict.
Section Five-Passage Clause
That this resolution shall take full force and effect from and after its passage,approval and
publication as provided by law.
Section Six-Constitutionality Clause
If any section, paragraph,clause or provision of this resolution is declared by a court of
law to be invalid or unconstitutional,the invalidity or unconstitutionality thereof shall not affect the
validity of any other provisions of this resolution,which are hereby declared to be separable.
Section Seven-Publication
This resolution shall be published in book or pamphlet form as provided by the Illinois
Municipal Code.
Section Eight-Recording
This resolution shall be entered into the minutes and upon the journals of the Board of
Trustees of the Village of Oak Brook.
