S-729 - 03/10/1992 - SPECIAL USE - OrdinancesH 9 2 10 1.4 L? 92 MAY 29 PH 1: 45 ORDINANCE S-729 AN ORDINANCE AMENDING 'ORDINANCE S-583 AND GRANTING AN AMENDED SPECIAL USE PERMIT (CHRIST CHURCH - 501 OAK BROOK ROAD) DA,C 3'QooK , -14 WHEREAS, on August 10, 1971 the corporate authorities of the Village of Oak Brook passed Ordinance S-237, which approved a special use for the property hereinafter described for construction of a church sanctuary and steeple; and WHEREAS, on October 28, 1975 and October 25, 1983, the corporate authorities of the Village of Oak Brook passed Ordinances S-346 and S-511, respectively, which amended the aforementioned special use by permitting additional parking; and WHEREAS, on April 22, 1986, the corporate authorities of the Village of Oak Brook passed Ordinance S-583, granting a special use to permit the construction of two additions to the. church, 136 additional parking space and various roadway and grading modifications; and WHEREAS, the owners of said property have applied to the Village for an amendment to said special use to permit construction of a choir rehearsal room and additional classrooms; and WHEREAS, the Plan Commission on January 20, 1992, recommended approval of the requested amendments to the special use; and WHEREAS, a public hearing thereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on February 4, 1992, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and Plan Commission that the amendment to special use be granted; and WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning Board of Appeals and Plan commission and deem the passage of this ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions set forth below; µ . NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. Section 2: That the special use granted pursuant to Ordinances S-237, S-346, S-511 and S-583 be and are hereby further amended to permit the construction of a choir rehearsal room and additional classrooms to the church. If the property owner fails to meet the conditions of this section, this special use permit shall automatically terminate and be of no further force and effect. Section 4: That this ordinance is limited to property located at 501 Oak Brook Road and 3202 York Road, Oak Brook, Illinois, which property is legally described as: Lot 1 in the Christ Church Resubdivision of part of the Northwest Quarter of Section 36, Township 39 North, Range 11, East of the Third Principal Meridian, in DuPage County, Illinois, recorded on the 9th day of September, 1986 as U,rument No. R86_,�07588. Trustee Krafthefer moved that the Oak Brook Park District, a governmental unit, be rebated the utility tax charge retroactive to its passage. Motion failed due to lack of a second. Christ Church has petitioned the Village for an amendment to their Special Use to allow construction of a choir rehearsal room and additional classrooms. Their petition is in compliance with the zoning ordinance requirements for this Special Use and with the underlying requirements of the zoning district. Their petition is in compliance with the zoning ordinance requirements for this Special Use and with the underlying requirements of the zoning district. The Plan Commission reviewed this request at its -meeting of January 20, 1992, and the Zoning Board of Appeals held the required public hearing on February 4, 1992. Both have recommended approval and found that the request is in accordance with the necessary standards. There was no public testimony in opposition to this request. If it is your wish to approve this request, it would be appropriate to authorize the attorney to draft the necessary ordinance. The following points were covered: a) The flooding experience of the property. b) The concrete wall and earth berm design. c) A portion of the front yard is protected to allow vehicular access. d) Compensatory storage is provided at a 1 to 1 ratio. e) The IDOT/DWR permit has been issued. f) The proposed Elmhurst quarry will Lower flood elevations; however, the petitioner does not want to rely on this since it may never be built and in any case this flood proofing system will provide additional protection. g) The factors relating to Flood Plain Special Use were reviewed. ALL findings were positive. The Plan Commission recommended approval with waiver of full compensatory storage requirments at their meeting of January 20, 1992. Compensatory storage at a 1 to 1 ratio is now included in the revised plan. Dale Durfey reported that most of his concerns were minor design details or housekeeping items except for the following: a) The revised compensatory storage plan still has to be analyzed. b) The flood proofing protects considerably more property than just the home. S- 583 AN ORDINANCE AMENDING ORDINANCES 5-237, S-346 AND 5-511 AND GRANTING AN AMENDED SPECIAL USE PERMIT (CHRIST CHURCH - 501 OAK BROOK ROAD and 3202 YORK ROAD) WHEREAS, an August 10, 1971 the Corporate Authorities of the Village of Oak Brack passed Ordinance No. S-237, which approved a special use for the property hereinafter described for construction of a church sanctuary and steeple; and WHEREAS, on October 28, 1975 and October 25, 1983, the Corporate Authorities of the Village of Oak Brook passed Ordinance Nos. 5-346 and 5-511 respectively, which amended the aforementioned special use by permitting additional parking; and WHEREAS, the owners of said property have applied to the Village for an amendment to said special use to permit construction of two additions to the Church, additional parking spaces and various roadway and grading modifications; and WHEREAS, the Plan Commission on February 17, 1986 recommended approval of the requested amendments to the special use; and WHEREAS, a public hearingthereon was conducted by the Zoning Board of Appeals of the Village of Oak Brook on March 4, 1986 and April 1, 1986, pursuant to due and appropriate legal notice; and WHEREAS, a recommendation has been made by both the said Zoning Board of Appeals and Plan Commission that the amendment to special use be granted; and WHEREAS, the President and Board of Trustees concur with the recommendations of the Zoning Board of Appeals and Plan Commission and deem the passage of this Ordinance to be in the best interest and in furtherance of the general welfare of the Village of Oak Brook, subject to the conditions and restrictions set forth below; NOW,THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF OAK BROOK, DU PAGE AND COOK COUNTIES, ILLINOIS as follows: Section 1: That the provisions of the preamble hereinabove set forth are hereby adopted as though fully set forth herein. - Section 2: The the special use granted pursuant to Ordinances Nos. 5-237, S-346 and 5-511 be and are hereby further amended to permit the construction .of two additions to the Church, 136 additional parking spaces and various roadway and grading modifications hereinafter described.
