RECOMMENDED MOTION: I move that the Village Board awards a contract to the lowest
responsible bidder with the lowest responsive bid, Era Valdivia Contractors, Inc.,
Chicago, Illinois, for the East and West Elevated Water Tanks Exterior Painting Project,
based on the unit prices in the attached bid tabulation,for an estimated total project price of
$728,400.00,and that the Village Board approves Resolution R-1936.
Backeround/History:
A solicitation for bids for the East and West Elevated Tanks Painting Project was posted on Village
website on Tuesday, January 26, 2021. Three (3) sealed bids were received and opened on
Tuesday,February 23,2021. Dixon Engineering,Inc. (our consulting engineer)recommends that
we award the contract to the lowest responsible and responsvie bidder, Era Valdivia Contractors,
Inc. (see attached letter). Dixon Engineering, Inc. has received and reviewed references for Era
Valdivia Contractors,Inc.and has prequalified them as a painting contractor for this scope of work.
The East and West Elevated Water Tanks Painting Project consists of exterior overcoat,wet interior
repaint, dry interior spot repaint, and miscellaneous repairs. Painting and repairs of the East and
West Water Tanks will begin on or after April 15, 2021, with a substantial completion date of
October 29, 2021. The maximum days that each tank will be out of service will be 35 days.
Recommendation:
That the Village Board awards a contract to the lowest responsible bidder with the lowest
responsive bid, Era Valdivia Contractors, Inc., Chicago, Illinois, for the East and West Elevated �G
Water Tanks Exterior Painting Project, based on the unit prices in the attached bid tabulation, for
an estimated total project price of$728,400.00,and that the Village Board approves Resolution R-
1936.

A RESOLUTION
APPROVING AND AUTHORIZING
THE AWARD OF A CONTRACT
FOR THE EAST&WEST ELEVATED WATER
TANKS PAINTING PROJECT
WHEREAS, the Village of Oak Brook (hereinafter referred to as the "Village") upon
approval of the corporate authorities may enter into a Contract with another party pursuant to
Illinois Statute;
WHEREAS, the Village pursuant to the requirements of the Illinois Municipal Code 65
ILCS 5/8-9-1 previously advertised for and received sealed bids regarding the East and West
Elevated Water Tanks Painting Project(hereinafter referred to as the"Project');
WHEREAS, due to the exterior wear the Village has identified the need to repaint the
water tanks,further delay in repainting said tanks could result in additional costs requiring the
removal of the existing layer of paint;
WHEREAS, the Village Board previously engaged the services of an engineer and
authorized the solicitation of bids;
WHEREAS,the bids for the Project referenced herein were opened and read on Tuesday,
February 23, 2021 at the Oak Brook Village Hall, 1200 Oak Brook Road, Oak Brook, Illinois,
60523;
WHEREAS, the sealed bids were reviewed by the Village of Oak Brook Staff and the
Village's Consulting Engineer, whereby a Letter of Recommendation was prepared, a copy of
which is attached hereto and made a part hereof as Exhibit A;
WHEREAS, it is the recommendation of the Village of Oak Brook Staff and Village
Engineer to award the contract to the lowest responsible bidder with the lowest responsive bid,
Era Valdivia Contractors,Inc.,in the amount of approximately$728,400.00,a copy of the contract
is attached hereto as Exhibit B;and
WHEREAS,the Village of Oak Brook Corporate Authorities feel that it is in the best interest
of the Village of Oak Brook to award the contract to the lowest responsible bidder as provided for
herein.
NOW,THEREFORE,BE IT RESOLVED by the Village President and Board of Trustees
of the Village of Oak Brook,DuPage and Cook Counties,Illinois as follows:
Section One-Recitals
The Corporate Authorities hereby find that all of the recitals herein before stated as
contained in the preamble to the resolution are full,true and correct and do hereby,by reference,
incorporate and make them part of this resolution as legislative findings.

Section Two—Approval and Acceptance of Bid and Contract
The Village hereby accepts the bid from the bidder set forth herein as the lowest
responsible bidder and approves the Contract substantially in the form attached hereto as Exhibit
B. The officials of the Village executing the same,their execution thereof to constitute exclusive
evidence of their approval to any and all changes or revisions therein from and after the execution
and delivery of such Agreement.
Section Three—Authorization and Direction
The Village Manager is hereby authorized,empowered and directed to sign,and the Village
Clerk to attest thereto,the contract presented herein and any finally negotiated terms as set forth
therein.
Section Four-Other Actions Authorized
The officers, employees and/or agents of the Village shall take all actions necessary or
reasonably required to carry out and give effect to the intent of this resolution and otherwise to
consummate the transactions contemplated herein, and shall take all actions necessary in
conformity therewith including, without limitation, the execution and delivery of all documents
required to be delivered in connection with the transaction contemplated herein.
Section Five-Authorization of Expenditures
The Corporate Authorities hereby authorize and direct the expenditure of all costs related
to the execution of the Contract,additionally,the Village is authorized and directed to allocate and
spend all necessary funds to fulfill the requirements of the Contract and of this resolution.
Section Six-Acts of Village Officials
That all past,present and future acts and doings of the officials of the Village that are in
conformity with the purpose and intent of this resolution are hereby, in all respects, ratified,
approved,authorized and confirmed.
Section Seven—Prevailing Wage Act
The successful bidder shall be required to comply with all of the terms and conditions of
the Illinois Prevailing Wage Act,to the extent that it applies.
Section Eight—Effective Date
This resolution shall be in full force and effect from and after its passage, approval and
publication as provided by law.
Section Nine-Conflict Clause
That all resolutions,parts of resolutions or Board actions in conflict with the terms of this
resolution shall be repealed to the extent of said conflict.

Section Ten - Passage Clause
That this resolution shall take full force and effect from and after its passage, approval and
publication as provided by law.
Section Eleven — Publication
This resolution shall be published in book or pamphlet form as provided by the Illinois
Municipal Code.
Section Twelve — Saving Clause
If any section, paragraph, clause or provision of this resolution is declared by a court of
law to be invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not affect the
validity of the remaining provisions of the resolution, which are hereby declared to be separable.
Section Thirteen — Recording
This resolution shall be entered into the minutes and upon the journals of the Board of
Trustees of the Village of Oak Brook.

Dear Mr. Patchin:
Dixon Engineering, Inc. has reviewed the bids submitted for the rehabilitation and
repainting of the exterior of the Village's 250,000-gallon spheroid East& West tanks.
We recommend award to the low bidder, Era Valdivia Contractors, Inc. of Chicago, IL in
the amount of$728,400. This includes all line items on the Schedule of Values and the
exterior bowl dark topcoat alternate. Bidding was very competitive with three (3)bids
received,the highest bid coming in at $961,000 and the lowest at $728,400.
Era Valdivia Contractors, Inc. is a prequalified painting contractor with Dixon
Engineering for this scope of work.
Enclosed for your review and action are three (3) copies of the notice of award, should
you decide to award this project to Era Valdivia Contractors, Inc. After Village approval,
please sign and forward all copies to the contractor for signature. Instruct the contractor
to return one copy to you, forward a copy to our office, and retain a copy for his files.
Also, please notify the contractor that he is to forward to our office the required bonds
and certificate(s) of insurance for inclusion in the contract documents. We ask that you
do this as the contract is between Oak Brook, IL. and the contractor. The contractor has
our mailing address.

The Owner has considered the Bid submitted by you for the above described work in response to its
Advertisement for Bids and Information for Bidders dated February 23,2021.
You are hereby notified that your Bid has been accepted for the line items listed in the Project Scope in
the amount of$728,400.
Work to begin on the East Tank on or after April 15, 2021, with Substantial Completion by July
1, 2021 including cure and disinfection time. Work to begin on the West Tank on or after
August 16, 2021, with Substantial Completion by October 29, 2021 including cure and
disinfection time. Each tank may be out of service a maximum of thirty-five (35) days.
You are required by the Information for Bidders to execute the Agreement and furnish the required
Contractor's Performance Bond,Payment Bond, and Certificate(s)of Insurance within ten (10)calendar
days from the date of this Notice to you. If you fail to execute said Agreement and to furnish said Bonds
within ten days from the date of this Notice, said Owner will be entitled to consider all your rights arising
out of the Owner's acceptance of your Bid as abandoned and as a forfeiture of your Bid Bond. The
Owner will be entitled to such other rights as may be granted by law.
You are required to return an acknowledged copy of this NOTICE of AWARD to the Owner.
